| 10 | 10 | SECTION 1. Subtitle B, Title 5, Health and Safety Code, is | |
| 11 | 11 | amended by adding Chapter 376 to read as follows: | |
| 12 | 12 | CHAPTER 376. WASTE TIRE RECYCLING PROGRAM | |
| 13 | 13 | Sec. 376.001. COMMISSION TO ESTABLISH PROGRAM. (a) The | |
| 14 | 14 | Texas Commission on Environmental Quality by rule shall adopt and | |
| 15 | 15 | implement a waste tire recycling program to be operated and | |
| 16 | 16 | enforced in the same way that this state's former waste tire | |
| 17 | 17 | recycling program was operated and enforced as provided by former | |
| 18 | 18 | Subchapter P, Chapter 361, as that subchapter was originally | |
| 19 | 19 | enacted. | |
| 20 | 20 | (b) The commission has all authority necessary to adopt, | |
| 21 | 21 | implement, operate, and enforce the waste tire recycling program as | |
| 22 | 22 | Subsection (a) requires. | |
| 23 | 23 | SECTION 2. This Act takes effect September 1, 2009. |
