9 | 9 | | ARTICLE 1. FEDERAL DRIVER'S LICENSE AND IDENTIFICATION CARD |
---|
10 | 10 | | SECURITY REQUIREMENTS |
---|
11 | 11 | | SECTION 1.01. The heading to Chapter 521, Transportation |
---|
12 | 12 | | Code, is amended to read as follows: |
---|
13 | 13 | | CHAPTER 521. DRIVER'S LICENSES AND IDENTIFICATION CARDS |
---|
14 | 14 | | [CERTIFICATES] |
---|
15 | 15 | | SECTION 1.02. Section 521.001(a), Transportation Code, is |
---|
16 | 16 | | amended by amending Subdivision (3) and adding Subdivisions (5-a) |
---|
17 | 17 | | and (10) to read as follows: |
---|
18 | 18 | | (3) "Driver's license" means an authorization issued |
---|
19 | 19 | | by the department for the operation of a motor vehicle. The term |
---|
20 | 20 | | includes: |
---|
21 | 21 | | (A) a learner's license [temporary license or |
---|
22 | 22 | | instruction permit]; and |
---|
23 | 23 | | (B) an occupational license. |
---|
24 | 24 | | (5-a) "Identification card" means a document issued by |
---|
25 | 25 | | the department verifying a person's identity. |
---|
26 | 26 | | (10) "Temporary driver's license" or "temporary |
---|
27 | 27 | | identification card" means a driver's license or identification |
---|
28 | 28 | | card issued to a person who is not a citizen or legal permanent |
---|
29 | 29 | | resident of the United States but has been granted lawful temporary |
---|
30 | 30 | | status in the United States by the United States agency responsible |
---|
31 | 31 | | for citizenship and immigration. A temporary driver's license |
---|
32 | 32 | | includes a learner's license, provisional license, and |
---|
33 | 33 | | occupational license. |
---|
34 | 34 | | SECTION 1.03. Subchapter A, Chapter 521, Transportation |
---|
35 | 35 | | Code, is amended by adding Section 521.007 to read as follows: |
---|
36 | 36 | | Sec. 521.007. RESTRICTIONS ON ISSUANCE. The department may |
---|
37 | 37 | | not issue both a driver's license and an identification card to the |
---|
38 | 38 | | same individual. |
---|
39 | 39 | | SECTION 1.04. Sections 521.044(a) and (b), Transportation |
---|
40 | 40 | | Code, are amended to read as follows: |
---|
41 | 41 | | (a) Information provided on a driver's license or |
---|
42 | 42 | | identification card application that relates to the applicant's |
---|
43 | 43 | | social security number may be used only by the department or |
---|
44 | 44 | | disclosed only to: |
---|
45 | 45 | | (1) the child support enforcement division of the |
---|
46 | 46 | | attorney general's office; |
---|
47 | 47 | | (2) another state entity responsible for enforcing the |
---|
48 | 48 | | payment of child support; [or] |
---|
49 | 49 | | (3) the United States Selective Service System as |
---|
50 | 50 | | provided by Section 521.147; or |
---|
51 | 51 | | (4) another state's driver's licensing agency or |
---|
52 | 52 | | central record system as required by federal law. |
---|
53 | 53 | | (b) The department shall enter an applicant's social |
---|
54 | 54 | | security number in the department's electronic database but may not |
---|
55 | 55 | | print the number on the applicant's driver's license or |
---|
56 | 56 | | identification card. |
---|
57 | 57 | | SECTION 1.05. Section 521.101, Transportation Code, is |
---|
58 | 58 | | amended to read as follows: |
---|
59 | 59 | | Sec. 521.101. [PERSONAL] IDENTIFICATION CARD |
---|
60 | 60 | | [CERTIFICATE]. (a) The department shall issue [personal] |
---|
61 | 61 | | identification cards [certificates]. |
---|
62 | 62 | | (b) An [A personal] identification card [certificate] must |
---|
63 | 63 | | be similar in form to, but distinguishable in color from, a driver's |
---|
64 | 64 | | license. |
---|
65 | 65 | | (c) The department shall indicate "UNDER 21" on the face of |
---|
66 | 66 | | an [a personal] identification card [certificate] issued to a |
---|
67 | 67 | | person under 21 years of age. |
---|
68 | 68 | | (d) The department may require each applicant for an |
---|
69 | 69 | | original, renewal, or duplicate [personal] identification card |
---|
70 | 70 | | [certificate] to furnish to the department the information required |
---|
71 | 71 | | by Section 521.142. |
---|
72 | 72 | | (e) The department may cancel and require surrender of an [a |
---|
73 | 73 | | personal] identification card [certificate] after determining that |
---|
74 | 74 | | the holder [was] is not entitled to the identification card |
---|
75 | 75 | | [certificate] or gave incorrect or incomplete information in the |
---|
76 | 76 | | application for the identification card [certificate]. |
---|
77 | 77 | | (f) An identification card [A certificate] expires: |
---|
78 | 78 | | (1) on a date specified by the department if the |
---|
79 | 79 | | applicant is a citizen or legal permanent resident of the United |
---|
80 | 80 | | States; or |
---|
81 | 81 | | (2) if the applicant is not a citizen or legal |
---|
82 | 82 | | permanent resident of the United States: |
---|
83 | 83 | | (A) the expiration of the applicant's authorized |
---|
84 | 84 | | stay in the United States; or |
---|
85 | 85 | | (B) one year from the issuance date if there is no |
---|
86 | 86 | | definite expiration date for the authorized stay in the United |
---|
87 | 87 | | States. [, except that a certificate issued to a person 60 years of |
---|
88 | 88 | | age or older does not expire]. |
---|
89 | 89 | | (f-1) A person who is not a citizen of the United States must |
---|
90 | 90 | | present to the department documentation issued by the United States |
---|
91 | 91 | | agency responsible for citizenship and immigration authorizing the |
---|
92 | 92 | | person to be in the United States before the person may be issued an |
---|
93 | 93 | | identification card. |
---|
94 | 94 | | (g) An individual, corporation, or association may not deny |
---|
95 | 95 | | the holder of an [a personal] identification card [certificate] |
---|
96 | 96 | | access to goods, services, or facilities, except as provided by |
---|
97 | 97 | | Section 521.460 or in regard to the operation of a motor vehicle, |
---|
98 | 98 | | because the holder has an [a personal] identification card |
---|
99 | 99 | | [certificate] rather than a driver's license. |
---|
