| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Subchapter C, Chapter 504, Local Government |
|---|
| 14 | 14 | | Code, is amended by adding Section 504.1025 to read as follows: |
|---|
| 15 | 15 | | Sec. 504.1025. PROJECTS RELATING TO PROMOTING HIGHER |
|---|
| 16 | 16 | | EDUCATION AND JOB TRAINING OPPORTUNITIES. (a) For purposes of this |
|---|
| 17 | 17 | | section: |
|---|
| 18 | 18 | | (1) "Education and job training project" means: |
|---|
| 19 | 19 | | (A) expenditures to provide financial |
|---|
| 20 | 20 | | assistance, including scholarships and loans, to students who: |
|---|
| 21 | 21 | | (i) enroll in institutions of higher |
|---|
| 22 | 22 | | education located in the authorizing municipality; or |
|---|
| 23 | 23 | | (ii) are residents of the authorizing |
|---|
| 24 | 24 | | municipality and who enroll at a public junior college located |
|---|
| 25 | 25 | | within the same junior college district service area in which the |
|---|
| 26 | 26 | | authorizing municipality is located; and |
|---|
| 27 | 27 | | (B) expenditures to support job training |
|---|
| 28 | 28 | | opportunities offered through an institution of higher education |
|---|
| 29 | 29 | | located in the authorizing municipality. |
|---|
| 30 | 30 | | (2) "Metropolitan planning area" has the meaning |
|---|
| 31 | 31 | | assigned by 49 U.S.C. Section 5303. |
|---|
| 32 | 32 | | (3) "Population" means the most recent population |
|---|
| 33 | 33 | | estimates as determined by the regional planning council that |
|---|
| 34 | 34 | | serves the metropolitan planning area in which the authorizing |
|---|
| 35 | 35 | | municipality is located. |
|---|
| 36 | 36 | | (b) This section applies only to a corporation authorized to |
|---|
| 37 | 37 | | be created by a municipality: |
|---|
| 38 | 38 | | (1) with a population of more than 30,000 and less than |
|---|
| 39 | 39 | | 50,000; |
|---|
| 40 | 40 | | (2) all of which is located in two counties, only one |
|---|
| 41 | 41 | | of which has a population of 500,000 or more; |
|---|
| 42 | 42 | | (3) that is located wholly or partly within the |
|---|
| 43 | 43 | | service area of two junior college districts; |
|---|
| 44 | 44 | | (4) in which is located a teaching facility owned or |
|---|
| 45 | 45 | | operated by a junior college district; and |
|---|
| 46 | 46 | | (5) that is located within a metropolitan planning |
|---|
| 47 | 47 | | area with a population of six million or more. |
|---|
| 48 | 48 | | (c) A Type A corporation may contract with a nonprofit |
|---|
| 49 | 49 | | corporation to administer an education and job training project or |
|---|
| 50 | 50 | | to assist the corporation with the administration of the project. |
|---|
| 51 | 51 | | The authorizing municipality may designate for the purposes of this |
|---|
| 52 | 52 | | section not more than one-eighth of the tax revenue that the |
|---|
| 53 | 53 | | municipality is entitled to receive from any sales and use tax |
|---|
| 54 | 54 | | adopted under this chapter. |
|---|
| 55 | 55 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 56 | 56 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 57 | 57 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 58 | 58 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 59 | 59 | | Act takes effect September 1, 2009. |
