7 | 7 | | relating to the use of state institutions of higher education to |

8 | 8 | | provide training to state agency employees. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 656.043, Government Code, is amended to |
---|
11 | 11 | | read as follows: |
---|
12 | 12 | | Sec. 656.043. DEFINITIONS [DEFINITION]. In this |
---|
13 | 13 | | subchapter: |
---|
14 | 14 | | (1) "Institution of higher education" has the meaning |
---|
15 | 15 | | assigned by Section 61.003, Education Code. |
---|
16 | 16 | | (2) "State[, "state] agency" means a department, |
---|
17 | 17 | | agency, or institution of this state, including an institution of |
---|
18 | 18 | | higher education as defined by Section 61.003, Education Code. |
---|
19 | 19 | | SECTION 2. Section 656.049, Government Code, is amended to |
---|
20 | 20 | | read as follows: |
---|
21 | 21 | | Sec. 656.049. AUTHORITY TO CONTRACT. (a) A state agency |
---|
22 | 22 | | may contract with another state, local, or federal department, |
---|
23 | 23 | | agency, or institution, including a state-supported college or |
---|
24 | 24 | | university, to train or educate its administrators and employees or |
---|
25 | 25 | | may join in presenting a training or educational program. |
---|
26 | 26 | | (b) A state agency may not contract with a private person to |
---|
27 | 27 | | train or educate a state agency administrator or employee if the |
---|
28 | 28 | | agency is required under Section 656.050 to use an institution of |
---|
29 | 29 | | higher education to provide the training or education. |
---|
30 | 30 | | SECTION 3. Subchapter C, Chapter 656, Government Code, is |
---|
31 | 31 | | amended by adding Section 656.050 to read as follows: |
---|
32 | 32 | | Sec. 656.050. TRAINING PROVIDED BY INSTITUTIONS OF HIGHER |
---|
33 | 33 | | EDUCATION. (a) A state agency shall use an institution of higher |
---|
34 | 34 | | education to provide training or education to its administrators |
---|
35 | 35 | | and employees if the institution can provide the training or |
---|
36 | 36 | | education: |
---|
37 | 37 | | (1) at a comparable level of quality but at a lower |
---|
38 | 38 | | cost to the agency; |
---|
39 | 39 | | (2) on the subject matter required by the state |
---|
40 | 40 | | agency; |
---|
41 | 41 | | (3) in the geographic area in which the state agency |
---|
42 | 42 | | administrator or employee is located; |
---|
43 | 43 | | (4) not later than the date the agency requires the |
---|
44 | 44 | | training or education to be completed; and |
---|
45 | 45 | | (5) according to a schedule acceptable to the agency. |
---|
46 | 46 | | (b) A state agency may use an institution of higher |
---|
47 | 47 | | education to supplement or enhance the training or education |
---|
48 | 48 | | provided by full-time state agency employees to the agency's other |
---|
49 | 49 | | employees. |
---|
50 | 50 | | SECTION 4. Section 656.049, Government Code, as amended by |
---|
51 | 51 | | this Act, applies only to a contract entered into on or after the |
---|
52 | 52 | | effective date of this Act. A contract entered into before the |
---|
53 | 53 | | effective date of this Act is covered by the law in effect when the |
---|
54 | 54 | | contract was entered into, and the former law is continued in effect |
---|
55 | 55 | | for that purpose. |
---|
56 | 56 | | SECTION 5. This Act takes effect September 1, 2009. |