100 | 100 | | (h) The department shall automatically revoke each |
---|
101 | 101 | | [personal] identification card [certificate] issued by the |
---|
102 | 102 | | department to a person who: |
---|
103 | 103 | | (1) is subject to the registration requirements of |
---|
104 | 104 | | Chapter 62, Code of Criminal Procedure; and |
---|
105 | 105 | | (2) fails to apply to the department for renewal of the |
---|
106 | 106 | | [personal] identification card [certificate] as required by |
---|
107 | 107 | | Article 62.060, Code of Criminal Procedure. |
---|
108 | 108 | | (i) The department may issue an [a personal] identification |
---|
109 | 109 | | card [certificate] to a person whose identification card |
---|
110 | 110 | | [certificate] is revoked under Subsection (h) only if the person |
---|
111 | 111 | | applies for an original or renewal identification card |
---|
112 | 112 | | [certificate] under Section 521.103. |
---|
113 | 113 | | SECTION 1.06. Section 521.103, Transportation Code, is |
---|
114 | 114 | | amended to read as follows: |
---|
115 | 115 | | Sec. 521.103. EXPIRATION AND RENEWAL REQUIREMENTS FOR |
---|
116 | 116 | | CERTAIN SEX OFFENDERS. (a) The department may issue an original |
---|
117 | 117 | | or renewal [personal] identification card [certificate] to a person |
---|
118 | 118 | | whose driver's license or [personal] identification card |
---|
119 | 119 | | [certificate] record indicates that the person is subject to the |
---|
120 | 120 | | registration requirements of Chapter 62, Code of Criminal |
---|
121 | 121 | | Procedure, only if the person: |
---|
122 | 122 | | (1) applies in person for the issuance of an |
---|
123 | 123 | | identification card [a certificate] under this section; and |
---|
124 | 124 | | (2) pays a fee of $20. |
---|
125 | 125 | | (b) An [A personal] identification card [certificate] |
---|
126 | 126 | | issued under this section, including a renewal, duplicate, or |
---|
127 | 127 | | corrected identification card [certificate], expires: |
---|
128 | 128 | | (1) if the identification card holder is a citizen or |
---|
129 | 129 | | legal permanent resident of the United States, on the first |
---|
130 | 130 | | birthday of the identification card [certificate] holder occurring |
---|
131 | 131 | | after the date of application, except that the initial |
---|
132 | 132 | | identification card [certificate] issued under this section |
---|
133 | 133 | | expires on the second birthday of the identification card |
---|
134 | 134 | | [certificate] holder occurring after the date of application; or |
---|
135 | 135 | | (2) if the applicant is not a citizen or legal |
---|
136 | 136 | | permanent resident of the United States: |
---|
137 | 137 | | (A) the expiration of the applicant's authorized stay in the |
---|
138 | 138 | | United States; or |
---|
139 | 139 | | (B) one year from the issuance date if there is no |
---|
140 | 140 | | definite expiration date for the authorized stay in the United |
---|
141 | 141 | | States. |
---|
142 | 142 | | SECTION 1.07. Section 521.104, Transportation Code, is |
---|
143 | 143 | | amended to read as follows: |
---|
144 | 144 | | Sec. 521.104. RENEWAL BY MAIL OR ELECTRONIC MEANS. The |
---|
145 | 145 | | department by rule may provide that the holder of an [a personal] |
---|
146 | 146 | | identification card [certificate] may renew the card [certificate] |
---|
147 | 147 | | by mail, by telephone, over the Internet, or by other electronic |
---|
148 | 148 | | means. A rule adopted under this section may prescribe eligibility |
---|
149 | 149 | | standards for renewal under this section. |
---|
150 | 150 | | SECTION 1.08. Section 521.121(a), Transportation Code, is |
---|
151 | 151 | | amended to read as follows: |
---|
152 | 152 | | (a) The driver's license must include: |
---|
153 | 153 | | (1) a distinguishing number assigned by the department |
---|
154 | 154 | | to the license holder; |
---|
155 | 155 | | (2) a digital [color] photograph of the entire face of |
---|
156 | 156 | | the holder; |
---|
157 | 157 | | (3) the full legal name, date of birth, gender, and |
---|
158 | 158 | | residence address of the holder; and |
---|
159 | 159 | | (4) a brief description of the holder. |
---|
160 | 160 | | SECTION 1.09. Section 521.124, Transportation Code, is |
---|
161 | 161 | | amended to read as follows: |
---|
162 | 162 | | Sec. 521.124. TEMPORARY LICENSE OR TEMPORARY |
---|
163 | 163 | | IDENTIFICATION CARD[; ISSUED WITHOUT PHOTOGRAPH]. (a) The |
---|
164 | 164 | | department shall [may] issue a temporary driver's license or |
---|
165 | 165 | | temporary identification card [without a photograph of the license |
---|
166 | 166 | | holder: |
---|
167 | 167 | | [(1)] to an applicant who is not a citizen or legal |
---|
168 | 168 | | permanent resident[out of state or a member of the armed forces] of |
---|
169 | 169 | | the United States and has temporary lawful status in the United |
---|
170 | 170 | | States[; or |
---|
171 | 171 | | [(2) if the department otherwise determines that a |
---|
172 | 172 | | temporary license is necessary]. |
---|
173 | 173 | | (b) A temporary driver's license or temporary |
---|
174 | 174 | | identification card expires: |
---|
175 | 175 | | (1) the expiration of the applicant's authorized period of |
---|
176 | 176 | | stay in the United States as determined by the United States agency |
---|
177 | 177 | | responsible for citizenship and immigration in compliance with |
---|
178 | 178 | | federal law; or |
---|
179 | 179 | | (2) one year from the issuance date if there is no definite |
---|
180 | 180 | | end to the period of authorized stay as determined by the United |
---|
181 | 181 | | States agency responsible for citizenship and immigration in |
---|
182 | 182 | | compliance with federal law. [A temporary license is valid only |
---|
183 | 183 | | until the applicant has time to appear and be photographed and a |
---|
184 | 184 | | license with a photograph is issued]. |
---|
185 | 185 | | (c) The department may require each applicant for an |
---|
186 | 186 | | original, renewal, or duplicate temporary driver's license or |
---|
187 | 187 | | temporary identification card to furnish to the department the |
---|
188 | 188 | | information required by Section 521.142. |
