66 AN ACT
77 relating to establishing scholarships for children of public school
88 teachers.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 61, Education Code, is amended by adding
1111 Subchapter M-1 to read as follows:
1212 SUBCHAPTER M-1. SCHOLARSHIPS FOR CHILDREN OF PUBLIC SCHOOL
1313 TEACHERS
1414 Sec. 61.721. SCHOLARSHIPS. The board shall establish and
1515 administer, in accordance with this subchapter and board rules,
1616 scholarships for students who are:
1717 (1) dependent children of public school classroom
1818 teachers; and
1919 (2) enrolled in an institution of higher education.
2020 Sec. 61.722. FACTORS. (a) The scholarships shall be
2121 established and administered in a manner that the board determines
2222 best serves the public purpose of the scholarships.
2323 (b) In determining what best serves the public purpose, the
2424 board shall consider the following factors relating to each person
2525 applying for a scholarship under this section:
2626 (1) the financial need of the applicant and the
2727 applicant's family;
2828 (2) the scholastic ability and performance of the
2929 applicant; and
3030 (3) other factors the board considers relevant, such
3131 as the applicant's responsibilities to others, the applicant's
3232 involvement in community service, the applicant's commitment to the
3333 applicant's education, and any hardships or disabilities affecting
3434 the applicant.
3535 Sec. 61.723. RULES. The board shall adopt rules as
3636 necessary for the administration of this subchapter, including
3737 rules providing eligibility criteria and the manner in which the
3838 amount of a scholarship is determined.
3939 Sec. 61.724. SCHOLARSHIP REGULATIONS. (a) The board shall
4040 determine the maximum amount of a scholarship awarded under this
4141 subchapter. The scholarship may be spent by the recipient only to
4242 cover all or part of the costs of attendance, including tuition,
4343 fees, expenses for books and supplies, and living expenses,
4444 incurred by the recipient in connection with enrollment at an
4545 institution of higher education.
4646 (b) To be eligible for consideration to receive a
4747 scholarship, a person must have an annual household income of less
4848 than $150,000.
4949 (c) A scholarship under this subchapter shall be paid to the
5050 recipient in the form of periodic partial payments throughout the
5151 academic year. The board by rule shall determine the manner in
5252 which the payments are made.
5353 Sec. 61.725. FUNDING. The board shall administer this
5454 subchapter using available appropriations and gifts, grants, and
5555 donations made for the purposes of this subchapter.
5656 SECTION 2. The Texas Higher Education Coordinating Board
5757 shall adopt the rules required by Subchapter M-1, Chapter 61,
5858 Education Code, as added by this Act, as soon as practicable after
5959 this Act takes effect. For that purpose, the coordinating board may
6060 adopt the initial rules in the manner provided by law for emergency
6161 rules.
6262 SECTION 3. This Act takes effect immediately if it receives
6363 a vote of two-thirds of all the members elected to each house, as
6464 provided by Section 39, Article III, Texas Constitution. If this
6565 Act does not receive the vote necessary for immediate effect, this
6666 Act takes effect September 1, 2009.
