66 AN ACT
77 relating to a pilot test of an advanced control technology for the
88 reduction of nitrogen oxides emissions.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. SELECTIVE CATALYTIC REDUCTION TECHNOLOGY PILOT.
1111 (a) The Texas Commission on Environmental Quality shall select one
1212 dry process cement kiln stack in a nonattainment or a near
1313 nonattainment area for the purpose of a pilot test to determine the
1414 effectiveness of a selective catalytic reduction technology as an
1515 advanced control technology for reducing the nitrogen oxides
1616 emissions from the cement kiln stack. The Texas Commission on
1717 Environmental Quality shall select a selective catalytic reduction
1818 technology vendor to provide the selective catalytic reduction
1919 technology needed to conduct the testing required by this
2020 subsection.
2121 (b) The Texas Commission on Environmental Quality shall:
2222 (1) design, supervise, and monitor the testing
2323 required by Subsection (a) of this section in consultation with:
2424 (A) the selective catalytic reduction technology
2525 vendor selected by the commission;
2626 (B) the owner or operator of the cement kiln
2727 stack selected for testing under Subsection (a) of this section;
2828 and
2929 (C) representatives of a regional council of
3030 government of the region in which the cement kiln is located; and
3131 (2) verify the accuracy of the results of the testing.
3232 (c) The Texas Commission on Environmental Quality may
3333 accept and hold a gift or grant conditioned on its use for testing
3434 advanced controls for nitrogen oxides emissions from cement kilns
3535 in a nonattainment or near nonattainment area and use such gifts or
3636 grants without an appropriation for the pilot test under this
3737 section.
3838 (d) If this Act takes effect before July 31, 2009, the Texas
3939 Commission on Environmental Quality shall:
4040 (1) not later than July 31, 2009, select a dry process
4141 cement kiln stack for testing as required under Subsection (a) of
4242 this section;
4343 (2) not later than August 31, 2009, select a selective
4444 catalytic reduction technology vendor as required under Subsection
4545 (a) of this section; and
4646 (3) not later than November 30, 2009, begin testing
4747 the selective catalytic reduction technology.
4848 (e) If this Act takes effect on or after July 31, 2009, the
4949 Texas Commission on Environmental Quality shall:
5050 (1) not later than September 30, 2009, select a dry
5151 process cement kiln stack for testing as required under Subsection
5252 (a) of this section;
5353 (2) not later than October 31, 2009, select a
5454 selective catalytic reduction technology vendor as required under
5555 Subsection (a) of this section; and
5656 (3) not later than January 1, 2009, begin testing the
5757 selective catalytic reduction technology.
5858 (f) The Texas Commission on Environmental Quality shall:
5959 (1) not later than December 31, 2010, complete the
6060 selective catalytic reduction technology testing required under
6161 Subsection (a) of this section; and
6262 (2) not later than January 1, 2011, prepare and
6363 deliver to each member of the legislature a report describing:
6464 (A) the results of the testing, including whether
6565 any reduction in nitrogen oxides emissions resulted from the use of
6666 the selective catalytic reduction technology; and
6767 (B) the costs involved in the installation, use,
6868 and maintenance of the selective catalytic reduction technology.
6969 SECTION 2. EFFECTIVE DATE. This Act takes effect
7070 immediately if it receives a vote of two-thirds of all the members
7171 elected to each house, as provided by Section 39, Article III, Texas
7272 Constitution. If this Act does not receive the vote necessary for
7373 immediate effect, this Act takes effect September 1, 2009.
