55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the right to an expunction of records and files relating
88 to a person's arrest.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Article 55.01(a), Code of Criminal Procedure, is
1111 amended to read as follows:
1212 (a) A person who has been placed under a custodial or
1313 noncustodial arrest for commission of either a felony or
1414 misdemeanor is entitled to have all records and files relating to
1515 the arrest expunged if:
1616 (1) the person is tried for the offense for which the
1717 person was arrested and is:
1818 (A) acquitted by the trial court, except as
1919 provided by Subsection (c) [of this section]; or
2020 (B) convicted and subsequently pardoned; [or]
2121 (2) prosecution of the person for the offense for
2222 which the person was arrested is no longer possible because:
2323 (A) the limitations period has expired; or
2424 (B) double jeopardy has attached; or
2525 (3) each of the following conditions exist:
2626 (A) an indictment or information charging the
2727 person with commission of a felony or misdemeanor has not been
2828 presented against the person for an offense arising out of the
2929 transaction for which the person was arrested or, if an indictment
3030 or information charging the person with commission of a felony or
3131 misdemeanor was presented, the indictment or information has been
3232 dismissed or quashed[, and:
3333 [(i) the limitations period expired before
3434 the date on which a petition for expunction was filed under Article
3535 55.02; or
3636 [(ii) the court finds that the indictment
3737 or information was dismissed or quashed because the presentment had
3838 been made because of mistake, false information, or other similar
3939 reason indicating absence of probable cause at the time of the
4040 dismissal to believe the person committed the offense or because it
4141 was void]; and
4242 (B) the person has been released and the charge,
4343 if any, has not resulted in a final conviction and is no longer
4444 pending and there was no court ordered community supervision under
4545 Article 42.12 for any offense except for [other than] a Class C
4646 misdemeanor[; and
4747 [(C) the person has not been convicted of a
4848 felony in the five years preceding the date of the arrest].
4949 SECTION 2. Article 55.01(a-1), Code of Criminal Procedure,
5050 is repealed.
5151 SECTION 3. The change in law made by this Act applies to a
5252 person seeking expunction of records relating to an arrest
5353 regardless of whether the arrest occurred before, on, or after the
5454 effective date of this Act.
5555 SECTION 4. This Act takes effect immediately if it receives
5656 a vote of two-thirds of all the members elected to each house, as
5757 provided by Section 39, Article III, Texas Constitution. If this
5858 Act does not receive the vote necessary for immediate effect, this
5959 Act takes effect September 1, 2009.
