| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 54.702, Education Code, is amended by |
|---|
| 12 | 12 | | adding Subsection (h) to read as follows: |
|---|
| 13 | 13 | | (h) The board may enter into an interagency contract with |
|---|
| 14 | 14 | | the Employees Retirement System of Texas to allow an employee of |
|---|
| 15 | 15 | | this state to enroll in the plan during the retirement system's |
|---|
| 16 | 16 | | annual enrollment period. The board shall provide information and |
|---|
| 17 | 17 | | materials regarding the plan to the retirement system for |
|---|
| 18 | 18 | | distribution to state employees during the enrollment period. |
|---|
| 19 | 19 | | SECTION 2. Section 54.752, Education Code, is amended by |
|---|
| 20 | 20 | | adding Subsection (d) to read as follows: |
|---|
| 21 | 21 | | (d) The board may enter into an interagency contract with |
|---|
| 22 | 22 | | the Employees Retirement System of Texas to allow an employee of |
|---|
| 23 | 23 | | this state to enroll in the program during the retirement system's |
|---|
| 24 | 24 | | annual enrollment period. The board shall provide information and |
|---|
| 25 | 25 | | materials regarding the program to the retirement system for |
|---|
| 26 | 26 | | distribution to state employees during the enrollment period. |

| 27 | 27 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 28 | 28 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 29 | 29 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 30 | 30 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 31 | 31 | | Act takes effect September 1, 2009. |
