7 | 7 | | relating to the regulation of the practice of cosmetology. |

8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Section 1602.002(a), Occupations Code, is |
---|
10 | 10 | | amended to read as follows: |
---|
11 | 11 | | (a) In this chapter, "cosmetology" means the practice of |
---|
12 | 12 | | performing or offering to perform for compensation any of the |
---|
13 | 13 | | following services: |
---|
14 | 14 | | (1) treating a person's hair by: |
---|
15 | 15 | | (A) providing any method of treatment as a |
---|
16 | 16 | | primary service, including arranging, beautifying, bleaching, |
---|
17 | 17 | | cleansing, coloring, cutting, dressing, dyeing, processing, |
---|
18 | 18 | | shampooing, shaping, singeing, straightening, styling, tinting, or |
---|
19 | 19 | | waving; |
---|
20 | 20 | | (B) providing a necessary service that is |
---|
21 | 21 | | preparatory or ancillary to a service under Paragraph (A), |
---|
22 | 22 | | including bobbing, clipping, cutting, or trimming; or |
---|
23 | 23 | | (C) cutting the person's hair as a separate and |
---|
24 | 24 | | independent service for which a charge is directly or indirectly |
---|
25 | 25 | | made separately from charges for any other service; |
---|
26 | 26 | | (2) weaving or braiding a person's hair; |
---|
27 | 27 | | (3) shampooing and conditioning a person's hair; |
---|
28 | 28 | | (4) servicing a person's wig or artificial hairpiece |
---|
29 | 29 | | on a person's head or on a block after the initial retail sale and |
---|
30 | 30 | | servicing in any manner listed in Subdivision (1); |
---|
31 | 31 | | (5) treating a person's mustache or beard by |
---|
32 | 32 | | arranging, beautifying, coloring, processing, styling, or |
---|
33 | 33 | | trimming; |
---|
34 | 34 | | (6) cleansing, stimulating, or massaging a person's |
---|
35 | 35 | | scalp, face, neck, or arms: |
---|
36 | 36 | | (A) by hand or by using a device, apparatus, or |
---|
37 | 37 | | appliance; and |
---|
38 | 38 | | (B) with or without the use of any cosmetic |
---|
39 | 39 | | preparation, antiseptic, tonic, lotion, or cream; |
---|
40 | 40 | | (7) beautifying a person's face, neck, or arms using a |
---|
41 | 41 | | cosmetic preparation, antiseptic, tonic, lotion, powder, oil, |
---|
42 | 42 | | clay, cream, or appliance; |
---|
43 | 43 | | (8) administering facial treatments; |
---|
44 | 44 | | (9) removing superfluous hair from a person's body |
---|
45 | 45 | | using: |
---|
46 | 46 | | (A) depilatories; |
---|
47 | 47 | | (B) wax; or |
---|
48 | 48 | | (C) mechanical tweezers; |
---|
49 | 49 | | (10) treating a person's nails by: |
---|
50 | 50 | | (A) cutting, trimming, polishing, tinting, |
---|
51 | 51 | | coloring, cleansing, or manicuring; or |
---|
52 | 52 | | (B) attaching false nails; or |
---|
53 | 53 | | (11) massaging, cleansing, treating, or beautifying a |
---|
54 | 54 | | person's hands or feet. |
---|
55 | 55 | | SECTION 2. This Act takes effect September 1, 2009. |
