55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to an alcohol awareness component of the health curriculum
88 used in public schools.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 28.002, Education Code, is amended by
1111 adding Subsection (r) to read as follows:
1212 (r) The State Board of Education shall adopt essential
1313 knowledge and skills that address the dangers, causes,
1414 consequences, signs, symptoms, and treatment of binge drinking and
1515 alcohol poisoning. The agency shall compile a list of alcohol
1616 awareness evidence-based programs from which a school district
1717 shall choose for use in the district's health curriculum. In this
1818 subsection, "alcohol awareness evidence-based program" means a
1919 program that, on the basis of evaluations that use valid and
2020 reliable measures and that are published in peer-reviewed journals,
2121 has been proven to effectively prevent or delay alcohol use among
2222 students.
2323 SECTION 2. This Act applies beginning with the 2009-2010
2424 school year.
2525 SECTION 3. This Act takes effect immediately if it receives
2626 a vote of two-thirds of all the members elected to each house, as
2727 provided by Section 39, Article III, Texas Constitution. If this
2828 Act does not receive the vote necessary for immediate effect, this
2929 Act takes effect September 1, 2009.
