55 AN ACT
66 requiring certain information be provided to consumers with
77 renewals of their homeowners insurance policy.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Chapter 521, Insurance Code, is amended by
1010 adding Section 521.006 to read as follows:
1111 Sec. 521.006. NOTICE TO ACCOMPANY RESIDENTIAL PROPERTY
1212 INSURANCE RENEWAL POLICY. (a) Each renewal of a residential
1313 property insurance policy must contain on the first page:
1414 (1) a table that clearly lists the premium charged
1515 under the policy before renewal, the new premium charged under the
1616 renewal policy, and the percent change, if any, between these
1717 amounts, and
1818 (2) an explanation, in plain language, of any changes
1919 in the coverage of the policy.
2020 (b) If there is any increase in the premium or change in the
2121 coverage of the renewal policy, the first page of the renewal policy
2222 must contain a statement advising the consumer of the Department's
2323 website www.helpinsure.com for comparing premiums and coverages of
2424 different insurers' policies.
2525 (c) The commissioner shall adopt appropriate wording for
2626 the notices.
2727 SECTION 2. This Act applies only to an insurance policy
2828 delivered, issued for delivery, or renewed on or after January 1,
2929 2010. A policy delivered, issued for delivery, or renewed before
3030 January 1, 2010, is governed by the law as it existed immediately
3131 before the effective date of this Act, and that law is continued in
3232 effect for that purpose.
3333 SECTION 3. This Act takes effect September 1, 2009.
