66 AN ACT
77 relating to authorizing the issuance of revenue bonds or other
88 obligations to fund capital projects at public institutions of
99 higher education.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter B, Chapter 55, Education Code, is
1212 amended by adding Sections 55.1771, 55.1772, 55.1773, 55.1774,
1313 55.1775, 55.1776, 55.1777, 55.1778, 55.1779, 55.1780, and 55.1781
1414 to read as follows:
1515 Sec. 55.1771. THE TEXAS A&M UNIVERSITY SYSTEM; ADDITIONAL
1616 BONDS. (a) In addition to the other authority granted by this
1717 subchapter, the board of regents of The Texas A&M University System
1818 may acquire, purchase, construct, improve, renovate, enlarge, or
1919 equip facilities, including roads and related infrastructure, for
2020 projects to be financed through the issuance of bonds in accordance
2121 with this subchapter and in accordance with a systemwide revenue
2222 financing program adopted by the board for the following
2323 institutions and facilities not to exceed the following aggregate
2424 principal amounts for the projects specified as follows:
2525 (1) Tarleton State University:
2626 (A) $53,000,000 for the renovation and
2727 rehabilitation of the O.A. Grant Building, Joe Autry Agricultural
2828 Building, and the Engineering Technology Building;
2929 (B) $26,000,000 for a Student Success Center and
3030 classroom building;
3131 (C) $58,000,000 for a Special Events Center; and
3232 (D) $29,000,000 for an Environmental and
3333 Agribusiness Research Building.
3434 (2) Texas A&M University-Commerce:
3535 (A) $23,250,000 for renovation of the University
3636 Library; and
3737 (B) $11,250,000 for renovation of the Ferguson
3838 Auditorium and Hall of Languages Building;
3939 (3) Texas A&M University-Corpus Christi:
4040 (A) $75 million for a life sciences building;
4141 (B) $50 million for a fine arts center; and
4242 (C) $31,000,000 for a Learning Resource Center
4343 (4) Texas A&M University-Kingsville:
4444 (A) $70 million for a performing and visual arts
4545 educational complex; and
4646 (B) $65 million for a natural
4747 resources/agriculture academic complex;

7474 (A) $32,500,000 for an academic classroom

7777 support services building.
7878 (12) Texas A&M System Centers:
7979 (A) Texas A&M-Central Texas: $50,000,000 for a
8080 new Classroom/Lab/Office Building
8181 (B) Texas A&M-San Antonio: $60,000,000 for a new
8282 Classroom/Lab/Office Building
8383 (b) The board may pledge irrevocably to the payment of bonds
8484 authorized by this section all or any part of the revenue funds of
8585 an institution, branch, or entity of The Texas A&M University
8686 System, including student tuition charges. The amount of a pledge
8787 made under this subsection may not be reduced or abrogated while the
8888 bonds for which the pledge is made, or bonds issued to refund those
8989 bonds, are outstanding.
9090 (c) If sufficient funds are not available to the board to
9191 meet its obligations under this section, the board may transfer
9292 funds among institutions, branches, and entities of The Texas A&M
9393 University System to ensure the most equitable and efficient
9494 allocation of available resources for each institution, branch, or
9595 entity to carry out its duties and purposes.
9696 Sec. 55.1772. THE UNIVERSITY OF TEXAS SYSTEM; ADDITIONAL
9797 BONDS. (a) In addition to the other authority granted by this
9898 subchapter, the board of regents of The University of Texas System
9999 may acquire, purchase, construct, improve, renovate, enlarge, or
100100 equip facilities, including roads and related infrastructure, for
101101 projects to be financed through the issuance of bonds in accordance
102102 with this subchapter and in accordance with a systemwide revenue
103103 financing program adopted by the board for the following
104104 institutions not to exceed the following aggregate principal
105105 amounts for the projects specified as follows:
106106 (1) The University of Texas at Arlington:
107107 (A) $31,000,000 for an Engineering Research
108108 Building; and
109109 (B) $60,000,000 for a Nanofab building;
110110 (2) The University of Texas at Austin:

187187 (c) If sufficient funds are not available to the board to
188188 meet its obligations under this section, the board may transfer
189189 funds among institutions, branches, and entities of The University
190190 of Texas System to ensure the most equitable and efficient
191191 allocation of available resources for each institution, branch, or
192192 entity to carry out its duties and purposes.
