77 relating to the requirement that governmental public notices be
88 published in Spanish-language newspapers.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subtitle A, Title 5, Government Code, is amended
1111 by adding Chapter 561 to read as follows:
1212 CHAPTER 561. PUBLICATION OF PUBLIC NOTICES IN SPANISH-LANGUAGE
1313 NEWSPAPER
1414 Sec. 561.001. DEFINITIONS. In this chapter:
1515 (1) "Public notice" means any notice that must be
1616 published in a newspaper under Chapter 4, Election Code, or other
1717 law by:
1818 (A) a state agency or a state officer or
1919 employee; or
2020 (B) a political subdivision of this state or an
2121 officer or employee of a political subdivision.
2222 (2) "Spanish-language newspaper" means a newspaper
2323 that is printed in Spanish.
2424 Sec. 561.002. PUBLICATION IN SPANISH-LANGUAGE NEWSPAPER BY
2525 STATE AGENCY OR OFFICER. A state agency or a state officer or
2626 employee with responsibility for publishing a public notice shall
2727 publish the notice in Spanish in a Spanish-language newspaper of
2828 general circulation in each county in which:
2929 (1) the agency, officer, or employee is required to
3030 publish the public notice;
3131 (2) more than 50 percent of the population is of
3232 Hispanic origin; and
3333 (3) there is a Spanish-language newspaper of general
3434 circulation.
3535 Sec. 561.003. PUBLICATION IN SPANISH-LANGUAGE NEWSPAPER BY
3636 POLITICAL SUBDIVISION. (a) This section applies only to:
3737 (1) a political subdivision, other than a county, any
3838 portion of which is located in a county in which more than 50
3939 percent of the population is of Hispanic origin; or
4040 (2) a county in which more than 50 percent of the
4141 population is of Hispanic origin.
4242 (b) A political subdivision or an officer or employee of a
4343 political subdivision with responsibility for publishing a public
4444 notice shall publish the notice in Spanish in a Spanish-language
4545 newspaper of general circulation in each county in which:
4646 (1) the political subdivision is located; and
4747 (2) there is a Spanish-language newspaper of general
4848 circulation.
4949 Sec. 561.004. NOTICE IN ADDITION TO NOTICE REQUIRED UNDER
5050 OTHER LAW. Notice published under this chapter is in addition to
5151 notice required by other law.
5252 SECTION 2. This Act takes effect September 1, 2009.
