44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to insurance agent licenses issued to certain foreign
77 corporations and partnerships.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 4001.106, Insurance Code, is amended by
1010 amending Subsection (b) and adding Subsection (b-1) to read as
1111 follows:
1212 (b) The department shall issue a license to a corporation or
1313 partnership if the department determines that:
1414 (1) the corporation or partnership is:
1515 (A) organized under the laws of this state or
1616 another state;
1717 [(B) admitted to engage in business in this state
1818 by the secretary of state, if required; and
1919 [(C)] (B) authorized by its articles of
2020 incorporation or its partnership agreement to act as an agent;
2121 (2) at least one officer of the corporation or one
2222 active partner of the partnership and all other persons performing
2323 any acts of an agent on behalf of the corporation or partnership in
2424 this state are individually licensed by the department separately
2525 from the corporation or partnership;
2626 (3) the corporation or partnership will have the
2727 ability to pay any amount up to $25,000 that it might become legally
2828 obligated to pay under a claim made against it by a customer and
2929 caused by a negligent act, error, or omission of the corporation or
3030 partnership or a person for whose acts the corporation or
3131 partnership is legally liable in the conduct of its business under
3232 this code;
3333 (4) if engaged in the business of insurance, the
3434 corporation or partnership intends to be actively engaged in that
3535 business as required under Section 4001.104(a);
3636 (5) each location from which the corporation or
3737 partnership will engage in business in this state under authority
3838 of a license issued by the department is registered separately with
3939 the department;
4040 (6) the corporation or partnership has submitted the
4141 application, appropriate fees, and any other information required
4242 by the department; and
4343 (7) an officer, director, member, manager, partner, or
4444 other person who has the right or ability to control the corporation
4545 or partnership has not:
4646 (A) had a license suspended or revoked or been
4747 the subject of any other disciplinary action by a financial or
4848 insurance regulator of this state, another state, or the United
4949 States; or
5050 (B) committed an act for which a license may be
5151 denied under Subchapter C, Chapter 4005.
5252 SECTION 2. This Act applies only to a license application
5353 filed on or after the effective date of this Act. A license
5454 application filed before the effective date of this Act is governed
5555 by the law in effect on the date the application was filed, and that
5656 law is continued in effect for that purpose.
5757 SECTION 3. This Act takes effect September 1, 2009.
