55 relating to testing liquefied petroleum gas systems in certain
66 school facilities.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Sections 113.352(a), (b), and (c), Natural
99 Resources Code, are amended to read as follows:
1010 (a) Each school district shall perform leakage [pressure]
1111 tests for leakage on the LP-gas piping system in each school
1212 district facility at least biennially. The tests must be performed
1313 before the beginning of the school year.
1414 (b) The school district may perform the leakage [pressure]
1515 tests on a two-year cycle under which the tests are performed for
1616 the LP-gas piping systems of approximately one-half of the
1717 facilities each year.
1818 (c) If a school district operates one or more school
1919 district facilities on a year-round calendar, the leakage
2020 [pressure] test in each of those facilities must be conducted and
2121 reported not later than July 1 of the year in which the test is
2222 performed.
2323 SECTION 2. Sections 113.353(a) and (b), Natural Resources
2424 Code, are amended to read as follows:
2525 (a) The school district shall perform the leakage
2626 [pressure] test to determine whether the LP-gas piping system holds
2727 at least the amount of pressure specified by the commission
2828 [National Fire Protection Association 54, National Fuel Gas Code].
2929 (b) The leakage [pressure] test must be conducted in
3030 accordance with commission rules [National Fire Protection
3131 Association 54].
3232 SECTION 3. Sections 113.354(a) and (c), Natural Resources
3333 Code, are amended to read as follows:
3434 (a) A school district shall retain documentation [provide
3535 written notice to the commission] specifying the date and the
3636 result of each leakage [pressure] test or other inspection of each
3737 [the] LP-gas piping system until at least the fifth anniversary of
3838 the date the test or other inspection was performed.
3939 (c) The commission may review a school district's
4040 documentation of each leakage test or other inspection conducted by
4141 the school district [shall maintain a copy of the notice provided
4242 under Subsection (a) until at least the first anniversary of the
4343 date the commission received the notice].
4444 SECTION 4. The change in law made by this Act applies
4545 beginning with the 2009-2010 school year.
4646 SECTION 5. This Act takes effect immediately if it receives
4747 a vote of two-thirds of all the members elected to each house, as
4848 provided by Section 39, Article III, Texas Constitution. If this
4949 Act does not receive the vote necessary for immediate effect, this
5050 Act takes effect September 1, 2009.
