7	7	relating to authorizing the issuance of revenue bonds or other
8	8	obligations to fund capital projects at public institutions of
9	9	higher education.
10	10	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
11	11	SECTION 1. Subchapter B, Chapter 55, Education Code, is
12	12	amended by adding Sections 55.1771, 55.1772, 55.1773, 55.1774,
13	13	55.1775, 55.1776, 55.1777, 55.1778, 55.1779, 55.1780, and 55.1781
14	14	to read as follows:
15	15	Sec. 55.1771. THE TEXAS A&M UNIVERSITY SYSTEM; ADDITIONAL
16	16	BONDS. (a) In addition to the other authority granted by this
17	17	subchapter, the board of regents of The Texas A&M University System
18	18	may acquire, purchase, construct, improve, renovate, enlarge, or
19	19	equip facilities, including roads and related infrastructure, for
20	20	projects to be financed through the issuance of bonds in accordance
21	21	with this subchapter and in accordance with a systemwide revenue
22	22	financing program adopted by the board for the following
23	23	institutions and facilities not to exceed the following aggregate
24	24	principal amounts for the projects specified as follows:
25	25	(1) Tarleton State University:
26	26	(A) $53,000,000 for the renovation and
27	27	rehabilitation of the O.A. Grant Building, Joe Autry Agricultural
28	28	Building, and the Engineering Technology Building;
29	29	(B) $26,000,000 for a Student Success Center and
30	30	classroom building;
31	31	(C) $58,000,000 for a Special Events Center; and
32	32	(D) $29,000,000 for an Environmental and
33	33	Agribusiness Research Building.
34	34	(2) Texas A&M University-Commerce:
35	35	(A) $23,250,000 for renovation of the University
36	36	Library; and
37	37	(B) $11,250,000 for renovation of the Ferguson
38	38	Auditorium and Hall of Languages Building;
39	39	(3) Texas A&M University-Corpus Christi:
40	40	(A) $75 million for a life sciences building;
41	41	(B) $50 million for a fine arts center; and
42	42	(C) $31,000,000 for a Learning Resource Center
43	43	(4) Texas A&M University-Kingsville:
44	44	(A) $70 million for a performing and visual arts

79	79	(A) Texas A&M-Central Texas: $50,000,000 for a
80	80	new Classroom/Lab/Office Building

82	82	Classroom/Lab/Office Building
83	83	(b) The board may pledge irrevocably to the payment of bonds
84	84	authorized by this section all or any part of the revenue funds of
85	85	an institution, branch, or entity of The Texas A&M University
86	86	System, including student tuition charges. The amount of a pledge
87	87	made under this subsection may not be reduced or abrogated while the
88	88	bonds for which the pledge is made, or bonds issued to refund those
89	89	bonds, are outstanding.
90	90	(c) If sufficient funds are not available to the board to
91	91	meet its obligations under this section, the board may transfer
92	92	funds among institutions, branches, and entities of The Texas A&M
93	93	University System to ensure the most equitable and efficient
94	94	allocation of available resources for each institution, branch, or
95	95	entity to carry out its duties and purposes.
96	96	Sec. 55.1772. THE UNIVERSITY OF TEXAS SYSTEM; ADDITIONAL
97	97	BONDS. (a) In addition to the other authority granted by this
98	98	subchapter, the board of regents of The University of Texas System
99	99	may acquire, purchase, construct, improve, renovate, enlarge, or
100	100	equip facilities, including roads and related infrastructure, for
101	101	projects to be financed through the issuance of bonds in accordance
102	102	with this subchapter and in accordance with a systemwide revenue
103	103	financing program adopted by the board for the following
104	104	institutions not to exceed the following aggregate principal
105	105	amounts for the projects specified as follows:
106	106	(1) The University of Texas at Arlington:
107	107	(A) $31,000,000 for an Engineering Research
108	108	Building; and
109	109	(B) $60,000,000 for a Nanofab building;

194	194	BONDS. (a) In addition to the other authority granted by this
195	195	subchapter, the board of regents of the University of Houston
196	196	System may acquire, purchase, construct, improve, renovate,
197	197	enlarge, or equip facilities, including roads and related
198	198	infrastructure, for the following institutions, to be financed
199	199	through the issuance of bonds in accordance with this subchapter
200	200	and in accordance with a systemwide revenue financing program
201	201	adopted by the board, in aggregate principal amounts not to exceed
202	202	the following:
203	203	(1) the University of Houston:
204	204	(A) $83,000,000 for a energy and wind research
205	205	building;
206	206	(B) $75,000,000 for a bio-life sciences research
207	207	building; and
208	208	(C) $27,000,000 for a multi-cultural studies and
209	209	classroom complex;
210	210	(2) the University of Houston--Clear Lake,
211	211	$68,600,000 for an academic enrichment and research facility;
212	212	(3) the University of Houston--Downtown, $51,429,000
213	213	for a science and technology building; and
214	214	(4) the University of Houston-Victoria, $30,500,000
215	215	for a health and kinesiology education building.
