99 relating to medical assistance reimbursement for immunizations
1010 administered by certain health care providers.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 32.024, Human Resources Code, is amended
1313 by adding Subsection (ii) to read as follows:
1414 (ii) The department shall provide medical assistance
1515 reimbursement to a pharmacist who is licensed to practice pharmacy
1616 in this state, is authorized to administer immunizations in
1717 accordance with rules adopted by the Texas State Board of Pharmacy,
1818 and administers an immunization to a recipient of medical
1919 assistance to the same extent the department provides reimbursement
2020 to a physician or other health care provider participating in the
2121 medical assistance program for the administration of that
2222 immunization.
2323 SECTION 2. If before implementing any provision of this Act
2424 a state agency determines that a waiver or authorization from a
2525 federal agency is necessary for implementation of that provision,
2626 the agency affected by the provision shall request the waiver or
2727 authorization and may delay implementing that provision until the
2828 waiver or authorization is granted.
2929 SECTION 3. This Act takes effect September 1, 2009.
