99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 301, Property Code, is amended by adding
1111 Subchapter J to read as follows:
1212 SUBCHAPTER J. STATE AND MUNICIPAL ACTIONS FOR
1313 FAIR HOUSING
1414 Sec. 301.201. ADMINISTRATION OF STATE PROGRAMS AND
1515 ACTIVITIES RELATING TO HOUSING AND URBAN DEVELOPMENT. Each state
1616 agency shall administer its programs and activities relating to
1717 housing and urban development in a manner that affirmatively
1818 furthers the goals of fair housing under this chapter.
1919 Sec. 301.202. GOVERNOR'S FAIR HOUSING ADVISORY COUNCIL. (a)
2020 In this section, "council" means the governor's fair housing
2121 advisory council.
2222 (b) The governor's fair housing advisory council is
2323 established. The council is composed of the heads of each of the
2424 following state agencies:
2525 (1) the Office of Rural Community Affairs;
2626 (2) the Health and Human Services Commission;
2727 (3) the Texas Department of Transportation;
2828 (4) the Texas Education Agency;
2929 (5) the Texas Department of Housing and Community
3030 Affairs; and
3131 (6) any other state agencies designated by the
3232 governor.
3333 (c) The executive director of the Texas Department of
3434 Housing and Community Affairs serves as the presiding officer of
3535 the council.
3636 (d) The council shall review the design and delivery of
3737 state programs and activities relating to housing and urban
3838 development to ensure that the programs and activities support a
3939 coordinated strategy to affirmatively further the goals of fair
4040 housing under this chapter. As necessary to achieve the goals of
4141 this chapter, the council shall:
4242 (1) propose revisions to existing programs or
4343 activities;
4444 (2) develop pilot programs and activities; and
4545 (3) propose new programs and activities.
4646 (e) In support of the council's goal of cooperative efforts
4747 among all state agencies, the executive director of the Texas
4848 Department of Housing and Community Affairs shall:
4949 (1) cooperate with, and render assistance to, the
5050 heads of all state agencies in the formulation of policies and
5151 procedures to:
5252 (A) affirmatively further fair housing goals;
5353 and
5454 (B) provide information and guidance on the
5555 affirmative administration of programs and activities relating to
5656 housing and urban development and the protection of the rights
5757 accorded by this chapter; and
5858 (2) develop with other state agencies memoranda of
5959 understanding and any necessary implementing procedures designed
6060 to provide for consultation and the coordination of state efforts
6161 to further fair housing goals through the affirmative
6262 administration of programs and activities relating to housing and
6363 urban development.
6464 (f) In implementing responsibilities under this subchapter,
6565 the Texas Department of Housing and Community Affairs shall adopt
6666 rules that describe:
6767 (1) the functions, organization, and operations of the
6868 council;
6969 (2) the responsibilities and obligations of state
7070 agencies in ensuring that programs and activities are administered
7171 and executed in a manner that furthers fair housing;
7272 (3) programs and activities that affirmatively
7373 further the goals of fair housing; and
7474 (4) a method to identify impediments in programs or
7575 activities that restrict fair housing choice and implement
7676 incentives that will maximize the success of practices that
7777 affirmatively further fair housing goals.
7878 Sec. 301.203. MUNICIPALITIES. Each municipality shall
7979 administer municipal programs and activities relating to housing
8080 and urban development in a manner that affirmatively furthers the
8181 goals of fair housing under this chapter.
8282 Sec. 301.204. ANNUAL REPORT. (a) The Texas Department of
8383 Housing and Community Affairs shall prepare an annual report
8484 describing the progress of the department and other state agencies
8585 in carrying out requirements and responsibilities under this
8686 subchapter.
8787 (b) The department shall submit the report required under
8888 Subsection (a) not later than December 1 of each year to the
8989 governor, the lieutenant governor, the speaker of the house of
9090 representatives, and the appropriate committees of the senate and
9191 the house of representatives.
9292 SECTION 2. This Act takes effect immediately if it receives
9393 a vote of two-thirds of all the members elected to each house, as
9494 provided by Section 39, Article III, Texas Constitution. If this
9595 Act does not receive the vote necessary for immediate effect, this
9696 Act takes effect September 1, 2009.
