44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the establishment of a collaborative language
77 acquisition pilot program.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter B, Chapter 29, Education Code, is
1010 amended by adding Section 29.070 to read as follows:
1111 Sec. 29.070. ESTABLISHMENT OF COLLABORATIVE LANGUAGE
1212 ACQUISITION PILOT PROGRAM. (a) From available funds that may be
1313 used for that purpose, the commissioner shall grant $1 million to
1414 the Texas Center for Education Policy of the University of Texas at
1515 Austin for the planning, implementation, and evaluation of an
1616 after-school language acquisition pilot program for students of
1717 limited English proficiency.
1818 (b) The Texas Center for Education Policy shall partner with
1919 at least one independent school district and a municipal or
2020 community entity in the planning, implementation, and evaluation of
2121 the pilot program.
2222 (c) Subject to Subsection (d), the Texas Center for
2323 Education Policy may use funds allocated for this program to
2424 collaborate and contract with entities in public or private
2525 institutions of higher education to promote the expansion of the
2626 pilot program across the state.
2727 (d) A pilot program established under this section shall:
2828 (1) adhere, to the extent practicable, to the La Clase
2929 Mgica program model, also known as The Magic Classroom, including
3030 any fundamental, programmatic, and data collection requirements of
3131 that model;
3232 (2) prepare students to perform satisfactorily on
3333 assessment instruments administered under Section 39.023 by
3434 implementing an after-school curriculum that develops a principled
3535 understanding of reading, science, and mathematics content;
3636 (3) build literacy skills in English and the student's
3737 native language;
3838 (4) promote digital literacy skills;
3939 (5) promote financial literacy skills;
4040 (6) promote college aspirations by:
4141 (A) increasing knowledge about and encouraging
4242 positive attitudes toward higher education; and
4343 (B) providing consistent peer interactions with
4444 university mentors;
4545 (7) expand the student's ability to communicate in any
4646 educational or professional setting;
4747 (8) communicate information under this section to the
4848 school, students, students' parents, and the community; and
4949 (9) inform students' parents regarding school district
5050 standards and requirements and state requirements regarding
5151 assessment instruments administered under Section 39.023.
5252 (e) The Texas Center for Education Policy must match funds
5353 provided in this section with other private, federal, state, or
5454 local funds, including:
5555 (1) gifts, grants, or donations of funds;
5656 (2) contributions of property that may be used in
5757 providing the program;
5858 (3) in-kind financial support to implement the program
5959 from collaborating or contracted public entities or private
6060 institutions of higher education;
6161 (4) in-kind financial support to implement the program
6262 from municipalities, school districts, or community entities
6363 partnering in the planning, implementation, and evaluation of the
6464 program;
6565 (5) university faculty and staff time allocated
6666 towards the planning, implementation, and evaluation of the
6767 program.
6868 (f) Not later than January 1, 2011, the Texas Center for
6969 Education Policy shall prepare and deliver to the governor, the
7070 lieutenant governor, the speaker of the house of representatives,
7171 and the presiding officers of the standing committees of each house
7272 of the legislature with primary jurisdiction over public education
7373 a report addressing the success of the pilot program under this
7474 section. This subsection expires September 1, 2011.
7575 SECTION 2. This Act applies beginning with the 2009-2010
7676 school year.
7777 SECTION 3. This Act takes effect immediately if it receives
7878 a vote of two-thirds of all the members elected to each house, as
7979 provided by Section 39, Article III, Texas Constitution. If this
8080 Act does not receive the vote necessary for immediate effect, this
8181 Act takes effect September 1, 2009.
