 A BILL TO BE ENTITLED
 AN ACT
 relating to the appointment of the director of the governor's
 office of homeland security.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1. Subchapter A, Chapter 421, Government Code, is
 amended by adding Section 421.006 to read as follows:
 Sec. 421.006.  DIRECTOR OF THE GOVERNOR'S OFFICE OF HOMELAND
 SECURITY.  (a)  The governor, with the advice and consent of the
 senate, shall appoint a director of the governor's office of
 homeland security.
 (b)  The director of the governor's office of homeland
 security serves a two-year term expiring February 1 of each
 odd-numbered year.  The director may be reappointed by the governor
 with the advice and consent of the senate.
 SECTION 2. As soon as practicable on or after the effective
 date of this Act, the governor shall appoint a director of the
 governor's office of homeland security to a term expiring February
 1, 2011.
 SECTION 3. This Act takes effect immediately if it receives
 a vote of two-thirds of all the members elected to each house, as
 provided by Section 39, Article III, Texas Constitution. If this
 Act does not receive the vote necessary for immediate effect, this
 Act takes effect September 1, 2009.