193193 Sec. 55.1773. UNIVERSITY OF HOUSTON SYSTEM; ADDITIONAL
194194 BONDS. (a) In addition to the other authority granted by this
195195 subchapter, the board of regents of the University of Houston
196196 System may acquire, purchase, construct, improve, renovate,
197197 enlarge, or equip facilities, including roads and related
198198 infrastructure, for the following institutions, to be financed
199199 through the issuance of bonds in accordance with this subchapter
200200 and in accordance with a systemwide revenue financing program
201201 adopted by the board, in aggregate principal amounts not to exceed
202202 the following:
203203 (1) the University of Houston:
204204 (A) $83,000,000 for a energy and wind research
205205 building;
206206 (B) $75,000,000 for a bio-life sciences research
207207 building; and
208208 (C) $27,000,000 for a multi-cultural studies and
209209 classroom complex;
210210 (2) the University of Houston--Clear Lake,
211211 $68,600,000 for an academic enrichment and research facility;
212212 (3) the University of Houston--Downtown, $51,429,000
213213 for a science and technology building; and
214214 (4) the University of Houston-Victoria, $30,500,000
215215 for a health and kinesiology education building.
216216 (b) The board may pledge irrevocably to the payment of bonds
217217 authorized by this section all or any part of the revenue funds of
218218 an institution, branch, or entity of the University of Houston
219219 System, including student tuition charges. The amount of a pledge
220220 made under this subsection may not be reduced or abrogated while the
221221 bonds for which the pledge is made, or bonds issued to refund those
222222 bonds, are outstanding.
223223 (c) If sufficient funds are not available to the board to
224224 meet its obligations under this section, the board may transfer
225225 funds among institutions, branches, and entities of the University
226226 of Houston System to ensure the most equitable and efficient
227227 allocation of available resources for each institution, branch, or
228228 entity to carry out its duties and purposes.
229229 Sec. 55.1774. TEXAS STATE UNIVERSITY SYSTEM; ADDITIONAL
230230 BONDS. (a) In addition to the other authority granted by this
231231 subchapter, the board of regents of the Texas State University
232232 System may acquire, purchase, construct, improve, renovate,
233233 enlarge, or equip facilities, including roads and related
234234 infrastructure, for projects to be financed through the issuance of
235235 bonds in accordance with this subchapter and in accordance with a
236236 systemwide revenue financing program adopted by the board for the
237237 following institutions not to exceed the following aggregate
238238 principal amounts for the projects specified as follows:
239239 (1) Lamar University:
240240 (A) $25,000,000 for a new science building;
241241 (B) $15,000,000 for a facilities management
242242 complex;
243243 (C) $36,000,000 for renovation of academic
244244 buildings;
245245 (D) $15,000,000 for a new administration
246246 services building;
247247 (E) $5,000,000 for a new security and computing
248248 center;
249249 (F) $10,000,000 for Addition II to the Cherry
250250 Engineering Building; and
251251 (G) $2,000,000 for the land acquisition;
252252 (2) Lamar State College-Orange:
253253 (A) $3,600,000 for a workforce training center;
254254 and
255255 (B) $6,000,000 for a multi-purpose educational
256256 building;
257257 (3) Lamar State College-Port Arthur:
258258 (A) $1,100,000 for an addition to the allied

288288 (b) The board may pledge irrevocably to the payment of bonds
289289 authorized by this section all or any part of the revenue funds of
290290 an institution, branch, or entity of the Texas State University
291291 System, including student tuition charges. The amount of a pledge
292292 made under this subsection may not be reduced or abrogated while the
293293 bonds for which the pledge is made, or bonds issued to refund those
294294 bonds, are outstanding.
295295 (c) If sufficient funds are not available to the board to
296296 meet its obligations under this section, the board may transfer
297297 funds among institutions, branches, and entities of the Texas State
298298 University System to ensure the most equitable and efficient
299299 allocation of available resources for each institution, branch, or
300300 entity to carry out its duties and purposes.