---|
189 | 189 | | (d) A temporary driver's license or temporary |
---|
190 | 190 | | identification card must be distinctively marked on the face of the |
---|
191 | 191 | | license or card. |
---|
192 | 192 | | (e) A temporary driver's license or temporary |
---|
193 | 193 | | identification card cannot be issued for a term longer than maximum |
---|
194 | 194 | | term of a driver's license or identification card issued under this |
---|
195 | 195 | | chapter. |
---|
196 | 196 | | SECTION 1.10. Section 521.142, Transportation Code, is |
---|
197 | 197 | | amended by amending Subsections (a), (b), (c), (e), and (g) and |
---|
198 | 198 | | adding Subsection (i) to read as follows: |
---|
199 | 199 | | (a) An application for an original license must state the |
---|
200 | 200 | | applicant's full legal name and place and date of birth. This |
---|
201 | 201 | | information must be verified by presentation of proof of identity |
---|
202 | 202 | | satisfactory to the department and in compliance with applicable |
---|
203 | 203 | | federal law. A person who is not a citizen of the United States must |
---|
204 | 204 | | present to the department documentation issued by the United States |
---|
205 | 205 | | agency responsible for citizenship and immigration authorizing the |
---|
206 | 206 | | person to be in the United States before the person may be issued a |
---|
207 | 207 | | driver's license or identification card. [The department must |
---|
208 | 208 | | accept as satisfactory proof of identity under this subsection an |
---|
209 | 209 | | offender identification card or similar form of identification |
---|
210 | 210 | | issued to an inmate by the Texas Department of Criminal Justice.] |
---|
211 | 211 | | (b) The application must include: |
---|
212 | 212 | | (1) the thumbprints of the applicant or, if |
---|
213 | 213 | | thumbprints cannot be taken, the index fingerprints of the |
---|
214 | 214 | | applicant; |
---|
215 | 215 | | (2) a digital photograph of the applicant; |
---|
216 | 216 | | (3) the signature of the applicant; and |
---|
217 | 217 | | (4) a brief description of the applicant. |
---|
218 | 218 | | (c) The application must state: |
---|
219 | 219 | | (1) the gender [sex] of the applicant; |
---|
220 | 220 | | (2) the principal residence address of the applicant; |
---|
221 | 221 | | (3) whether the applicant has been licensed to drive a |
---|
222 | 222 | | motor vehicle or issued an identification card before; |
---|
223 | 223 | | (4) if previously licensed or issued an identification |
---|
224 | 224 | | card, when and by what state or country; |
---|
225 | 225 | | (5) whether that license or driving privilege has been |
---|
226 | 226 | | suspended or revoked or a license application denied; |
---|
227 | 227 | | (6) the date and reason for the suspension, |
---|
228 | 228 | | revocation, or denial; |
---|
229 | 229 | | (7) whether the applicant is a citizen of the United |
---|
230 | 230 | | States; and |
---|
231 | 231 | | (8) the county of residence of the applicant. |
---|
232 | 232 | | (e) The application must include any other information the |
---|
233 | 233 | | department requires to determine the applicant's identity, |
---|
234 | 234 | | residency, competency, and eligibility as required by the |
---|
235 | 235 | | department or state or federal law. |
---|
236 | 236 | | (g) The department shall [may] require an applicant to |
---|
237 | 237 | | provide the applicant's social security number or proof of |
---|
238 | 238 | | ineligibility for a social security number as required by state or |
---|
239 | 239 | | federal law [only for a purpose permitted by Section 521.044]. |
---|
240 | 240 | | (i) The application must be accompanied by a sworn statement |
---|
241 | 241 | | certifying that the information provided on the application is true |
---|
242 | 242 | | and correct. |
---|
243 | 243 | | SECTION 1.11. Section 521.182, Transportation Code, is |
---|
244 | 244 | | amended to read as follows: |
---|
245 | 245 | | Sec. 521.182. SURRENDER OF LICENSE OR IDENTIFICATION CARD |
---|
246 | 246 | | ISSUED BY OTHER JURISDICTION. (a) A person is not entitled to |
---|
247 | 247 | | receive a driver's license or identification card until the person |
---|
248 | 248 | | terminates by surrendering [surrenders] to the department each |
---|
249 | 249 | | driver's license or identification card in the person's possession |
---|
250 | 250 | | that was issued by this state or another state or Canadian province. |
---|
251 | 251 | | (a-1) The department may invalidate the surrendered license |
---|
252 | 252 | | or identification card and return it to the applicant. |
---|
253 | 253 | | (b) The department shall send to the state or province that |
---|
254 | 254 | | issued the license or identification card: |
---|
255 | 255 | | (1) the surrendered license or identification card or |
---|
256 | 256 | | a notification that the license or identification card has been |
---|
257 | 257 | | surrendered; and |
---|
258 | 258 | | (2) a statement that the person holds a driver's |
---|
259 | 259 | | license or identification card issued by this state. |
---|
260 | 260 | | SECTION 1.12. Section 521.222, Transportation Code, is |
---|
261 | 261 | | amended to read as follows: |
---|
262 | 262 | | Sec. 521.222. LEARNER'S LICENSE [INSTRUCTION PERMIT]. |
---|
263 | 263 | | (a) The department or a driver education school licensed under |
---|
264 | 264 | | Chapter 1001, Education Code, [the Texas Driver and Traffic Safety |
---|
265 | 265 | | Education Act (Article 4413(29c), Vernon's Texas Civil Statutes)] |
---|
266 | 266 | | may issue a learner's license [an instruction permit], including a |
---|
267 | 267 | | Class A or Class B driver's license learner's license [instruction |
---|
268 | 268 | | permit], to a person who: |
---|
269 | 269 | | (1) is 15 years of age or older but under 18 years of |
---|
270 | 270 | | age; |
---|
271 | 271 | | (2) has satisfactorily completed and passed the |
---|
272 | 272 | | classroom phase of an approved driver education course, which may |
---|
273 | 273 | | be a course approved under Section 521.205; |
---|
274 | 274 | | (3) meets the requirements imposed under Section |
