11 | 11 | | university of certain veterans receiving health care treatment. |

12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

13 | 13 | | SECTION 1. Subchapter Z, Chapter 51, Education Code, is |
---|
14 | 14 | | amended by adding Section 51.9112 to read as follows: |
---|
15 | 15 | | Sec. 51.9112. VETERAN'S TEMPORARY HOUSING IN INSTITUTION |
---|
16 | 16 | | HOUSING FACILITY. (a) In this section, "institution of higher |
---|
17 | 17 | | education" has the meaning assigned by Section 61.003. |
---|
18 | 18 | | (b) A veteran receiving health care services from a |
---|
19 | 19 | | hospital, health clinic, or other facility operated by the Veterans |
---|
20 | 20 | | Health Administration of the United States Department of Veterans |
---|
21 | 21 | | Affairs may stay, free of charge, in a vacant room of a housing |
---|
22 | 22 | | facility located at and operated by an institution of higher |
---|
23 | 23 | | education while the veteran is receiving the health care services |
---|
24 | 24 | | if: |
---|
25 | 25 | | (1) the institution is able to accommodate and |
---|
26 | 26 | | approves the veteran's request for temporary housing and the |
---|
27 | 27 | | institution is located a reasonable distance from the hospital, |
---|
28 | 28 | | health clinic, or other facility providing health care services to |
---|
29 | 29 | | the veteran; and |
---|
30 | 30 | | (2) the veteran resides more than 100 miles from the |
---|
31 | 31 | | hospital, health clinic, or other facility providing health care |
---|
32 | 32 | | services to the veteran. |
---|
33 | 33 | | (c) The primary or other necessary caregiver to a veteran |
---|
34 | 34 | | described by Subsection (b) may stay, free of charge, in a vacant |
---|
35 | 35 | | room of a housing facility located at and operated by an institution |
---|
36 | 36 | | of higher education while the veteran is receiving health care |
---|
37 | 37 | | services from a facility operated by the Veterans Health |
---|
38 | 38 | | Administration of the United States Department of Veterans Affairs |
---|
39 | 39 | | if: |
---|
40 | 40 | | (1) the institution is able to accommodate and |
---|
41 | 41 | | approves the caregiver's request for temporary housing and the |
---|
42 | 42 | | institution is located a reasonable distance from the facility |
---|
43 | 43 | | providing health care services; |
---|
44 | 44 | | (2) Subsection (b)(2) applies; and |
---|
45 | 45 | | (3) the veteran is staying either at an institution |
---|
46 | 46 | | housing facility as provided by Subsection (b) or at the facility |
---|
47 | 47 | | providing health care services. |
---|
48 | 48 | | SECTION 2. This Act takes effect immediately if it receives |
---|
49 | 49 | | a vote of two-thirds of all the members elected to each house, as |
---|
50 | 50 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
51 | 51 | | Act does not receive the vote necessary for immediate effect, this |
---|
52 | 52 | | Act takes effect September 1, 2009. |