301301 Sec. 55.1775. UNIVERSITY OF NORTH TEXAS SYSTEM; ADDITIONAL
302302 BONDS. (a) In addition to the other authority granted by this
303303 subchapter, the board of regents of the University of North Texas
304304 System may acquire, purchase, construct, improve, renovate,
305305 enlarge, or equip facilities, including roads and related
306306 infrastructure, for projects to be financed through the issuance of
307307 bonds in accordance with this subchapter and in accordance with a
308308 systemwide revenue financing program adopted by the board for the
309309 following institutions and facilities not to exceed the following
310310 aggregate principal amounts for the projects specified as follows:
311311 (1) the University of North Texas System, $40,000,000
312312 for a College of Law;
313313 (2) the University of North Texas, $63,000,000 for a
314314 College of Visual Arts and Design building; and
315315 (3) the University of North Texas Dallas Campus,
316316 $18,500,000 for a second building.
317317 (4) the University of North Texas Health Sciences
318318 Center. $90,000,000 for a new Research Building
319319 (b) The board may pledge irrevocably to the payment of bonds
320320 authorized by this section all or any part of the revenue funds of
321321 an institution, branch, or entity of the University of North Texas
322322 System, including student tuition charges. The amount of a pledge
323323 made under this subsection may not be reduced or abrogated while the
324324 bonds for which the pledge is made, or bonds issued to refund those
325325 bonds, are outstanding.
326326 (c) If sufficient funds are not available to the board to
327327 meet its obligations under this section, the board may transfer
328328 funds among institutions, branches, and entities of the University
329329 of North Texas System to ensure the most equitable and efficient
330330 allocation of available resources for each institution, branch, or
331331 entity to carry out its duties and purposes.
332332 (d) Notwithstanding Subsection (a), the University of North
333333 Texas System may not issue bonds under this section for facilities
334334 at the University of North Texas Dallas Campus until the Texas
335335 Higher Education Coordinating Board certifies that enrollment at
336336 the University of North Texas Dallas Campus has reached an
337337 enrollment equivalent of 1,500 full-time students for one semester.
338338 If that enrollment is not reached by January 1, 2010, the system's
339339 authority to issue bonds for the University of North Texas Dallas
340340 Campus under this section expires on that date.
341341 Sec. 55.1776. TEXAS WOMAN'S UNIVERSITY. (a) In addition to
342342 the other authority granted by this subchapter, the board of
343343 regents of Texas Woman's University may acquire, purchase,
344344 construct, improve, renovate, enlarge, or equip facilities,
345345 including roads and related infrastructure, for projects to be
346346 financed through the issuance of bonds in accordance with this
347347 subchapter and in accordance with a systemwide revenue financing
348348 program adopted by the board for the following institutions and
349349 facilities not to exceed the following aggregate principal amounts
350350 for the projects specified as follows:
351351 (1) $26,000,000 for a graduate research building;
352352 (2) $17,500,000 for the renovation of the old main
353353 building;
354354 (3) $9,500,000 for a new academic support and
355355 administrative support building; and
356356 (4) $4,800,000 for infrastructure repair and upgrade.
357357 (b) The board may pledge irrevocably to the payment of bonds
358358 authorized by this section all or any part of the revenue funds of
359359 Texas Woman's University, including student tuition charges. The
360360 amount of a pledge made under this subsection may not be reduced or
361361 abrogated while the bonds for which the pledge is made, or bonds
362362 issued to refund those bonds, are outstanding.
363363 Sec. 55.1777. MIDWESTERN STATE UNIVERSITY; ADDITIONAL
364364 BONDS. (a) In addition to the other authority granted by this
365365 subchapter, the board of regents of Midwestern State University may
366366 acquire, purchase, construct, improve, renovate, enlarge, or equip
367367 facilities, including roads and related infrastructure, for
368368 projects at Midwestern State University, to be financed through the
369369 issuance of bonds in accordance with this subchapter not to exceed
370370 the following aggregate principal amounts for the projects
371371 specified as follows:
372372 (1) $6,420,000 for Phase II of the renovation of the D.
373373 L. Ligon Building; and
374374 (2) $40,000,000 for the reconstruction of the Moffett
375375 Library.
376376 (b) The board may pledge irrevocably to the payment of bonds
377377 authorized by this section all or any part of the revenue funds of
378378 Midwestern State University, including student tuition charges.
379379 The amount of a pledge made under this subsection may not be reduced
380380 or abrogated while the bonds for which the pledge is made, or bonds
381381 issued to refund those bonds, are outstanding.