---|
275 | 275 | | 521.204(a)(3) [521.204(3)]; and |
---|
276 | 276 | | (4) has passed each examination required under Section |
---|
277 | 277 | | 521.161 other than the driving test. |
---|
278 | 278 | | (b) The department may issue a learner's license [an |
---|
279 | 279 | | instruction permit] to a person 18 years of age or older who has |
---|
280 | 280 | | successfully passed all parts of the driver's examination required |
---|
281 | 281 | | under Section 521.161 other than the driving test. |
---|
282 | 282 | | (c) A driver education school may issue a learner's license |
---|
283 | 283 | | [an instruction permit] to a person 18 years of age or older who has |
---|
284 | 284 | | successfully passed: |
---|
285 | 285 | | (1) a six-hour adult classroom driver education course |
---|
286 | 286 | | approved by the Texas Education Agency; and |
---|
287 | 287 | | (2) each part of the driver's examination required by |
---|
288 | 288 | | Section 521.161 other than the driving test. |
---|
289 | 289 | | (d) A learner's license [An instruction permit] entitles |
---|
290 | 290 | | the holder to operate a type of motor vehicle on a highway while: |
---|
291 | 291 | | (1) the learner's license [permit] is in the holder's |
---|
292 | 292 | | possession; and |
---|
293 | 293 | | (2) the holder is accompanied by a person occupying |
---|
294 | 294 | | the seat by the operator who: |
---|
295 | 295 | | (A) holds a license that qualifies the operator |
---|
296 | 296 | | to operate that type of vehicle; |
---|
297 | 297 | | (B) is 21 years of age or older; and |
---|
298 | 298 | | (C) has at least one year of driving experience. |
---|
299 | 299 | | (e) [Except as provided by Subsection (f), an instruction |
---|
300 | 300 | | permit is not required to include a photograph. |
---|
301 | 301 | | [(f)] The department may issue a learner's license [an |
---|
302 | 302 | | instruction permit] under this section to a person who is subject to |
---|
303 | 303 | | the registration requirements under Chapter 62, Code of Criminal |
---|
304 | 304 | | Procedure, and is otherwise eligible for the learner's license |
---|
305 | 305 | | [permit]. |
---|
306 | 306 | | (f) A learner's license [An instruction permit issued under |
---|
307 | 307 | | this subsection] must include a photograph of the license holder |
---|
308 | 308 | | [person]. |
---|
309 | 309 | | (g) A person who occupies the seat in a vehicle by a holder |
---|
310 | 310 | | of a learner's license [an instruction permit] commits an offense |
---|
311 | 311 | | if, while the holder is operating the vehicle, the person: |
---|
312 | 312 | | (1) sleeps; |
---|
313 | 313 | | (2) is intoxicated, as defined by Section 49.01, Penal |
---|
314 | 314 | | Code; or |
---|
315 | 315 | | (3) is engaged in an activity that prevents the person |
---|
316 | 316 | | from observing and responding to the actions of the operator. |
---|
317 | 317 | | (h) It is a defense to prosecution [of a violation] under |
---|
318 | 318 | | Subsection (g) that at the time of the violation another person in |
---|
319 | 319 | | addition to the defendant: |
---|
320 | 320 | | (1) occupied the seat by the operator; |
---|
321 | 321 | | (2) complied with the requirements of Subsections |
---|
322 | 322 | | (d)(2)(A)-(C); and |
---|
323 | 323 | | (3) was not in violation of Subsection (g). |
---|
324 | 324 | | SECTION 1.13. Section 521.271, Transportation Code, is |
---|
325 | 325 | | amended to read as follows: |
---|
326 | 326 | | Sec. 521.271. LICENSE EXPIRATION. (a) Each original |
---|
327 | 327 | | driver's license, [and] provisional license, learner's license, or |
---|
328 | 328 | | occupational license issued to a person who is a citizen or legal |
---|
329 | 329 | | permanent resident of the United States expires as follows: |
---|
330 | 330 | | (1) except as provided by Section 521.2711, a driver's |
---|
331 | 331 | | license expires on the first birthday of the license holder |
---|
332 | 332 | | occurring after the sixth anniversary of the date of the |
---|
333 | 333 | | application; |
---|
334 | 334 | | (2) a provisional license expires on the earlier of: |
---|
335 | 335 | | (A) the 18th birthday of the license holder; or |
---|
336 | 336 | | (B) the first birthday of the license holder |
---|
337 | 337 | | occurring after the date of the application; |
---|
338 | 338 | | (3) a learner's license [an instruction permit] |
---|
339 | 339 | | expires on the second birthday of the license holder occurring |
---|
340 | 340 | | after the date of the application; and |
---|
341 | 341 | | (4) an occupational license expires on the first |
---|
342 | 342 | | anniversary of the court order granting the license. |
---|
343 | 343 | | (a-1) Each original driver's license, provisional license, |
---|
344 | 344 | | or learner's license issued to a person who is not a citizen or |
---|
345 | 345 | | legal permanent resident of the United States expires on the |
---|
346 | 346 | | earlier of the first anniversary of the date of issuance or the |
---|
347 | 347 | | expiration of the license holder's lawful presence in the United |
---|
348 | 348 | | States as determined by the United States agency responsible for |
---|
349 | 349 | | citizenship and immigration in compliance with federal law. |
---|
350 | 350 | | (b) Except as provided by Section 521.2711, a driver's |
---|
351 | 351 | | license that is renewed expires on: |
---|
352 | 352 | | (1) the sixth anniversary of the expiration date |
---|
353 | 353 | | before renewal if the license holder is a citizen or legal permanent |
---|
354 | 354 | | resident of the United States; or |
---|
355 | 355 | | (2) if the applicant is not a citizen or legal |
---|
356 | 356 | | permanent resident of the United States: |
---|
357 | 357 | | (A) the expiration of the applicant's authorized stay in the |
---|
358 | 358 | | United States; or |
---|
359 | 359 | | (B) one year from the issuance date if there is no |
---|
360 | 360 | | definite expiration date for the authorized stay in the United |
---|
361 | 361 | | States. |
---|
362 | 362 | | (c) The department may require the renewal of a license or |
---|
363 | 363 | | identification card before its expiration if the renewal is |
---|

