5	5	relating to testing liquefied petroleum gas systems in certain
6	6	school facilities.
7	7	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	8	SECTION 1. Sections 113.352(a), (b), and (c), Natural
9	9	Resources Code, are amended to read as follows:
10	10	(a) Each school district shall perform leakage [pressure]
11	11	tests for leakage on the LP-gas piping system in each school
12	12	district facility at least biennially. The tests must be performed
13	13	before the beginning of the school year.
14	14	(b) The school district may perform the leakage [pressure]
15	15	tests on a two-year cycle under which the tests are performed for
16	16	the LP-gas piping systems of approximately one-half of the
17	17	facilities each year.
18	18	(c) If a school district operates one or more school
19	19	district facilities on a year-round calendar, the leakage
20	20	[pressure] test in each of those facilities must be conducted and
21	21	reported not later than July 1 of the year in which the test is
22	22	performed.
23	23	SECTION 2. Sections 113.353(a) and (b), Natural Resources
24	24	Code, are amended to read as follows:
25	25	(a) The school district shall perform the leakage
26	26	[pressure] test to determine whether the LP-gas piping system holds
27	27	at least the amount of pressure specified by the commission
28	28	[National Fire Protection Association 54, National Fuel Gas Code].
29	29	(b) The leakage [pressure] test must be conducted in
30	30	accordance with commission rules [National Fire Protection
31	31	Association 54].
32	32	SECTION 3. Sections 113.354(a) and (c), Natural Resources
33	33	Code, are amended to read as follows:
34	34	(a) A school district shall retain documentation [provide
35	35	written notice to the commission] specifying the date and the
36	36	result of each leakage [pressure] test or other inspection of each
37	37	[the] LP-gas piping system until at least the fifth anniversary of
38	38	the date the test or other inspection was performed.
39	39	(c) The commission may review a school district's
40	40	documentation of each leakage test or other inspection conducted by
41	41	the school district [shall maintain a copy of the notice provided
42	42	under Subsection (a) until at least the first anniversary of the
43	43	date the commission received the notice].
44	44	SECTION 4. The change in law made by this Act applies
45	45	beginning with the 2009-2010 school year.
46	46	SECTION 5. This Act takes effect immediately if it receives
47	47	a vote of two-thirds of all the members elected to each house, as
48	48	provided by Section 39, Article III, Texas Constitution. If this
49	49	Act does not receive the vote necessary for immediate effect, this
50	50	Act takes effect September 1, 2009.
