| 5 | 5 | | relating to notification sent by the Texas Ethics Commission to |

| 6 | 6 | | certain persons regarding deadlines to file reports. |

| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 251.033, Election Code, is amended to |
|---|
| 9 | 9 | | read as follows: |
|---|
| 10 | 10 | | Sec. 251.033. NOTIFICATION OF DEADLINE FOR FILING REPORTS. |
|---|
| 11 | 11 | | (a) The commission shall notify each person responsible for filing |
|---|
| 12 | 12 | | a report with the commission under Subchapters C through F, Chapter |
|---|
| 13 | 13 | | 254, of the deadline for filing a report, except that notice of the |
|---|
| 14 | 14 | | deadline is not required for a political committee involved in an |
|---|
| 15 | 15 | | election other than a primary election or the general election for |
|---|
| 16 | 16 | | state and county officers. Notification under this subsection may |
|---|
| 17 | 17 | | be sent by electronic mail. |
|---|
| 18 | 18 | | (b) If the commission is unable to notify a person of a |
|---|
| 19 | 19 | | deadline after two attempts, the commission is not required to make |
|---|
| 20 | 20 | | any further attempts to notify the person of that deadline or any |
|---|
| 21 | 21 | | future deadlines until the person has notified the commission of |
|---|
| 22 | 22 | | the person's current address or electronic mail address. |
|---|
| 23 | 23 | | (c) Chapter 552, Government Code, does not apply to a |
|---|
| 24 | 24 | | notification under this section sent by electronic mail. |
|---|
| 25 | 25 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 26 | 26 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 27 | 27 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 28 | 28 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 29 | 29 | | Act takes effect September 1, 2009. |
