55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the administrative personnel, human resources, and
88 payroll functions of state schools for persons with mental
99 retardation.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter C, Chapter 161, Human Resources Code,
1212 is amended by adding Section 161.0521 to read as follows:
1313 Sec. 161.0521. STATE SCHOOL PERSONNEL. (a) Notwithstanding
1414 Section 531.0055, Government Code, or any other law, the department
1515 shall perform all administrative personnel, human resources, and
1616 payroll functions for state schools and employees of state schools.
1717 (b) The department shall ensure that each state school has
1818 at least one on-site employee dedicated to the performance of
1919 administrative personnel, human resources, and payroll functions
2020 for the state school.
2121 (c) The department may not contract for the performance of
2222 administrative personnel, human resources, or payroll functions or
2323 otherwise outsource those functions to a private person.
2424 SECTION 2. (a) As soon as practicable after the effective
2525 date of this Act, the Department of Aging and Disability Services
2626 and the Health and Human Services Commission shall coordinate the
2727 transfer of all administrative personnel, human resources, and
2828 payroll functions relating to state schools in accordance with
2929 Section 161.0521, Human Resources Code, as added by this Act.
3030 (b) Section 161.0521, Human Resources Code, as added by this
3131 Act, takes effect on the date on which the Department of Aging and
3232 Disability Services and the Health and Human Services Commission
3333 coordinate the transfer under Subsection (a) of this section.
3434 SECTION 3. This Act takes effect September 1, 2009.