216	216	(b) The board may pledge irrevocably to the payment of bonds
217	217	authorized by this section all or any part of the revenue funds of
218	218	an institution, branch, or entity of the University of Houston
219	219	System, including student tuition charges. The amount of a pledge
220	220	made under this subsection may not be reduced or abrogated while the
221	221	bonds for which the pledge is made, or bonds issued to refund those
222	222	bonds, are outstanding.
223	223	(c) If sufficient funds are not available to the board to
224	224	meet its obligations under this section, the board may transfer
225	225	funds among institutions, branches, and entities of the University
226	226	of Houston System to ensure the most equitable and efficient
227	227	allocation of available resources for each institution, branch, or
228	228	entity to carry out its duties and purposes.
229	229	Sec. 55.1774. TEXAS STATE UNIVERSITY SYSTEM; ADDITIONAL
230	230	BONDS. (a) In addition to the other authority granted by this
231	231	subchapter, the board of regents of the Texas State University
232	232	System may acquire, purchase, construct, improve, renovate,
233	233	enlarge, or equip facilities, including roads and related
234	234	infrastructure, for projects to be financed through the issuance of
235	235	bonds in accordance with this subchapter and in accordance with a
236	236	systemwide revenue financing program adopted by the board for the
237	237	following institutions not to exceed the following aggregate
238	238	principal amounts for the projects specified as follows:
239	239	(1) Lamar University:
240	240	(A) $25,000,000 for a new science building;
241	241	(B) $15,000,000 for a facilities management
242	242	complex;
243	243	(C) $36,000,000 for renovation of academic
244	244	buildings;
245	245	(D) $15,000,000 for a new administration
246	246	services building;
247	247	(E) $5,000,000 for a new security and computing
248	248	center;
249	249	(F) $10,000,000 for Addition II to the Cherry

289	289	authorized by this section all or any part of the revenue funds of
290	290	an institution, branch, or entity of the Texas State University
291	291	System, including student tuition charges. The amount of a pledge
292	292	made under this subsection may not be reduced or abrogated while the
293	293	bonds for which the pledge is made, or bonds issued to refund those
294	294	bonds, are outstanding.
295	295	(c) If sufficient funds are not available to the board to
296	296	meet its obligations under this section, the board may transfer
297	297	funds among institutions, branches, and entities of the Texas State
298	298	University System to ensure the most equitable and efficient
299	299	allocation of available resources for each institution, branch, or
300	300	entity to carry out its duties and purposes.
301	301	Sec. 55.1775. UNIVERSITY OF NORTH TEXAS SYSTEM; ADDITIONAL
302	302	BONDS. (a) In addition to the other authority granted by this
303	303	subchapter, the board of regents of the University of North Texas
304	304	System may acquire, purchase, construct, improve, renovate,
305	305	enlarge, or equip facilities, including roads and related
306	306	infrastructure, for projects to be financed through the issuance of
307	307	bonds in accordance with this subchapter and in accordance with a
308	308	systemwide revenue financing program adopted by the board for the
309	309	following institutions and facilities not to exceed the following
310	310	aggregate principal amounts for the projects specified as follows:
311	311	(1) the University of North Texas System, $40,000,000
312	312	for a College of Law;
313	313	(2) the University of North Texas, $63,000,000 for a
314	314	College of Visual Arts and Design building; and
315	315	(3) the University of North Texas Dallas Campus,
316	316	$18,500,000 for a second building.
