| 7 | 7 | | relating to the provision of exercise equipment to certain |

| 8 | 8 | | recipients of medical assistance. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 32.024, Human Resources Code, is amended |
|---|
| 11 | 11 | | by adding Subsection (kk) to read as follows: |
|---|
| 12 | 12 | | (kk) To the extent allowed by federal law, the department |
|---|
| 13 | 13 | | shall provide reimbursement under the medical assistance program |
|---|
| 14 | 14 | | for the purchase or rental of exercise equipment by a recipient of |
|---|
| 15 | 15 | | medical assistance diagnosed as having diabetes. The executive |
|---|
| 16 | 16 | | commissioner of the Health and Human Services Commission shall |
|---|
| 17 | 17 | | adopt rules defining items considered "exercise equipment" for |
|---|
| 18 | 18 | | purposes of this subsection. |
|---|
| 19 | 19 | | SECTION 2. The executive commissioner of the Health and |
|---|
| 20 | 20 | | Human Services Commission shall adopt the rules required by Section |
|---|
| 21 | 21 | | 32.024(kk), Human Resources Code, as added by this Act, as soon as |
|---|
| 22 | 22 | | possible after the effective date of this Act. |
|---|
| 23 | 23 | | SECTION 3. If before implementing any provision of this Act |
|---|
| 24 | 24 | | a state agency determines that a waiver or authorization from a |
|---|
| 25 | 25 | | federal agency is necessary for implementation of that provision, |
|---|
| 26 | 26 | | the agency affected by the provision shall request the waiver or |
|---|
| 27 | 27 | | authorization and may delay implementing that provision until the |
|---|
| 28 | 28 | | waiver or authorization is granted. |
|---|
| 29 | 29 | | SECTION 4. This Act takes effect September 1, 2009. |
