99 relating to prohibiting school districts from requiring or coercing
1010 school district employees to make charitable contributions.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter A, Chapter 22, Education Code, is
1313 amended by adding Section 22.012 to read as follows:
1414 Sec. 22.012. REQUIRING OR COERCING EMPLOYEES TO MAKE
1515 CHARITABLE CONTRIBUTIONS. (a) A school district board of trustees
1616 or school district employee may not directly or indirectly require
1717 or coerce any school district employee to:
1818 (1) make a contribution to a charitable organization
1919 or in response to a fund-raiser; or
2020 (2) attend a meeting called for the purpose of
2121 soliciting charitable contributions.
2222 (b) A school district board of trustees or school district
2323 employee may not directly or indirectly require or coerce any
2424 school district employee to refrain from:
2525 (1) making a contribution to a charitable organization
2626 or in response to a fund-raiser; or
2727 (2) attending a meeting called for the purpose of
2828 soliciting charitable contributions.
2929 SECTION 2. This Act takes effect immediately if it receives
3030 a vote of two-thirds of all the members elected to each house, as
3131 provided by Section 39, Article III, Texas Constitution. If this
3232 Act does not receive the vote necessary for immediate effect, this
3333 Act takes effect September 1, 2009.