317	317	(4) the University of North Texas Health Sciences
318	318	Center. $90,000,000 for a new Research Building
319	319	(b) The board may pledge irrevocably to the payment of bonds
320	320	authorized by this section all or any part of the revenue funds of
321	321	an institution, branch, or entity of the University of North Texas
322	322	System, including student tuition charges. The amount of a pledge
323	323	made under this subsection may not be reduced or abrogated while the
324	324	bonds for which the pledge is made, or bonds issued to refund those
325	325	bonds, are outstanding.
326	326	(c) If sufficient funds are not available to the board to
327	327	meet its obligations under this section, the board may transfer
328	328	funds among institutions, branches, and entities of the University
329	329	of North Texas System to ensure the most equitable and efficient
330	330	allocation of available resources for each institution, branch, or
331	331	entity to carry out its duties and purposes.
332	332	(d) Notwithstanding Subsection (a), the University of North
333	333	Texas System may not issue bonds under this section for facilities
334	334	at the University of North Texas Dallas Campus until the Texas
335	335	Higher Education Coordinating Board certifies that enrollment at
336	336	the University of North Texas Dallas Campus has reached an
337	337	enrollment equivalent of 1,500 full-time students for one semester.
338	338	If that enrollment is not reached by January 1, 2010, the system's
339	339	authority to issue bonds for the University of North Texas Dallas
340	340	Campus under this section expires on that date.
341	341	Sec. 55.1776. TEXAS WOMAN'S UNIVERSITY. (a) In addition to
342	342	the other authority granted by this subchapter, the board of
343	343	regents of Texas Woman's University may acquire, purchase,
344	344	construct, improve, renovate, enlarge, or equip facilities,
345	345	including roads and related infrastructure, for projects to be
346	346	financed through the issuance of bonds in accordance with this
347	347	subchapter and in accordance with a systemwide revenue financing
348	348	program adopted by the board for the following institutions and
349	349	facilities not to exceed the following aggregate principal amounts
350	350	for the projects specified as follows:
351	351	(1) $26,000,000 for a graduate research building;
352	352	(2) $17,500,000 for the renovation of the old main
353	353	building;
354	354	(3) $9,500,000 for a new academic support and
355	355	administrative support building; and
356	356	(4) $4,800,000 for infrastructure repair and upgrade.
357	357	(b) The board may pledge irrevocably to the payment of bonds
358	358	authorized by this section all or any part of the revenue funds of
359	359	Texas Woman's University, including student tuition charges. The
360	360	amount of a pledge made under this subsection may not be reduced or
361	361	abrogated while the bonds for which the pledge is made, or bonds
362	362	issued to refund those bonds, are outstanding.
363	363	Sec. 55.1777. MIDWESTERN STATE UNIVERSITY; ADDITIONAL
364	364	BONDS. (a) In addition to the other authority granted by this
365	365	subchapter, the board of regents of Midwestern State University may
366	366	acquire, purchase, construct, improve, renovate, enlarge, or equip
367	367	facilities, including roads and related infrastructure, for
368	368	projects at Midwestern State University, to be financed through the
369	369	issuance of bonds in accordance with this subchapter not to exceed
370	370	the following aggregate principal amounts for the projects
371	371	specified as follows:
372	372	(1) $6,420,000 for Phase II of the renovation of the D.
373	373	L. Ligon Building; and
374	374	(2) $40,000,000 for the reconstruction of the Moffett
375	375	Library.
376	376	(b) The board may pledge irrevocably to the payment of bonds
377	377	authorized by this section all or any part of the revenue funds of
378	378	Midwestern State University, including student tuition charges.
379	379	The amount of a pledge made under this subsection may not be reduced
380	380	or abrogated while the bonds for which the pledge is made, or bonds
381	381	issued to refund those bonds, are outstanding.
382	382	Sec. 55.1778. STEPHEN F. AUSTIN STATE UNIVERSITY. (a) In
383	383	addition to the other authority granted by this subchapter, the
384	384	board of regents of Stephen F. Austin State University may acquire,
385	385	purchase, construct, improve, renovate, enlarge, or equip
386	386	facilities, including roads and related infrastructure, for a
387	387	molecular sciences building at Stephen F. Austin State University,
388	388	to be financed through the issuance of bonds in accordance with this
389	389	subchapter not to exceed the aggregate principal amount of
390	390	$46,000,000.
