55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to exempting certain school districts from certain laws
88 and rules.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 39.074(a) and (b), Education Code, are
1111 amended to read as follows:
1212 (a) The commissioner may:
1313 (1) to ensure compliance with federal law or
1414 regulations, direct the agency to conduct on-site investigations at
1515 any time of [to answer any questions concerning] a program,
1616 including a special education program, required by federal law or
1717 for which the district receives federal funds; and
1818 (2) raise or lower the performance rating as a result
1919 of the investigation.
2020 (b) Except as provided by Subsection (a), the [The]
2121 commissioner may direct the agency to conduct [shall determine the
2222 frequency of] on-site investigations of a district only if the
2323 district was rated academically unacceptable under Section 39.072
2424 for the preceding school year [by the agency according to annual
2525 comprehensive analyses of student performance and equity in
2626 relation to the academic excellence indicators adopted under
2727 Section 39.051].
2828 SECTION 2. Section 39.112, Education Code, is amended by
2929 amending Subsections (a), (b), and (d) and adding Subsections (c-1)
3030 and (e) to read as follows:
3131 (a) Except as provided by Subsection (b) or (c-1), a school
3232 campus or district that is rated exemplary is exempt from
3333 requirements and prohibitions imposed under this code, including
3434 rules adopted under this code.
3535 (b) A school campus or district is not exempt under this
3636 section from:
3737 (1) a prohibition on conduct that constitutes a
3838 criminal offense;
3939 (2) requirements imposed by federal law or rule,
4040 including requirements for special education or bilingual
4141 education programs; or
4242 (3) a requirement, restriction, or prohibition
4343 relating to:
4444 (A) curriculum essential knowledge and skills
4545 under Section 28.002 or minimum graduation requirements under
4646 Section 28.025;
4747 (B) public school accountability as provided by
4848 Subchapters B, C, D, and G;
4949 (C) extracurricular activities under Section
5050 33.081;
5151 (D) health and safety under Chapter 38;
5252 (E) purchasing [competitive bidding] under
5353 Subchapter B, Chapter 44;
5454 (F) elementary school class size limits, except
5555 as provided by Subsection (c-1) or (d) or Section 25.112;
5656 (G) removal of a disruptive student from the
5757 classroom under Subchapter A, Chapter 37;
5858 (H) at risk programs under Subchapter C, Chapter
5959 29;
6060 (I) prekindergarten programs under Subchapter E,
6161 Chapter 29;
6262 (J) rights and benefits of school employees;
6363 (K) special education programs under Subchapter
6464 A, Chapter 29; or
6565 (L) bilingual education programs under
6666 Subchapter B, Chapter 29.
6767 (c-1) Notwithstanding Section 25.112, a school district
6868 that is rated exemplary or recognized may not enroll at the
6969 kindergarten, first grade, second grade, third grade, or fourth
7070 grade level an average of more than 22 students per class per
7171 campus. The exceptions to elementary school class size limits
7272 provided by Section 25.112 apply to the limits under this
7373 subsection.
7474 (d) The commissioner may exempt an exemplary school campus
7575 from elementary class size limits prescribed by Section 25.112
7676 [under this section] if the school campus submits to the
7777 commissioner a written plan showing steps that will be taken to
7878 ensure that the exemption from the class size limits will not be
7979 harmful to the academic achievement of the students on the school
8080 campus. The commissioner shall review achievement levels annually.
8181 The exemption remains in effect until the commissioner determines
8282 that achievement levels of the campus have declined.
8383 (e) A school district that is rated exemplary or recognized
8484 is specifically exempted from the following provisions and any rule
8585 adopted under any of the following provisions:
8686 (1) Section 21.003(a), restricting employment to only
8787 those educators holding appropriate certification;
8888 (2) Section 37.020, requiring a report concerning
8989 expulsions and disciplinary alternative education program
9090 placements;
9191 (3) Sections 42.152(c), (q), (q-1), (q-2), (q-3),
9292 (q-4), and (r), restricting the use of the compensatory education
9393 allotment;
9494 (4) Section 42.154(c), restricting the use of the
9595 career and technology education allotment; and
9696 (5) Section 42.156(b), restricting the use of the
9797 gifted and talented student allotment.
9898 SECTION 3. Section 39.074(e), Education Code, is repealed.
9999 SECTION 4. This Act applies beginning with the 2009-2010
100100 school year.
101101 SECTION 5. This Act takes effect immediately if it receives
102102 a vote of two-thirds of all the members elected to each house, as
103103 provided by Section 39, Article III, Texas Constitution. If this
104104 Act does not receive the vote necessary for immediate effect, this
105105 Act takes effect September 1, 2009.
