66 AN ACT
77 relating to waste recycling plans of entities that receive money
88 from this state.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 403, Government Code, is
1111 amended by adding Section 403.0307 to read as follows:
1212 Sec. 403.0307. RECYCLING POLICY REQUIRED. (a) The
1313 comptroller by rule shall require each of the following entities to
1414 develop a program for recycling solid waste the entity produces and
1515 to report to the comptroller the contents of the policy as a
1616 condition for the entity receiving money from this state:
1717 (1) state agencies;
1818 (2) political subdivisions of this state; and
1919 (3) vendors and other contractors of a state agency.
2020 (b) A rule adopted under Subsection (a) may impose goals,
2121 standards, or guidelines a recycling policy must meet for an entity
2222 to qualify to receive money from this state. The rule may provide
2323 for goals, standards, or guidelines to differ according to the type
2424 of waste the entity produces that may be recycled, according to the
2525 type of entity, including a political subdivision's population or a
2626 vendor's or contractor's size, and according to other factors the
2727 comptroller determines relevant.
2828 SECTION 2. The comptroller of public accounts shall adopt
2929 rules as necessary to implement Section 403.0307, Government Code,
3030 as added by this Act, as soon as is practicable.
3131 SECTION 3. This Act takes effect September 1, 2009.
