A BILL TO BE ENTITLED
AN ACT
relating to the provision of exercise equipment to certain
recipients of medical assistance.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 32.024, Human Resources Code, is amended
by adding Subsection (kk) to read as follows:
(kk) To the extent allowed by federal law, the department
shall provide reimbursement under the medical assistance program
for the purchase or rental of exercise equipment by a recipient of
medical assistance diagnosed as having diabetes. The executive
commissioner of the Health and Human Services Commission shall
adopt rules defining items considered "exercise equipment" for
purposes of this subsection.
SECTION 2. The executive commissioner of the Health and
Human Services Commission shall adopt the rules required by Section
32.024(kk), Human Resources Code, as added by this Act, as soon as
possible after the effective date of this Act.
SECTION 3. If before implementing any provision of this Act
a state agency determines that a waiver or authorization from a
federal agency is necessary for implementation of that provision,
the agency affected by the provision shall request the waiver or
authorization and may delay implementing that provision until the
waiver or authorization is granted.
SECTION 4. This Act takes effect September 1, 2009.