452 | 452 | | learner's license and a nonresident commercial driver's license. |

453 | 453 | | SECTION 1.19. Section 522.013, Transportation Code, is |
---|
454 | 454 | | amended by amending Subsections (a), (b), (c), (d), and (e) and |
---|
455 | 455 | | adding Subsection (g) to read as follows: |
---|
456 | 456 | | (a) The department may issue a temporary commercial |
---|
457 | 457 | | driver's license or temporary nonresident commercial driver's |
---|
458 | 458 | | license to a resident of a foreign jurisdiction if the secretary has |
---|
459 | 459 | | determined that the commercial motor vehicle testing and licensing |
---|
460 | 460 | | standards in the foreign jurisdiction do not meet the testing |
---|
461 | 461 | | standards established by 49 C.F.R. Part 383. |
---|
462 | 462 | | (b) The department shall issue a temporary commercial |

463 | 463 | | driver's license to an applicant who is not a citizen or legal |
---|
464 | 464 | | permanent resident of the United States and has temporary lawful |
---|
465 | 465 | | status in the United States. [An applicant must surrender any |

466 | 466 | | nonresident commercial driver's license issued by another state.] |
---|
467 | 467 | | (c) The department may require each applicant for an |
---|
468 | 468 | | original, renewal, or duplicate license issued under this section |
---|
469 | 469 | | to furnish to the department the information required by Section |
---|
470 | 470 | | 521.142. [Before issuing a nonresident commercial driver's |
---|
471 | 471 | | license, the department must establish the practical capability of |

472 | 472 | | disqualifying the person under the conditions applicable to a |

473 | 473 | | commercial driver's license issued to a resident of this state.] |
---|
474 | 474 | | (d) A license issued under this section must be |
---|
475 | 475 | | distinctively marked ["Nonresident" must appear] on the face of the |
---|
476 | 476 | | [a] license [issued under this section]. |
---|
477 | 477 | | (e) The department may issue a temporary nonresident |
---|
478 | 478 | | commercial driver's license to a person who does not present a |
---|
479 | 479 | | social security card as required by Section 522.021(a-1)(1) but who |
---|
480 | 480 | | otherwise meets the requirements for a temporary [nonresident] |
---|
481 | 481 | | commercial driver's license, including the requirement that the |
---|
482 | 482 | | commercial motor vehicle testing and licensing standards of the |
---|
483 | 483 | | country of which the applicant is a resident not meet the testing |
---|
484 | 484 | | and licensing standards established by 49 C.F.R. Part 383. A |
---|
485 | 485 | | license issued under this subsection: |
---|
486 | 486 | | (1) expires on the earlier of: |
---|
487 | 487 | | (A) the 60th day after the date the license is |
---|
488 | 488 | | issued; |
---|
489 | 489 | | (B) the expiration date of the visa presented |
---|
490 | 490 | | under Section 522.021(a-1)(2)(B); or |
---|
491 | 491 | | (C) the expiration date of the Form I-94 |
---|
492 | 492 | | Arrival/Departure record, or a successor document, presented under |
---|
493 | 493 | | Section 522.021(a-1)(2)(C); and |
---|
494 | 494 | | (2) may not be renewed. |
---|
495 | 495 | | (g) A temporary commercial driver's license expires: |
---|
496 | 496 | | (1) the expiration of the applicant's authorized period of stay in |
---|
497 | 497 | | the United States as determined by the United States agency |
---|
498 | 498 | | responsible for citizenship and immigration in compliance with |
---|
499 | 499 | | federal law; or |
---|
500 | 500 | | (2) one year from the issuance date if there is no definite |
---|
501 | 501 | | end to the period of authorized stay as determined by the United |
---|
502 | 502 | | States agency responsible for citizenship and immigration in |
---|
503 | 503 | | compliance with federal law. |
---|
504 | 504 | | (h) A temporary commercial driver's license cannot be |
---|
505 | 505 | | issued for a term longer than maximum term of a commercial driver's |
---|
506 | 506 | | license issued under this chapter. |
---|
507 | 507 | | SECTION 1.20. Sections 522.021(a), (c), and (d), |
---|
508 | 508 | | Transportation Code, are amended to read as follows: |
---|
509 | 509 | | (a) An application for a commercial driver's license or |
---|
510 | 510 | | commercial driver learner's license [permit] must include: |
---|
511 | 511 | | (1) the full legal name and current principal |
---|
512 | 512 | | residence and mailing address of the applicant; |
---|
