| 6 | 6 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 7 | 7 | | SECTION 1. Section 1038.051(d), Special District Local Laws |
|---|
| 8 | 8 | | Code, is amended to read as follows: |
|---|
| 9 | 9 | | (d) An election shall be held on the uniform election date |
|---|
| 10 | 10 | | in May of each year to elect the appropriate number of directors |
|---|
| 11 | 11 | | [Section 41.001, Election Code, applies to an election held under |
|---|
| 12 | 12 | | this section]. |

| 13 | 13 | | SECTION 2. Section 1038.052, Special District Local Laws |
|---|
| 14 | 14 | | Code, is amended to read as follows: |

| 15 | 15 | | Sec. 1038.052. NOTICE OF ELECTION. The [At least 30 days |

| 16 | 16 | | before the date of an election of directors, the] board shall |
|---|
| 17 | 17 | | publish notice of the election [one time] in a newspaper or |
|---|
| 18 | 18 | | newspapers that individually or collectively have general |
|---|

| 21 | 21 | | SECTION 3. Section 1038.301, Special District Local Laws |

| 22 | 22 | | Code, is amended by adding Subsection (e) to read as follows: |

| 23 | 23 | | (e) Section 41.001(a), Election Code, does not apply to an |
|---|
| 24 | 24 | | election ordered under this section. |

| 25 | 25 | | SECTION 4. Section 1038.007, Special District Local Laws |
|---|
| 26 | 26 | | Code, is repealed. |
|---|
| 27 | 27 | | SECTION 5. This Act takes effect immediately if it receives |
|---|
| 28 | 28 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 29 | 29 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 30 | 30 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 31 | 31 | | Act takes effect September 1, 2009. |
