| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 659.262(b), Government Code, is amended |
|---|
| 11 | 11 | | to read as follows: |
|---|
| 12 | 12 | | (b) To enhance the recruitment and retention of competent |
|---|
| 13 | 13 | | personnel for certain classified employee positions, a state agency |
|---|
| 14 | 14 | | may provide to a state employee a recruitment payment[,] at the time |
|---|
| 15 | 15 | | of the employee's hiring for a classified position or a retention |
|---|
| 16 | 16 | | payment after the completion of 12 months of service. A recruitment |
|---|
| 17 | 17 | | or retention payment under this subsection is[, additional |
|---|
| 18 | 18 | | compensation in the form of] a one-time [recruitment] payment in an |
|---|
| 19 | 19 | | amount not to exceed $5,000. If the employee discontinues |
|---|
| 20 | 20 | | employment with the state agency for any reason less than three |
|---|
| 21 | 21 | | months after the date of receiving the recruitment or retention |
|---|
| 22 | 22 | | payment, the employee shall refund to the state agency the full |
|---|
| 23 | 23 | | amount of the [recruitment] payment. If the employee discontinues |
|---|
| 24 | 24 | | employment with the state agency for any reason three months or |
|---|
| 25 | 25 | | longer but less than 12 months after the date of receiving the |
|---|
| 26 | 26 | | recruitment or retention payment, the employee shall refund to the |
|---|
| 27 | 27 | | state agency an amount computed by: |
|---|
| 28 | 28 | | (1) subtracting from 12 months the number of complete |
|---|
| 29 | 29 | | calendar months the employee worked after the date of receiving the |
|---|
| 30 | 30 | | recruitment or retention payment; |
|---|
| 31 | 31 | | (2) dividing the number of months computed under |
|---|
| 32 | 32 | | Subdivision (1) by 12 months; and |
|---|
| 33 | 33 | | (3) multiplying the fraction computed under |
|---|
| 34 | 34 | | Subdivision (2) by the amount of the recruitment or retention |
|---|
| 35 | 35 | | payment. |
|---|
| 36 | 36 | | SECTION 2. This Act takes effect September 1, 2009. |