391	391	(b) The board may pledge irrevocably to the payment of bonds
392	392	authorized by this section all or any part of the revenue funds of
393	393	Stephen F. Austin State University, including student tuition
394	394	charges. The amount of a pledge made under this subsection may not
395	395	be reduced or abrogated while the bonds for which the pledge is
396	396	made, or bonds issued to refund those bonds, are outstanding.
397	397	Sec. 55.1779. TEXAS TECH UNIVERSITY SYSTEM; ADDITIONAL
398	398	BONDS. (a) In addition to the other authority granted by this
399	399	subchapter, the board of regents of the Texas Tech University
400	400	System may acquire, purchase, construct, improve, renovate,
401	401	enlarge, or equip facilities, including roads and related
402	402	infrastructure, for projects to be financed through the issuance of
403	403	bonds in accordance with this subchapter and in accordance with a
404	404	systemwide revenue financing program adopted by the board not to
405	405	exceed the following aggregate principal amounts for the projects
406	406	specified as follows:
407	407	(1) Texas Tech University Health Sciences Center:
408	408	(A) $72,000,000 for Lubbock
409	409	Education/Research/Technology and renovation;
410	410	(B) $58,500,000 for the EL Paso Medical Science
411	411	Building II;
412	412	(C) $27,000,000 for the El Paso Clinical Sciences
413	413	Building;
414	414	(D) $12,600,000 for the Permian Basin medical
415	415	education facility; and
416	416	(E) $14,850,000 for the Panhandle
417	417	clinical/hospital simulation center;
418	418	(2) Texas Tech University:
419	419	(A) $95,000,000 for the expansion and renovation
420	420	of the College of Engineering;
421	421	(B) $42,500,000 for a Plant and Soil Sciences
422	422	Building; and
423	423	(C) $45,000,000 for a performing arts center; and
424	424	(3) Angelo State University:
425	425	(A) $40,000,000 for the College of Nursing and
426	426	Allied Health;
427	427	(B) $35,000,000 for campus modernization and
428	428	expansion; and
429	429	(C) $42,325,000 for a Performing Arts Center.
430	430	(b) The board may pledge irrevocably to the payment of bonds
431	431	authorized by this section all or any part of the revenue funds of
432	432	an institution, branch, or entity of the Texas Tech University
433	433	System, including student tuition charges. The amount of a pledge
434	434	made under this subsection may not be reduced or abrogated while the
435	435	bonds for which the pledge is made, or bonds issued to refund those
436	436	bonds, are outstanding.
437	437	(c) If sufficient funds are not available to the board to
438	438	meet its obligations under this section, the board may transfer
439	439	funds among institutions, branches, and entities of the Texas Tech
440	440	University System to ensure the most equitable and efficient
441	441	allocation of available resources for each institution, branch, or
442	442	entity to carry out its duties and purposes.
443	443	Sec. 55.1780. TEXAS SOUTHERN UNIVERSITY; ADDITIONAL BONDS.
444	444	(a) In addition to the other authority granted by this subchapter,
445	445	the board of regents of Texas Southern University may acquire,
446	446	purchase, construct, improve, renovate, enlarge, or equip
447	447	facilities, including roads and related infrastructure, for
448	448	projects at Texas Southern University, to be financed through the
449	449	issuance of bonds in accordance with this subchapter not to exceed
450	450	the following aggregate principal amounts for the projects
451	451	specified as follows:
452	452	(1) $46,000,000 for renovation of the Robert J. Terry
453	453	Library;
454	454	(2) $9,450,000 for a Spearman technology building;
455	455	(3) $4,500,000 for Multi-purpose Academic Center;
456	456	(4) $30,000,000 for deferred maintenance;
457	457	(5) $5,000,000 for asbestos abatement and removal;
458	458	(6) $10,000,000 for campus
459	459	infrastructure/beautification; and
460	460	(7) $4,000,000 for land acquisition/Multi-Purpose
461	461	Academic Center.
462	462	(b) The board may pledge irrevocably to the payment of bonds
463	463	authorized by this section all or any part of the revenue funds of
464	464	Texas Southern University, including student tuition charges. The
465	465	amount of a pledge made under this subsection may not be reduced or
466	466	abrogated while the bonds for which the pledge is made, or bonds
467	467	issued to refund those bonds, are outstanding.