382382 Sec. 55.1778. STEPHEN F. AUSTIN STATE UNIVERSITY. (a) In
383383 addition to the other authority granted by this subchapter, the
384384 board of regents of Stephen F. Austin State University may acquire,
385385 purchase, construct, improve, renovate, enlarge, or equip
386386 facilities, including roads and related infrastructure, for a
387387 molecular sciences building at Stephen F. Austin State University,
388388 to be financed through the issuance of bonds in accordance with this
389389 subchapter not to exceed the aggregate principal amount of
390390 $46,000,000.
391391 (b) The board may pledge irrevocably to the payment of bonds
392392 authorized by this section all or any part of the revenue funds of
393393 Stephen F. Austin State University, including student tuition
394394 charges. The amount of a pledge made under this subsection may not
395395 be reduced or abrogated while the bonds for which the pledge is
396396 made, or bonds issued to refund those bonds, are outstanding.
397397 Sec. 55.1779. TEXAS TECH UNIVERSITY SYSTEM; ADDITIONAL
398398 BONDS. (a) In addition to the other authority granted by this
399399 subchapter, the board of regents of the Texas Tech University
400400 System may acquire, purchase, construct, improve, renovate,
401401 enlarge, or equip facilities, including roads and related
402402 infrastructure, for projects to be financed through the issuance of
403403 bonds in accordance with this subchapter and in accordance with a
404404 systemwide revenue financing program adopted by the board not to
405405 exceed the following aggregate principal amounts for the projects
406406 specified as follows:
407407 (1) Texas Tech University Health Sciences Center:
408408 (A) $72,000,000 for Lubbock
409409 Education/Research/Technology and renovation;
410410 (B) $58,500,000 for the EL Paso Medical Science
411411 Building II;
412412 (C) $27,000,000 for the El Paso Clinical Sciences
413413 Building;
414414 (D) $12,600,000 for the Permian Basin medical
415415 education facility; and
416416 (E) $14,850,000 for the Panhandle
417417 clinical/hospital simulation center;
418418 (2) Texas Tech University:
419419 (A) $95,000,000 for the expansion and renovation
420420 of the College of Engineering;
421421 (B) $42,500,000 for a Plant and Soil Sciences
422422 Building; and
423423 (C) $45,000,000 for a performing arts center; and
424424 (3) Angelo State University:
425425 (A) $40,000,000 for the College of Nursing and
426426 Allied Health;
427427 (B) $35,000,000 for campus modernization and
428428 expansion; and
429429 (C) $42,325,000 for a Performing Arts Center.
430430 (b) The board may pledge irrevocably to the payment of bonds
431431 authorized by this section all or any part of the revenue funds of
432432 an institution, branch, or entity of the Texas Tech University
433433 System, including student tuition charges. The amount of a pledge
434434 made under this subsection may not be reduced or abrogated while the
435435 bonds for which the pledge is made, or bonds issued to refund those
436436 bonds, are outstanding.
437437 (c) If sufficient funds are not available to the board to
438438 meet its obligations under this section, the board may transfer
439439 funds among institutions, branches, and entities of the Texas Tech
440440 University System to ensure the most equitable and efficient
441441 allocation of available resources for each institution, branch, or
442442 entity to carry out its duties and purposes.
443443 Sec. 55.1780. TEXAS SOUTHERN UNIVERSITY; ADDITIONAL BONDS.
444444 (a) In addition to the other authority granted by this subchapter,
445445 the board of regents of Texas Southern University may acquire,
446446 purchase, construct, improve, renovate, enlarge, or equip
447447 facilities, including roads and related infrastructure, for
448448 projects at Texas Southern University, to be financed through the
449449 issuance of bonds in accordance with this subchapter not to exceed
450450 the following aggregate principal amounts for the projects
451451 specified as follows:
452452 (1) $46,000,000 for renovation of the Robert J. Terry
453453 Library;
454454 (2) $9,450,000 for a Spearman technology building;
455455 (3) $4,500,000 for Multi-purpose Academic Center;
456456 (4) $30,000,000 for deferred maintenance;
457457 (5) $5,000,000 for asbestos abatement and removal;
458458 (6) $10,000,000 for campus
459459 infrastructure/beautification; and
460460 (7) $4,000,000 for land acquisition/Multi-Purpose
461461 Academic Center.
462462 (b) The board may pledge irrevocably to the payment of bonds
463463 authorized by this section all or any part of the revenue funds of
464464 Texas Southern University, including student tuition charges. The
465465 amount of a pledge made under this subsection may not be reduced or
466466 abrogated while the bonds for which the pledge is made, or bonds
467467 issued to refund those bonds, are outstanding.
