55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the regulation of the practice of cosmetology.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 1602.002(a), Occupations Code, is
1010 amended to read as follows:
1111 (a) In this chapter, "cosmetology" means the practice of
1212 performing or offering to perform for compensation any of the
1313 following services:
1414 (1) treating a person's hair by:
1515 (A) providing any method of treatment as a
1616 primary service, including arranging, beautifying, bleaching,
1717 cleansing, coloring, cutting, dressing, dyeing, processing,
1818 shampooing, shaping, singeing, straightening, styling, tinting, or
1919 waving;
2020 (B) providing a necessary service that is
2121 preparatory or ancillary to a service under Paragraph (A),
2222 including bobbing, clipping, cutting, or trimming; or
2323 (C) cutting the person's hair as a separate and
2424 independent service for which a charge is directly or indirectly
2525 made separately from charges for any other service;
2626 (2) weaving or braiding a person's hair;
2727 (3) shampooing and conditioning a person's hair;
2828 (4) servicing a person's wig or artificial hairpiece
2929 on a person's head or on a block after the initial retail sale and
3030 servicing in any manner listed in Subdivision (1);
3131 (5) treating a person's mustache or beard by
3232 arranging, beautifying, coloring, processing, styling, or
3333 trimming;
3434 (6) cleansing, stimulating, or massaging a person's
3535 scalp, face, neck, or arms:
3636 (A) by hand or by using a device, apparatus, or
3737 appliance; and
3838 (B) with or without the use of any cosmetic
3939 preparation, antiseptic, tonic, lotion, or cream;
4040 (7) beautifying a person's face, neck, or arms using a
4141 cosmetic preparation, antiseptic, tonic, lotion, powder, oil,
4242 clay, cream, or appliance;
4343 (8) administering facial treatments;
4444 (9) removing superfluous hair from a person's body
4545 using:
4646 (A) depilatories;
4747 (B) wax; or
4848 (C) mechanical tweezers;
4949 (10) treating a person's nails by:
5050 (A) cutting, trimming, polishing, tinting,
5151 coloring, cleansing, or manicuring; or
5252 (B) attaching false nails; or
5353 (11) massaging, cleansing, treating, or beautifying a
5454 person's hands or feet.
5555 SECTION 2. This Act takes effect September 1, 2009.
