44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the establishment of a charter school for alleged
77 offender residents at a state school.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter A, Chapter 553, Health and Safety
1010 Code, is amended by adding Section 553.003 to read as follows:
1111 Sec. 553.003. ESTABLISHMENT OF CHARTER SCHOOL. (a) In this
1212 section, "alleged offender resident" means a person with mental
1313 retardation who has been committed to or transferred to a state
1414 school under Chapter 55, Family Code, or Chapter 46B or 46C, Code of
1515 Criminal Procedure.
1616 (b) The commissioner of education and the executive
1717 commissioner of health and human services shall enter into a
1818 memorandum of understanding to establish at a selected state school
1919 a charter school for the education of alleged offender residents.
2020 (c) Subchapter D, Chapter 12, Education Code, applies to a
2121 charter school established under this section as though the school
2222 were granted a charter under that subchapter.
2323 (d) A charter granted under this section is not considered
2424 for purposes of the limit on the number of open-enrollment charter
2525 schools imposed by Section 12.101(b), Education Code.
2626 SECTION 2. The commissioner of education and the executive
2727 commissioner of health and human services shall adopt the
2828 memorandum of understanding required by Section 553.003, Health and
2929 Safety Code, as added by this Act, not later than October 1, 2009.
3030 SECTION 3. This Act takes effect immediately if it receives
3131 a vote of two-thirds of all the members elected to each house, as
3232 provided by Section 39, Article III, Texas Constitution. If this
3333 Act does not receive the vote necessary for immediate effect, this
3434 Act takes effect September 1, 2009.
