66 AN ACT
77 relating to the powers and duties of the Hopkins County Hospital
88 District.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 1043.052, Special District Local Laws
1111 Code, as effective April 1, 2009, is amended to read as follows:
1212 Sec. 1043.052. NOTICE OF ELECTION. Notice [At least 10
1313 days before the date] of an election of directors [, notice of the
1414 election] shall be published [one time] in a newspaper of general
1515 circulation in the district in accordance with Section 4.003,
1616 Election Code [Hopkins County].
1717 SECTION 2. Sections 1043.059(d) and (e), Special District
1818 Local Laws Code, as effective April 1, 2009, are amended to read as
1919 follows:
2020 (d) Subject to Subsection (e), the board may provide
2121 financial inducements [, including income subsidies or guarantees
2222 and reimbursement of relocation expenses,] to a full-time medical
2323 intern or [resident] physician [serving in a hospital] who
2424 contractually agrees to:
2525 (1) reside and practice in Hopkins County; and
2626 (2) provide care and treatment to its needy residents.
2727 (e) The board may employ physicians, dentists, or other
2828 health care providers as the board considers necessary for the
2929 efficient operation of the district. This subsection may not be
3030 construed as authorizing the board to supervise or control the
3131 practice of medicine, as prohibited by Subtitle B, Title 3,
3232 Occupations Code [offer financial inducements only to attract
3333 qualified physicians who possess medical expertise that is not
3434 available in the county].
3535 SECTION 3. Section 1043.108, Special District Local Laws
3636 Code, as effective April 1, 2009, is amended to read as follows:
3737 Sec. 1043.108. PROPERTY, FACILITIES, AND EQUIPMENT FOR
3838 HEALTH CARE PROVIDERS [STAFF PHYSICIANS]. (a) The board shall
3939 determine the type, number, and location of buildings required to
4040 establish and maintain office facilities for health care providers
4141 [staff physicians] as necessary to provide adequate health
4242 [medical] care services.
4343 (b) The board may:
4444 (1) acquire property, including equipment, and
4545 construct facilities for the district for use by health care
4646 providers [staff physicians]; and
4747 (2) mortgage or pledge the property or facilities as
4848 security for the payment of the purchase or construction price.
4949 (c) The board for the district may:
5050 (1) lease the office facilities and equipment to
5151 health care providers [staff physicians]; and
5252 (2) sell or otherwise dispose of the property,
5353 including facilities and equipment.
5454 SECTION 4. Section 1043.152(c), Special District Local Laws
5555 Code, as effective April 1, 2009, is amended to read as follows:
5656 (c) Any district resident [taxpayer] is entitled to:
5757 (1) appear at the time and place designated in the
5858 notice; and
5959 (2) be heard regarding any item included in the
6060 proposed budget.
6161 SECTION 5. Section 1043.154(b), Special District Local Laws
6262 Code, as effective April 1, 2009, is amended to read as follows:
6363 (b) Not later than December 31 each year, the audit shall be
6464 filed[:
6565 [(1) with the comptroller; and
6666 [(2)] at the district office.
6767 SECTION 6. This Act takes effect immediately if it receives
6868 a vote of two-thirds of all the members elected to each house, as
6969 provided by Section 39, Article III, Texas Constitution. If this
7070 Act does not receive the vote necessary for immediate effect, this
7171 Act takes effect September 1, 2009.
