| 8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 9 | 9 | SECTION 1. Chapter 39, Utilities Code, is amended by adding | |
| 10 | 10 | Section 39.1516 to read as follows: | |
| 11 | 11 | SECTION 39.1516. In order to promote transparency in the | |
| 12 | 12 | electricity market in ERCOT, the independent organization | |
| 13 | 13 | governing the ERCOT power region shall disclose all offers in the | |
| 14 | 14 | balancing energy market within forty-eight hours after the making | |
| 15 | 15 | of such offers. The disclosure shall be made on the organization's | |
| 16 | 16 | web site and shall include the identity of the generation entity | |
| 17 | 17 | making the offer, the amount of the offer and the time periods for | |
| 18 | 18 | which the offer was made. This section shall become effective on | |
| 19 | 19 | September 1, 2009. The commission shall adopt rules as necessary to | |
| 20 | 20 | implement this section. |
