| 7 | 7 | | relating to waste recycling plans of entities that receive money |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter B, Chapter 403, Government Code, is |
|---|
| 11 | 11 | | amended by adding Section 403.0307 to read as follows: |
|---|
| 12 | 12 | | Sec. 403.0307. RECYCLING POLICY REQUIRED. (a) The |
|---|
| 13 | 13 | | comptroller by rule shall require each of the following entities to |
|---|
| 14 | 14 | | develop a program for recycling solid waste the entity produces and |
|---|
| 15 | 15 | | to report to the comptroller the contents of the policy as a |
|---|
| 16 | 16 | | condition for the entity receiving money from this state: |
|---|
| 17 | 17 | | (1) state agencies; |
|---|
| 18 | 18 | | (2) political subdivisions of this state; and |
|---|
| 19 | 19 | | (3) vendors and other contractors of a state agency. |
|---|
| 20 | 20 | | (b) A rule adopted under Subsection (a) may impose goals, |
|---|
| 21 | 21 | | standards, or guidelines a recycling policy must meet for an entity |
|---|
| 22 | 22 | | to qualify to receive money from this state. The rule may provide |
|---|
| 23 | 23 | | for goals, standards, or guidelines to differ according to the type |
|---|
| 24 | 24 | | of waste the entity produces that may be recycled, according to the |
|---|
| 25 | 25 | | type of entity, including a political subdivision's population or a |
|---|
| 26 | 26 | | vendor's or contractor's size, and according to other factors the |
|---|
| 27 | 27 | | comptroller determines relevant. |
|---|
| 28 | 28 | | SECTION 2. The comptroller of public accounts shall adopt |
|---|
| 29 | 29 | | rules as necessary to implement Section 403.0307, Government Code, |
|---|
| 30 | 30 | | as added by this Act, as soon as is practicable. |
|---|
| 31 | 31 | | SECTION 3. This Act takes effect September 1, 2009. |
