A BILL TO BE ENTITLED
AN ACT
relating to certain contracts by certain governmental entities.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Sec. 403.0305, Government Code is amended to
read as follows:
Sec. 403.0305. LEGAL FEES[APPROVAL BY COMPTROLLER]. A
public agency as defined under Section 30.003(3), Water Code, is
free to contract for legal fees on any basis allowed pursuant to
Rule 1.04, State Bar Rules of Professional Conduct[may not enter
into a contract as provided by Subchapter C, Chapter 2254, without
review and approval by the comptroller].
SECTION 2. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2009.
