99 relating to use of sales and tax revenues by certain development
1010 corporations to promote higher education and job training
1111 opportunities.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter C, Chapter 504, Local Government
1414 Code, is amended by adding Section 504.1025 to read as follows:
1515 Sec. 504.1025. PROJECTS RELATING TO PROMOTING HIGHER
1616 EDUCATION AND JOB TRAINING OPPORTUNITIES. (a) For purposes of this
1717 section:
1818 (1) "Education and job training project" means:
1919 (A) expenditures to provide financial
2020 assistance, including scholarships and loans, to students who:
2121 (i) enroll in institutions of higher
2222 education located in the authorizing municipality; or
2323 (ii) are residents of the authorizing
2424 municipality and who enroll at a public junior college located
2525 within the same junior college district service area in which the
2626 authorizing municipality is located; and
2727 (B) expenditures to support job training
2828 opportunities offered through an institution of higher education
2929 located in the authorizing municipality.
3030 (2) "Metropolitan planning area" has the meaning
3131 assigned by 49 U.S.C. Section 5303.
3232 (3) "Population" means the most recent population
3333 estimates as determined by the regional planning council that
3434 serves the metropolitan planning area in which the authorizing
3535 municipality is located.
3636 (b) This section applies only to a corporation authorized to
3737 be created by a municipality:
3838 (1) with a population of more than 30,000 and less than
3939 50,000;
4040 (2) all of which is located in two counties, only one
4141 of which has a population of 500,000 or more;
4242 (3) that is located wholly or partly within the
4343 service area of two junior college districts;
4444 (4) in which is located a teaching facility owned or
4545 operated by a junior college district; and
4646 (5) that is located within a metropolitan planning
4747 area with a population of six million or more.
4848 (c) A Type A corporation may contract with a nonprofit
4949 corporation to administer an education and job training project or
5050 to assist the corporation with the administration of the project.
5151 The authorizing municipality may designate for the purposes of this
5252 section not more than one-eighth of the tax revenue that the
5353 municipality is entitled to receive from any sales and use tax
5454 adopted under this chapter.
5555 SECTION 2. This Act takes effect immediately if it receives
5656 a vote of two-thirds of all the members elected to each house, as
5757 provided by Section 39, Article III, Texas Constitution. If this
5858 Act does not receive the vote necessary for immediate effect, this
5959 Act takes effect September 1, 2009.