468	468	Sec. 55.1781. TEXAS STATE TECHNICAL COLLEGE SYSTEM. (a) In
469	469	addition to the other authority granted by this subchapter, the
470	470	board of regents of the Texas State Technical College System may
471	471	acquire, purchase, construct, improve, renovate, enlarge, or equip
472	472	property, buildings, structures, facilities, roads, or related
473	473	infrastructure, for projects to be financed through the issuance of
474	474	bonds in accordance with this subchapter not to exceed the
475	475	following aggregate principal amounts for the projects specified as
476	476	follows:
477	477	(1) Texas State Technical College-Harlingen,
478	478	$8,000,000 to construct an academic building;
479	479	(2) Texas State Technical College-Brownwood,
480	480	$3,000,000 to renovate an academic building;
481	481	(3) Texas State Technical College-Marshall,
482	482	$2,500,000 for a diesel equipment technology building; and

484	484	(A) $10,000,000 for a learning services center;

486	486	(B) $5,000,000 for Phase II of the East
487	487	Williamson County Education Center.
488	488	(b) The board may pledge irrevocably to the payment of those
489	489	bonds all or any part of the revenue funds of an institution,
490	490	branch, or entity of the Texas State Technical College System,
491	491	including student tuition charges. The amount of a pledge made
492	492	under this subsection may not be reduced or abrogated while the
493	493	bonds for which the pledge is made, or bonds issued to refund those
494	494	bonds, are outstanding.
495	495	(c) If sufficient funds are not available to the board to
496	496	meet its obligations under this section, the board may transfer
497	497	funds among institutions, branches, and entities of the Texas State
498	498	Technical College System to ensure the most equitable and efficient
499	499	allocation of available resources for each institution, branch, or
500	500	entity to carry out its duties and purposes.
501	501	SECTION 2. Section 61.0572(e), Education Code, is amended
502	502	to read as follows:
503	503	(e) Approval of the board is not required to acquire real
504	504	property that is financed by bonds issued under Section 55.17(e)(3)
505	505	or (4), 55.1713-55.1718, 55.1721-55.1728, 55.1735(a)(1), 55.174,
506	506	55.1742, 55.1743, 55.1744, [or] 55.1751-55.17592, or
507	507	55.1771-55.1781, except that the board shall review all real
508	508	property to be financed by bonds issued under those sections to
509	509	determine whether the property meets the standards adopted by the
510	510	board for cost, efficiency, and space use. If the property does not
511	511	meet those standards, the board shall notify the governor, the
512	512	lieutenant governor, the speaker of the house of representatives,
513	513	and the Legislative Budget Board.
514	514	SECTION 3. Section 61.058(b), Education Code, is amended to
515	515	read as follows:
516	516	(b) This section does not apply to construction, repair, or
517	517	rehabilitation financed by bonds issued under Section 55.17(e)(3)
518	518	or (4), 55.1713-55.1718, 55.1721-55.1728, 55.174, 55.1742,
519	519	55.1743, 55.1744 [or] 55.1751-55.17.592 , or 55.1771-55.1781,
520	520	except that the board shall review all construction, repair, or
521	521	rehabilitation to be financed by bonds issued under those sections
522	522	to determine whether the construction, rehabilitation, or repair
523	523	meets the standards adopted by board rule for cost, efficiency, and
524	524	space use. If the construction, rehabilitation, or repair does not
525	525	meet those standards, the board shall notify the governor, the
526	526	lieutenant governor, the speaker of the house of representatives,
527	527	and the Legislative Budget Board.
528	528	SECTION 4. This Act does not affect any authority or
529	529	restriction regarding the activities that a public institution of
530	530	higher education may conduct in connection with a facility financed
531	531	by bonds authorized by this Act.
532	532	SECTION 5. This Act takes effect immediately if it receives
533	533	a vote of two-thirds of all the members elected to each house, as
534	534	provided by Section 39, Article III, Texas Constitution. If this
535	535	Act does not receive the vote necessary for immediate effect, this
536	536	Act takes effect on the 91st day after the last day of the
537	537	legislative session.
