55 AN ACT
66 relating to the determination of the total taxable value of
77 property in a school district under the property value study
88 conducted by the comptroller of public accounts.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subsection (b), Section 403.302, Government
1111 Code, is amended to read as follows:
1212 (b) In conducting the study, the comptroller shall
1313 determine the taxable value of property in each school district:
1414 (1) using, if appropriate, samples selected through
1515 generally accepted sampling techniques;
1616 (2) according to generally accepted standard
1717 valuation, statistical compilation, and analysis techniques;
1818 (3) ensuring that different levels of appraisal on
1919 sold and unsold property do not adversely affect the accuracy of the
2020 study; and
2121 (4) ensuring that different levels of appraisal
2222 resulting from protests determined under Section 41.43, Tax Code,
2323 are appropriately adjusted in the study:
2424 (A) by excluding from the samples used in the
2525 study such properties that are determined to significantly vary
2626 such that they adversely affect the accuracy and validity of the
2727 study; or
2828 (B) by using initial value prior to determination
2929 by 41.43, Tax Code, for such properties, in the sample and in the
3030 study.
3131 SECTION 2. The change in law made by this Act applies only
3232 to the annual study conducted by Section 403.302, Government Code,
3333 to determine taxable value for a tax year that begins on or after
3434 January 1, 2009. The annual study to determine taxable value for a
3535 tax year that begins before that date is covered by the law in
3636 effect immediately before the effective date of this Act, and the
3737 prior law is continued in effect for that purpose.
3838 SECTION 3. This Act takes effect immediately if it receives
3939 a vote of two-thirds of all the members elected to each house, as
4040 provided by Section 39, Article III, Texas Constitution. If this
4141 Act does not receive the vote necessary for immediate effect, this
4242 Act takes effect September 1, 2009.