513 | 513 | | (2) a physical description of the applicant, including |
---|
514 | 514 | | gender [sex], height, and eye color; |
---|
515 | 515 | | (3) the applicant's date of birth; |
---|
516 | 516 | | (4) the applicant's social security number, unless the |
---|
517 | 517 | | application is for a temporary nonresident commercial driver's |
---|
518 | 518 | | license and the applicant is a resident of a foreign jurisdiction; |
---|
519 | 519 | | (5) certifications, including those required by 49 |
---|
520 | 520 | | C.F.R. Section 383.71(a); and |
---|
521 | 521 | | (6) any other information required by the department. |
---|
522 | 522 | | (c) The application must meet the requirements of an |
---|
523 | 523 | | application under Sections [Section] 521.141 and 521.142 and must |
---|
524 | 524 | | be accompanied by the fee required under Section 522.029. The |
---|
525 | 525 | | department may require documentary evidence to verify the |
---|
526 | 526 | | information required by Subsection (a). |
---|
527 | 527 | | (d) A person who knowingly falsifies information or a |
---|
528 | 528 | | certification required by Subsection (a) commits an offense and is |
---|
529 | 529 | | subject to a 60-day cancellation of the person's commercial |
---|
530 | 530 | | driver's license, commercial driver learner's license [permit], or |
---|
531 | 531 | | application. An offense under this subsection is a Class C |
---|
532 | 532 | | misdemeanor. |
---|
533 | 533 | | SECTION 1.21. Section 522.022, Transportation Code, is |
---|
534 | 534 | | amended to read as follows: |
---|
535 | 535 | | Sec. 522.022. LICENSE REQUIREMENTS. The department may not |
---|
536 | 536 | | issue a commercial driver's license other than a temporary |
---|
537 | 537 | | nonresident license to a person unless the person: |
---|
538 | 538 | | (1) has a domicile in this state; |
---|
539 | 539 | | (2) has passed knowledge and skills tests for driving |
---|
540 | 540 | | a commercial motor vehicle that comply with minimal federal |
---|
541 | 541 | | standards established by 49 C.F.R. Part 383, Subparts G and H; and |
---|
542 | 542 | | (3) has satisfied the requirements imposed by the |
---|
543 | 543 | | federal act, federal regulation, or state law. |
---|
544 | 544 | | SECTION 1.22. Section 522.029, Transportation Code, is |
---|
545 | 545 | | amended to read as follows: |
---|
546 | 546 | | Sec. 522.029. FEES. (a) The fee for a commercial driver's |
---|
547 | 547 | | license or commercial driver learner's license [permit] issued by |
---|
548 | 548 | | the department is $60, except as provided by Subsections (f), (h), |
---|
549 | 549 | | [and] (j), (k), (l), and (m). |
---|
550 | 550 | | (b) The fee for a commercial driver's license or commercial |
---|
551 | 551 | | driver learner's license [permit] shall be reduced by $4 for each |
---|
552 | 552 | | remaining year of validity of a driver's license, other than a |
---|
553 | 553 | | commercial driver's license or commercial driver learner's license |
---|
554 | 554 | | [permit] issued by the department to the applicant. |
---|
555 | 555 | | (c) The fee for a duplicate commercial driver's license or |
---|
556 | 556 | | commercial driver learner's license [permit] is $10. |
---|
557 | 557 | | (d) An applicant who is changing a class of license, |
---|
558 | 558 | | endorsement, or restriction or who is adding a class of vehicle |
---|
559 | 559 | | other than a motorcycle to the license must pay a fee of $10 for the |
---|
560 | 560 | | examination, except for a renewal or original issuance of a |
---|
561 | 561 | | commercial driver's license. |
---|
562 | 562 | | (e) The fees required by this chapter and collected by an |
---|
563 | 563 | | officer or agent of the department shall be remitted without |
---|
564 | 564 | | deduction to the department. |
---|
565 | 565 | | (f) The fee for renewal of a commercial driver's license or |
---|
566 | 566 | | a commercial driver learner's license [permit] that includes |
---|
567 | 567 | | authorization to operate a motorcycle is $45. |
---|
568 | 568 | | (f-1) [(f)] If a commercial driver's license or commercial |
---|
569 | 569 | | driver learner's license [permit] includes an authorization to |
---|
570 | 570 | | operate a motorcycle or moped, the fee for the driver's license or |
---|
571 | 571 | | learner's license [permit] is increased by $8. |
---|
572 | 572 | | (g) An applicant who is applying for additional |
---|
573 | 573 | | authorization to operate a motorcycle shall pay a fee of $15 for the |
---|
574 | 574 | | examination. |

