| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Subchapter A, Chapter 553, Health and Safety |
|---|
| 10 | 10 | | Code, is amended by adding Section 553.003 to read as follows: |
|---|
| 11 | 11 | | Sec. 553.003. ESTABLISHMENT OF CHARTER SCHOOL. (a) In this |
|---|
| 12 | 12 | | section, "alleged offender resident" means a person with mental |
|---|
| 13 | 13 | | retardation who has been committed to or transferred to a state |
|---|
| 14 | 14 | | school under Chapter 55, Family Code, or Chapter 46B or 46C, Code of |
|---|
| 15 | 15 | | Criminal Procedure. |
|---|
| 16 | 16 | | (b) The commissioner of education and the executive |
|---|
| 17 | 17 | | commissioner of health and human services shall enter into a |
|---|
| 18 | 18 | | memorandum of understanding to establish at a selected state school |
|---|
| 19 | 19 | | a charter school for the education of alleged offender residents. |
|---|
| 20 | 20 | | (c) Subchapter D, Chapter 12, Education Code, applies to a |
|---|
| 21 | 21 | | charter school established under this section as though the school |
|---|
| 22 | 22 | | were granted a charter under that subchapter. |
|---|
| 23 | 23 | | (d) A charter granted under this section is not considered |
|---|
| 24 | 24 | | for purposes of the limit on the number of open-enrollment charter |
|---|
| 25 | 25 | | schools imposed by Section 12.101(b), Education Code. |
|---|
| 26 | 26 | | SECTION 2. The commissioner of education and the executive |
|---|
| 27 | 27 | | commissioner of health and human services shall adopt the |
|---|
| 28 | 28 | | memorandum of understanding required by Section 553.003, Health and |
|---|
| 29 | 29 | | Safety Code, as added by this Act, not later than October 1, 2009. |
|---|
| 30 | 30 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 31 | 31 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 32 | 32 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 33 | 33 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 34 | 34 | | Act takes effect September 1, 2009. |