468468 Sec. 55.1781. TEXAS STATE TECHNICAL COLLEGE SYSTEM. (a) In
469469 addition to the other authority granted by this subchapter, the
470470 board of regents of the Texas State Technical College System may
471471 acquire, purchase, construct, improve, renovate, enlarge, or equip
472472 property, buildings, structures, facilities, roads, or related
473473 infrastructure, for projects to be financed through the issuance of
474474 bonds in accordance with this subchapter not to exceed the
475475 following aggregate principal amounts for the projects specified as
476476 follows:
477477 (1) Texas State Technical College-Harlingen,
478478 $8,000,000 to construct an academic building;
479479 (2) Texas State Technical College-Brownwood,
480480 $3,000,000 to renovate an academic building;
481481 (3) Texas State Technical College-Marshall,
482482 $2,500,000 for a diesel equipment technology building; and
483483 (4)Texas State Technical College-Waco:
484484 (A) $10,000,000 for a learning services center;
485485 and
486486 (B) $5,000,000 for Phase II of the East
487487 Williamson County Education Center.
488488 (b) The board may pledge irrevocably to the payment of those
489489 bonds all or any part of the revenue funds of an institution,
490490 branch, or entity of the Texas State Technical College System,
491491 including student tuition charges. The amount of a pledge made
492492 under this subsection may not be reduced or abrogated while the
493493 bonds for which the pledge is made, or bonds issued to refund those
494494 bonds, are outstanding.
495495 (c) If sufficient funds are not available to the board to
496496 meet its obligations under this section, the board may transfer
497497 funds among institutions, branches, and entities of the Texas State
498498 Technical College System to ensure the most equitable and efficient
499499 allocation of available resources for each institution, branch, or
500500 entity to carry out its duties and purposes.
501501 SECTION 2. Section 61.0572(e), Education Code, is amended
502502 to read as follows:
503503 (e) Approval of the board is not required to acquire real
504504 property that is financed by bonds issued under Section 55.17(e)(3)
505505 or (4), 55.1713-55.1718, 55.1721-55.1728, 55.1735(a)(1), 55.174,

507507 55.1771-55.1781, except that the board shall review all real
508508 property to be financed by bonds issued under those sections to
509509 determine whether the property meets the standards adopted by the
510510 board for cost, efficiency, and space use. If the property does not
511511 meet those standards, the board shall notify the governor, the
512512 lieutenant governor, the speaker of the house of representatives,
513513 and the Legislative Budget Board.
514514 SECTION 3. Section 61.058(b), Education Code, is amended to
515515 read as follows:
516516 (b) This section does not apply to construction, repair, or
517517 rehabilitation financed by bonds issued under Section 55.17(e)(3)
518518 or (4), 55.1713-55.1718, 55.1721-55.1728, 55.174, 55.1742,
519519 55.1743, 55.1744 [or] 55.1751-55.17.592 , or 55.1771-55.1781,
520520 except that the board shall review all construction, repair, or
521521 rehabilitation to be financed by bonds issued under those sections
522522 to determine whether the construction, rehabilitation, or repair
523523 meets the standards adopted by board rule for cost, efficiency, and
524524 space use. If the construction, rehabilitation, or repair does not
525525 meet those standards, the board shall notify the governor, the
526526 lieutenant governor, the speaker of the house of representatives,
527527 and the Legislative Budget Board.
528528 SECTION 4. This Act does not affect any authority or
529529 restriction regarding the activities that a public institution of
530530 higher education may conduct in connection with a facility financed
531531 by bonds authorized by this Act.
532532 SECTION 5. This Act takes effect immediately if it receives
533533 a vote of two-thirds of all the members elected to each house, as
534534 provided by Section 39, Article III, Texas Constitution. If this
535535 Act does not receive the vote necessary for immediate effect, this
536536 Act takes effect on the 91st day after the last day of the
537537 legislative session.
