| 7 | 7 | | relating to reduced tuition rates at public institutions of higher |

| 8 | 8 | | education for certain children of state employees. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter B, Chapter 54, Education Code, is |
|---|
| 11 | 11 | | amended by adding Section 54.0615 to read as follows: |
|---|
| 12 | 12 | | Sec. 54.0615. REDUCED TUITION RATES FOR CERTAIN CHILDREN OF |
|---|
| 13 | 13 | | STATE EMPLOYEES. (a) This section applies to tuition charged in a |
|---|
| 14 | 14 | | semester or other academic term to a resident student of an |
|---|
| 15 | 15 | | institution of higher education: |
|---|
| 16 | 16 | | (1) who is 23 years of age or younger; and |
|---|
| 17 | 17 | | (2) whose parent is employed full-time by this state |
|---|
| 18 | 18 | | or an agency of this state and has been so employed for at least six |
|---|
| 19 | 19 | | months before the semester or other term begins. |
|---|
| 20 | 20 | | (b) An institution of higher education shall charge a |
|---|
| 21 | 21 | | student to whom this section applies a total amount of tuition, |
|---|
| 22 | 22 | | including designated tuition under Section 54.0513, that is at |
|---|
| 23 | 23 | | least 10 percent less than the amount that would otherwise be |
|---|
| 24 | 24 | | charged to the student. |
|---|
| 25 | 25 | | (c) The Texas Higher Education Coordinating Board shall |
|---|
| 26 | 26 | | adopt rules for the administration of this section. |
|---|
| 27 | 27 | | SECTION 2. Section 54.0615, Education Code, as added by |
|---|
| 28 | 28 | | this Act, applies beginning with tuition charged by an institution |
|---|
| 29 | 29 | | of higher education for the 2009 fall semester. If a person who |
|---|
| 30 | 30 | | becomes eligible for a reduced tuition rate in that semester under |
|---|
| 31 | 31 | | that section has paid the tuition for that semester, the |
|---|
| 32 | 32 | | institution of higher education shall refund to the student the |
|---|
| 33 | 33 | | excess amount of the tuition paid. Tuition for a term or semester |
|---|
| 34 | 34 | | before the 2009 fall semester is covered by the law in effect |
|---|
| 35 | 35 | | immediately before the effective date of this Act, and the former |
|---|
| 36 | 36 | | law is continued in effect for that purpose. |
|---|
| 37 | 37 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 38 | 38 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 39 | 39 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 40 | 40 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 41 | 41 | | Act takes effect September 1, 2009. |
