| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Chapter 615, Local Government Code, is amended |
|---|
| 9 | 9 | | by adding a new subchapter E to read as follows: |
|---|
| 10 | 10 | | SUBCHAPTER E. COUNTY |
|---|
| 11 | 11 | | TRANSPORTATION ACCESS PLANS |
|---|
| 12 | 12 | | SECTION 615.201 APPLICABILITY. This subchapter applies to |
|---|
| 13 | 13 | | the approval, issuance, or renewal of a license, permit, or |
|---|
| 14 | 14 | | registration under the provisions of Chapter 27 of the Water Code |
|---|
| 15 | 15 | | for any location within the unincorporated area of a county. |
|---|
| 16 | 16 | | SECTION 615.202 ACCESS PLAN REQUIRED. Before the approval, |
|---|
| 17 | 17 | | issuance, or renewal of a license, permit, or registration subject |
|---|
| 18 | 18 | | to this subchapter, an access plan approved by the county shall be |
|---|
| 19 | 19 | | filed with the reviewing agency. |
|---|
| 20 | 20 | | SECTION 615.203 ADDITIONAL COSTS RECOVERY. The access plan |
|---|
| 21 | 21 | | shall provide for recovery by the county for any additional costs to |
|---|
| 22 | 22 | | the county for construction or maintenance of county roads for |
|---|
| 23 | 23 | | access to the licensed, permitted or registered site. The |
|---|
| 24 | 24 | | additional costs, if any, shall be determined by an analysis |
|---|
| 25 | 25 | | completed by an independent licensed professional engineer. |
|---|
| 26 | 26 | | SECTION 615.204 WAIVER. By order of the commissioners court, |
|---|
| 27 | 27 | | a county may waive the requirements of this subchapter. |
|---|
| 28 | 28 | | SECTION 2. This Act takes effect September 1, 2009. |
