66 AN ACT
77 relating to energy efficiency in newly constructed buildings.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 388.003, Health and Safety Code, is
1010 amended by amending Subsections (a) and (b) and adding Subsection
1111 (b-4) to read as follows:
1212 (a) To achieve energy conservation in single-family
1313 residential construction, the energy efficiency chapter of the
1414 International Residential Code, as it existed on January 1, 2009
1515 [May 1, 2001], is adopted as the energy code in this state for
1616 single-family residential construction.
1717 (b) To achieve energy conservation in all other
1818 residential, commercial, and industrial construction, the
1919 International Energy Conservation Code as it existed on January 1,
2020 2009 [May 1, 2001], is adopted as the energy code for use in this
2121 state for all other residential, commercial, and industrial
2222 construction.
2323 (b-4) The State Energy Conservation Office shall:
2424 (1) not later than the 180th day before the date a new
2525 edition of the International Residential Code or International
2626 Energy Conservation Code is scheduled to be published, and in
2727 cooperation with the laboratory, the Public Utility Commission of
2828 Texas, and interested persons under Subsection (b-2), identify a
2929 list of energy code improvements anticipated to be contained in the
3030 new edition and develop market transformation programs to train
3131 builders, architects, and tradesmen to meet the anticipated code
3232 improvements; and
3333 (2) identify additional energy efficiency measures,
3434 technologies, and practices that have the potential to
3535 significantly reduce energy use in buildings.
3636 SECTION 2. Section 388.003(b-1), Health and Safety Code, as
3737 added by Chapters 262 (S.B. 12) and 939 (H.B. 3693), Acts of the
3838 80th Legislature, Regular Session, 2007, is reenacted and amended
3939 to read as follows:
4040 (b-1) If the State Energy Conservation Office determines,
4141 based on written recommendations from the laboratory, that the
4242 latest published edition of the International Residential Code
4343 energy efficiency provisions or the latest published edition of the
4444 International Energy Conservation Code will result in residential
4545 or commercial energy efficiency and air quality that is equivalent
4646 to or better than the energy efficiency and air quality achievable
4747 under the editions adopted under Subsection (a) or (b), the office
4848 shall [may] by rule adopt the equivalent or more stringent editions
4949 and substitute them for the energy codes described by Subsection
5050 (a) or (b). The rule, if adopted, shall establish an effective
5151 date for the new energy codes but not earlier than nine months after
5252 the date of adoption. The laboratory shall make its
5353 recommendations not later than six months after publication of new
5454 editions at the end of each three-year code development cycle of the
5555 International Residential Code and the International Energy
5656 Conservation Code.
5757 SECTION 3. Section 39.905, Utilities Code, is amended by
5858 adding Subsection (d-1) to read as follows:
5959 (d-1) In addition to the market-transformation programs
6060 described by Subsection (d), the commission shall establish, and
6161 each utility shall implement, market-transformation incentive
6262 programs that:
6363 (1) encourage the use of new building technologies and
6464 construction practices that are anticipated to be included in a new
6565 edition of the International Residential Code or International
6666 Energy Conservation Code;
6767 (2) offer incentives for a building that exceeds by at
6868 least 15 percent the energy conservation standards of the most
6969 current edition of the International Residential Code or
7070 International Energy Conservation Code;
7171 (3) offer increased incentives for a building that
7272 exceeds by at least 30 percent the energy conservation standards of
7373 the most current edition of the International Residential Code or
7474 International Energy Conservation Code; and
7575 (4) encourage the testing of new building technologies
7676 and construction practices that:
7777 (A) have significant potential to reduce
7878 building energy use by 50 percent or more within 10 years of the
7979 date the incentive is given; and
8080 (B) integrate renewable energy into building
8181 designs.
8282 SECTION 4. This Act takes effect September 1, 2009.
