| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter C, Chapter 161, Human Resources Code, |
|---|
| 12 | 12 | | is amended by adding Section 161.0521 to read as follows: |
|---|
| 13 | 13 | | Sec. 161.0521. STATE SCHOOL PERSONNEL. (a) Notwithstanding |
|---|
| 14 | 14 | | Section 531.0055, Government Code, or any other law, the department |
|---|
| 15 | 15 | | shall perform all administrative personnel, human resources, and |
|---|
| 16 | 16 | | payroll functions for state schools and employees of state schools. |
|---|
| 17 | 17 | | (b) The department shall ensure that each state school has |
|---|
| 18 | 18 | | at least one on-site employee dedicated to the performance of |
|---|
| 19 | 19 | | administrative personnel, human resources, and payroll functions |
|---|
| 20 | 20 | | for the state school. |
|---|
| 21 | 21 | | (c) The department may not contract for the performance of |
|---|
| 22 | 22 | | administrative personnel, human resources, or payroll functions or |
|---|
| 23 | 23 | | otherwise outsource those functions to a private person. |
|---|
| 24 | 24 | | SECTION 2. (a) As soon as practicable after the effective |
|---|
| 25 | 25 | | date of this Act, the Department of Aging and Disability Services |
|---|
| 26 | 26 | | and the Health and Human Services Commission shall coordinate the |
|---|
| 27 | 27 | | transfer of all administrative personnel, human resources, and |
|---|
| 28 | 28 | | payroll functions relating to state schools in accordance with |
|---|
| 29 | 29 | | Section 161.0521, Human Resources Code, as added by this Act. |
|---|
| 30 | 30 | | (b) Section 161.0521, Human Resources Code, as added by this |
|---|
| 31 | 31 | | Act, takes effect on the date on which the Department of Aging and |
|---|
| 32 | 32 | | Disability Services and the Health and Human Services Commission |
|---|
| 33 | 33 | | coordinate the transfer under Subsection (a) of this section. |
|---|
| 34 | 34 | | SECTION 3. This Act takes effect September 1, 2009. |