575 | 575 | | (h) The fee for a commercial driver's license or commercial |
---|
576 | 576 | | driver learner's license [permit] issued under Section 522.033 is |
---|

---|
578 | 578 | | (i) Except as provided by Section 662.011, each fee |

579 | 579 | | collected under this section shall be deposited to the credit of the |

806 | 806 | | (3) notify the person of the consequence of the |

810 | 810 | | copy of the record of conviction, a copy of the order granting |

---|
813 | 813 | | SECTION 2.04. Article 62.053(a), Code of Criminal |
---|

816 | 816 | | under this chapter is due to be released from a penal institution, |
---|
817 | 817 | | the Texas Department of Criminal Justice or the Texas Youth |

818 | 818 | | Commission shall determine the person's level of risk to the |

819 | 819 | | community using the sex offender screening tool developed or |
---|
820 | 820 | | selected under Article 62.007 and assign to the person a numeric |
---|
821 | 821 | | risk level of one, two, or three. Before releasing the person, an |
---|
822 | 822 | | official of the penal institution shall: |
---|
823 | 823 | | (1) inform the person that: |
---|
824 | 824 | | (A) not later than the later of the seventh day |
---|
825 | 825 | | after the date on which the person is released or after the date on |
---|
826 | 826 | | which the person moves from a previous residence to a new residence |
---|
827 | 827 | | in this state or not later than the later of the first date the |
---|
828 | 828 | | applicable local law enforcement authority by policy allows the |
---|
829 | 829 | | person to register or verify registration, the person |
---|
830 | 830 | | must register or verify registration with the local law |
---|
831 | 831 | | enforcement authority in the municipality or county in which the |
---|
832 | 832 | | person intends to reside; |
---|
833 | 833 | | (B) not later than the seventh day after the date |
---|
834 | 834 | | on which the person is released or the date on which the person |
---|
835 | 835 | | moves from a previous residence to a new residence in this state, |
---|
836 | 836 | | the person must, if the person has not moved to an intended |
---|
837 | 837 | | residence, report to the juvenile probation officer, community |
---|
838 | 838 | | supervision and corrections department officer, or parole officer |
---|
839 | 839 | | supervising the person; |
---|
840 | 840 | | (C) not later than the seventh day before the |
---|
841 | 841 | | date on which the person moves to a new residence in this state or |
---|
842 | 842 | | another state, the person must report in person to the local law |
---|
843 | 843 | | enforcement authority designated as the person's primary |
---|
844 | 844 | | registration authority by the department and to the juvenile |
---|
845 | 845 | | probation officer, community supervision and corrections |
---|
846 | 846 | | department officer, or parole officer supervising the person; |
---|
847 | 847 | | (D) not later than the 10th day after the date on |
---|
848 | 848 | | which the person arrives in another state in which the person |
---|
849 | 849 | | intends to reside, the person must register with the law |
---|
850 | 850 | | enforcement agency that is identified by the department as the |
---|
851 | 851 | | agency designated by that state to receive registration |
---|
852 | 852 | | information, if the other state has a registration requirement for |
---|
853 | 853 | | sex offenders; |
---|
854 | 854 | | (E) not later than the 30th day after the date on |
---|
855 | 855 | | which the person is released, the person must apply to the |
---|
856 | 856 | | department in person for the issuance of an original or renewal |
---|
857 | 857 | | driver's license or [personal] identification card [certificate] |
---|
858 | 858 | | and a failure to apply to the department as required by this |
---|
859 | 859 | | paragraph results in the automatic revocation of any driver's |
---|
860 | 860 | | license or [personal] identification card [certificate] issued by |
---|
861 | 861 | | the department to the person; and |
---|
862 | 862 | | (F) the person must notify appropriate entities |
---|
863 | 863 | | of any change in status as described by Article 62.057; |
---|
864 | 864 | | (2) require the person to sign a written statement |
---|
865 | 865 | | that the person was informed of the person's duties as described by |
---|
866 | 866 | | Subdivision (1) or Subsection (g) or, if the person refuses to sign |
---|
867 | 867 | | the statement, certify that the person was so informed; |
---|
868 | 868 | | (3) obtain the address where the person expects to |
---|
869 | 869 | | reside on the person's release and other registration information, |
---|
870 | 870 | | including a photograph and complete set of fingerprints; and |
---|
871 | 871 | | (4) complete the registration form for the person. |
---|
872 | 872 | | SECTION 2.05. Article 62.060, Code of Criminal Procedure, |
---|
873 | 873 | | is amended to read as follows: |
---|
874 | 874 | | Art. 62.060. REQUIREMENTS RELATING TO DRIVER'S LICENSE OR |

885 | 885 | | (1) the person is released from a penal institution or |

886 | 886 | | is released by a court on community supervision or juvenile |
---|

888 | 888 | | (2) the department sends written notice to the person |

889 | 889 | | of the requirements of this article. |
---|
890 | 890 | | (b) The person shall annually renew in person each driver's |
---|
891 | 891 | | license or [personal] identification card [certificate] issued by |
---|
892 | 892 | | the department to the person, including each renewal, duplicate, or |
---|
893 | 893 | | corrected license or card [certificate], until the person's duty to |
---|
894 | 894 | | register under this chapter expires. |
---|
895 | 895 | | SECTION 2.06. Section 1956.062(c), Occupations Code, is |
---|
896 | 896 | | amended to read as follows: |
---|
897 | 897 | | (c) The dealer shall record the proposed seller's driver's |
---|
898 | 898 | | license number or department [personal] identification card |
---|
899 | 899 | | [certificate] number on physical presentation of the license or |
---|
900 | 900 | | [personal] identification card [certificate] by the seller. The |
---|
901 | 901 | | record must accompany the list. |
---|
902 | 902 | | SECTION 2.07. Section 12.114, Parks and Wildlife Code, is |
---|
903 | 903 | | amended to read as follows: |
---|
904 | 904 | | Sec. 12.114. DRIVER'S LICENSE OR [PERSONAL] IDENTIFICATION |
---|
905 | 905 | | CARD [CERTIFICATE] REQUIRED. (a) A person who is 17 years of age or |

906 | 906 | | older and who has a license or permit issued under this code or who |
---|
907 | 907 | | is engaging in an activity that requires a license or permit shall |

910 | 910 | | (b) If the person is a resident as defined by Subdivision |

911 | 911 | | (1) of Section 42.001 of this code, "driver's license" and |

912 | 912 | | "[personal] identification card [certificate]" have the meanings |
---|
913 | 913 | | assigned by Chapter 521, Transportation Code. |
---|
914 | 914 | | (c) If the person is a nonresident as defined by Section |
---|
915 | 915 | | 42.001, "driver's license" and "[personal] identification card |
---|
916 | 916 | | [certificate]" mean those documents that are similar to those |
---|
917 | 917 | | defined in Subsection (b) and that are issued by the agency in the |
---|
918 | 918 | | state or country of which the person is a resident that is |
---|
919 | 919 | | authorized to issue driver's licenses or [personal] identification |
---|
920 | 920 | | cards [certificates]. |
---|
921 | 921 | | SECTION 2.08. Section 12.115(a), Parks and Wildlife Code, |
---|
922 | 922 | | is amended to read as follows: |
---|
923 | 923 | | (a) A person who is arrested for an alleged violation of |
---|
924 | 924 | | this code or a proclamation or regulation adopted under this code |
---|
925 | 925 | | commits an offense if the person: |
---|
926 | 926 | | (1) does not have in his immediate possession a |
---|
927 | 927 | | driver's license or [personal] identification card [certificate] |
---|
928 | 928 | | required by Section 12.114 of this code; or |
---|
929 | 929 | | (2) fails or refuses to display the driver's license or |
---|
930 | 930 | | [personal] identification card [certificate] required by Section |
---|
931 | 931 | | 12.114 of this code when requested to do so by any peace officer, |
---|
932 | 932 | | game warden, magistrate, or officer of a court of competent |
---|
933 | 933 | | jurisdiction. |
---|
934 | 934 | | SECTION 2.09. Section 12.116(a), Parks and Wildlife Code, |
---|
935 | 935 | | is amended to read as follows: |
---|
936 | 936 | | (a) If a person is convicted in justice court for violating |
---|
937 | 937 | | a provision of this code or a proclamation or regulation adopted |
---|
938 | 938 | | under this code that provides enhanced penalties for subsequent |

940 | 940 | | affidavit certifying the conviction. The affidavit must include |

943 | 943 | | SECTION 2.10. The heading to Subtitle B, Title 7, |

---|

---|
961 | 961 | | SECTION 2.12. Sections 521.054(a), (b), and (c), |
---|
962 | 962 | | Transportation Code, are amended to read as follows: |

