99 relating to the requirement to post notice of the subject of a
1010 meeting under the open meetings law as the requirement relates to
1111 reports about items of community interest at a city council
1212 meeting.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Subchapter C, Chapter 551, Government Code, is
1515 amended by adding Section 551.0415 to read as follows:
1616 Sec. 551.0415. GOVERNING BODY OF MUNICIPALITY: REPORTS
1717 ABOUT ITEMS OF COMMUNITY INTEREST REGARDING WHICH NO ACTION WILL BE
1818 TAKEN. (a) Notwithstanding Sections 551.041 and 551.042, a quorum
1919 of the governing body of a municipality may receive from municipal
2020 staff and a member of the governing body may make a report about
2121 items of community interest during a meeting of the governing body
2222 without having given notice of the subject of the report as required
2323 by this subchapter if no action is taken and, except as provided by
2424 Section 551.042, possible action is not discussed regarding the
2525 information provided in the report.
2626 (b) For purposes of Subsection (a), "items of community
2727 interest" includes:
2828 (1) expressions of thanks, congratulations, or
2929 condolence;
3030 (2) information regarding holiday schedules;
3131 (3) an honorary or salutary recognition of a public
3232 official, public employee, or other citizen, except that a
3333 discussion regarding a change in the status of a person's public
3434 office or public employment is not an honorary or salutary
3535 recognition for purposes of this subdivision;
3636 (4) a reminder about an upcoming event organized or
3737 sponsored by the governing body;
3838 (5) information regarding a social, ceremonial, or
3939 community event organized or sponsored by an entity other than the
4040 governing body that was attended or is scheduled to be attended by a
4141 member of the governing body or an official or employee of the
4242 municipality; and
4343 (6) announcements involving the public health and
4444 safety of people in the municipality.
4545 SECTION 2. This Act takes effect September 1, 2009.
