10 | 10 | administered by certain health care providers. | |
11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
12 | 12 | SECTION 1. Section 32.024, Human Resources Code, is amended | |
13 | 13 | by adding Subsection (ii) to read as follows: | |
14 | 14 | (ii) The department shall provide medical assistance | |
15 | 15 | reimbursement to a pharmacist who is licensed to practice pharmacy | |
16 | 16 | in this state, is authorized to administer immunizations in | |
17 | 17 | accordance with rules adopted by the Texas State Board of Pharmacy, | |
18 | 18 | and administers an immunization to a recipient of medical | |
19 | 19 | assistance to the same extent the department provides reimbursement | |
20 | 20 | to a physician or other health care provider participating in the | |
21 | 21 | medical assistance program for the administration of that | |
22 | 22 | immunization. | |
23 | 23 | SECTION 2. If before implementing any provision of this Act | |
24 | 24 | a state agency determines that a waiver or authorization from a | |
25 | 25 | federal agency is necessary for implementation of that provision, | |
26 | 26 | the agency affected by the provision shall request the waiver or | |
27 | 27 | authorization and may delay implementing that provision until the | |
28 | 28 | waiver or authorization is granted. | |
29 | 29 | SECTION 3. This Act takes effect September 1, 2009. |