983 | 983 | | SECTION 2.13. Section 521.057, Transportation Code, is |

---|

1012 | 1012 | | (3) does not commit other fraud in connection with the |
---|
1013 | 1013 | | application for a license[, permit,] or identification card |
---|
1014 | 1014 | | [certificate]. |
---|
1015 | 1015 | | SECTION 2.15. Sections 521.126(a), (b), and (e) through |
---|
1016 | 1016 | | (i), Transportation Code, are amended to read as follows: |

---|

---|

1027 | 1027 | | (2) compiles or maintains a database of electronically |
---|
1028 | 1028 | | readable information derived from driver's licenses, commercial |
---|
1029 | 1029 | | driver's licenses, or [personal] identification card |
---|
1030 | 1030 | | [certificates]. |
---|
1031 | 1031 | | (e) The prohibition provided by Subsection (b)(1) does not |
---|
1032 | 1032 | | apply to a financial institution or a business if the information is |
---|
1033 | 1033 | | accessed and used only for purposes of identification verification |
---|
1034 | 1034 | | of an individual or check verification at the point of sale for a |
---|
1035 | 1035 | | purchase of a good or service by check. The prohibition provided |
---|
1036 | 1036 | | by Subsection (b)(2) does not apply to a financial institution if |
---|
1037 | 1037 | | each license or identification card [certificate] holder whose |
---|
1038 | 1038 | | information is included in the compilation or database consents to |
---|
1039 | 1039 | | the inclusion of the person's information in the compilation or |
---|
1040 | 1040 | | database. Consent under this subsection must be on a separate |
---|
1041 | 1041 | | document, signed by the license or identification card |
---|
1042 | 1042 | | [certificate] holder, that explains in at least 14-point bold type |
---|
1043 | 1043 | | the information that will be included in the compilation or |
---|
1044 | 1044 | | database. For the purposes of this subsection, "financial |
---|
1045 | 1045 | | institution" has the meaning assigned by 31 U.S.C. Section |
---|
1046 | 1046 | | 5312(a)(2), as amended. |
---|
1047 | 1047 | | (f) A person may not use information derived from |
---|
1048 | 1048 | | electronically readable information from a driver's license, |
---|
1049 | 1049 | | commercial driver's license, or [personal] identification card |
---|
1050 | 1050 | | [certificate] to engage in telephone solicitation to encourage the |
---|
1051 | 1051 | | purchase or rental of, or investment in, goods, other property, or |
---|
1052 | 1052 | | services. |
---|
1053 | 1053 | | (g) If authorized by the executive or administrative head of |
---|
1054 | 1054 | | a maritime facility as defined in the Maritime Transportation |
---|
1055 | 1055 | | Security Act of 2002 (46 U.S.C. Section 70101 et seq.), or of a |
---|
1056 | 1056 | | port, port authority, or navigation district created or operating |
---|
1057 | 1057 | | under Section 52, Article III, or Section 59, Article XVI, Texas |
---|
1058 | 1058 | | Constitution, a person may access, use, compile, or maintain in a |
---|
1059 | 1059 | | database electronically readable information derived from a |
---|
1060 | 1060 | | driver's license, commercial driver's license, or [personal] |
---|
1061 | 1061 | | identification card [certificate] to secure the facility or port. |
---|
1062 | 1062 | | The information may be used only to: |
---|
1063 | 1063 | | (1) identify an individual; |
---|
1064 | 1064 | | (2) provide official credentials for an individual; |
---|
1065 | 1065 | | (3) track or limit the movement of an individual on |
---|
1066 | 1066 | | facility property; |
---|
1067 | 1067 | | (4) establish a secure database of visitors to the |
---|

1197 | 1197 | | under Chapter 49, Health and Safety Code, and, subject to Section |

1223 | 1223 | | (b) For purposes of this section, a document is deceptively |

1224 | 1224 | | similar to a driver's license or [personal] identification card |
---|
1225 | 1225 | | [certificate] if a reasonable person would assume that it was |
---|
1226 | 1226 | | issued by the department, another agency of this state, another |
---|
1227 | 1227 | | state, or the United States. |
---|
1228 | 1228 | | (c) A peace officer listed in Article 2.12, Code of Criminal |
---|
1229 | 1229 | | Procedure, may confiscate a document that: |
---|
1230 | 1230 | | (1) is deceptively similar to a driver's license or |
---|
1231 | 1231 | | [personal] identification card [certificate]; and |
---|
1232 | 1232 | | (2) does not display the statement required under |
---|
1233 | 1233 | | Subsection (a). |
---|
1234 | 1234 | | (f) Subsection (a) does not apply to: |
---|
1235 | 1235 | | (1) a government agency, office, or political |
---|
1236 | 1236 | | subdivision that is authorized to produce or sell [personal] |
---|
1237 | 1237 | | identification card [certificates]; or |
---|
1238 | 1238 | | (2) a person that provides a document similar to an [a |
---|
1239 | 1239 | | personal] identification card [certificate] to an employee of the |
---|
1240 | 1240 | | person for a business purpose. |
---|
1241 | 1241 | | (g) In this section: |
---|
1242 | 1242 | | (1) "Driver's license" includes a driver's license |
---|
1243 | 1243 | | issued by another state or by the United States. |
---|
1244 | 1244 | | (2) "Identification card [Personal identification |
---|
1245 | 1245 | | certificate]" means an [a personal] identification card |
---|
1246 | 1246 | | [certificate] issued by the department, by another agency of this |
---|
1247 | 1247 | | state, by another state, or by the United States. |
---|
1248 | 1248 | | SECTION 2.27. Section 521.454(a), Transportation Code, is |

1426 | 1426 | | SECTION 4.02. To the extent of any conflict, this Act |

1427 | 1427 | | prevails over another Act of the 81st Legislature, Regular Session, |

1428 | 1428 | | 2009, relating to nonsubstantive additions to and corrections in |

1429 | 1429 | | enacted codes. |

1430 | 1430 | | SECTION 4.03. This Act takes effect September 1, 2009. |
