| 6 | 6 | | requiring certain information be provided to consumers with |
|---|
| 7 | 7 | | renewals of their homeowners insurance policy. |
|---|
| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Chapter 521, Insurance Code, is amended by |
|---|
| 10 | 10 | | adding Section 521.006 to read as follows: |
|---|
| 11 | 11 | | Sec. 521.006. NOTICE TO ACCOMPANY RESIDENTIAL PROPERTY |
|---|
| 12 | 12 | | INSURANCE RENEWAL POLICY. (a) Each renewal of a residential |
|---|
| 13 | 13 | | property insurance policy must contain on the first page: |
|---|
| 14 | 14 | | (1) a table that clearly lists the premium charged |
|---|
| 15 | 15 | | under the policy before renewal, the new premium charged under the |
|---|
| 16 | 16 | | renewal policy, and the percent change, if any, between these |
|---|
| 17 | 17 | | amounts, and |
|---|
| 18 | 18 | | (2) an explanation, in plain language, of any changes |
|---|
| 19 | 19 | | in the coverage of the policy. |
|---|
| 20 | 20 | | (b) If there is any increase in the premium or change in the |
|---|
| 21 | 21 | | coverage of the renewal policy, the first page of the renewal policy |
|---|
| 22 | 22 | | must contain a statement advising the consumer of the Department's |
|---|
| 23 | 23 | | website www.helpinsure.com for comparing premiums and coverages of |
|---|
| 24 | 24 | | different insurers' policies. |
|---|
| 25 | 25 | | (c) The commissioner shall adopt appropriate wording for |
|---|
| 26 | 26 | | the notices. |
|---|
| 27 | 27 | | SECTION 2. This Act applies only to an insurance policy |
|---|
| 28 | 28 | | delivered, issued for delivery, or renewed on or after January 1, |
|---|
| 29 | 29 | | 2010. A policy delivered, issued for delivery, or renewed before |
|---|
| 30 | 30 | | January 1, 2010, is governed by the law as it existed immediately |
|---|
| 31 | 31 | | before the effective date of this Act, and that law is continued in |
|---|
| 32 | 32 | | effect for that purpose. |
|---|
| 33 | 33 | | SECTION 3. This Act takes effect September 1, 2009. |
