99 AN ACT
1010 relating to the temporary housing in a housing facility of a public
1111 university of certain veterans receiving health care treatment.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter Z, Chapter 51, Education Code, is
1414 amended by adding Section 51.9112 to read as follows:
1515 Sec. 51.9112. VETERAN'S TEMPORARY HOUSING IN INSTITUTION
1616 HOUSING FACILITY. (a) In this section, "institution of higher
1717 education" has the meaning assigned by Section 61.003.
1818 (b) A veteran receiving health care services from a
1919 hospital, health clinic, or other facility operated by the Veterans
2020 Health Administration of the United States Department of Veterans
2121 Affairs may stay, free of charge, in a vacant room of a housing
2222 facility located at and operated by an institution of higher
2323 education while the veteran is receiving the health care services
2424 if:
2525 (1) the institution is able to accommodate and
2626 approves the veteran's request for temporary housing and the
2727 institution is located a reasonable distance from the hospital,
2828 health clinic, or other facility providing health care services to
2929 the veteran; and
3030 (2) the veteran resides more than 100 miles from the
3131 hospital, health clinic, or other facility providing health care
3232 services to the veteran.
3333 (c) The primary or other necessary caregiver to a veteran
3434 described by Subsection (b) may stay, free of charge, in a vacant
3535 room of a housing facility located at and operated by an institution
3636 of higher education while the veteran is receiving health care
3737 services from a facility operated by the Veterans Health
3838 Administration of the United States Department of Veterans Affairs
3939 if:
4040 (1) the institution is able to accommodate and
4141 approves the caregiver's request for temporary housing and the
4242 institution is located a reasonable distance from the facility
4343 providing health care services;
4444 (2) Subsection (b)(2) applies; and
4545 (3) the veteran is staying either at an institution
4646 housing facility as provided by Subsection (b) or at the facility
4747 providing health care services.
4848 SECTION 2. This Act takes effect immediately if it receives
4949 a vote of two-thirds of all the members elected to each house, as
5050 provided by Section 39, Article III, Texas Constitution. If this
5151 Act does not receive the vote necessary for immediate effect, this
5252 Act takes effect September 1, 2009.
