| 5 | 5 | | relating to the management and control of certain utility systems. |

| 6 | 6 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 7 | 7 | | SECTION 1. Section 1502.070(a), Government Code, is amended |
|---|
| 8 | 8 | | to read as follows: |
|---|
| 9 | 9 | | (a) Management and control of a utility system may be vested |
|---|
| 10 | 10 | | in: |
|---|
| 11 | 11 | | (1) the municipality's governing body; or |
|---|
| 12 | 12 | | (2) a board of trustees named in the proceedings |
|---|
| 13 | 13 | | adopted by the municipality and consisting of not more than: |
|---|
| 14 | 14 | | (A) five members, one of whom must be the mayor of |
|---|
| 15 | 15 | | the municipality; or |
|---|
| 16 | 16 | | (B) seven members, one of whom must be the mayor |
|---|
| 17 | 17 | | of the municipality, if the municipality is located in a county: |
|---|
| 18 | 18 | | (i) with a population of at least 600,000; |
|---|
| 19 | 19 | | and |
|---|
| 20 | 20 | | (ii) that is located on an international |
|---|
| 21 | 21 | | border. |
|---|
| 22 | 22 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 23 | 23 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 24 | 24 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 25 | 25 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 26 | 26 | | Act takes effect September 1, 2009. |
