6	6	AN ACT
7	7	relating to the powers and duties of the Hopkins County Hospital
8	8	District.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Section 1043.052, Special District Local Laws
11	11	Code, as effective April 1, 2009, is amended to read as follows:
12	12	Sec. 1043.052. NOTICE OF ELECTION. Notice [At least 10
13	13	days before the date] of an election of directors [, notice of the
14	14	election] shall be published [one time] in a newspaper of general
15	15	circulation in the district in accordance with Section 4.003,
16	16	Election Code [Hopkins County].
17	17	SECTION 2. Sections 1043.059(d) and (e), Special District
18	18	Local Laws Code, as effective April 1, 2009, are amended to read as
19	19	follows:
20	20	(d) Subject to Subsection (e), the board may provide
21	21	financial inducements [, including income subsidies or guarantees
22	22	and reimbursement of relocation expenses,] to a full-time medical
23	23	intern or [resident] physician [serving in a hospital] who
24	24	contractually agrees to:
25	25	(1) reside and practice in Hopkins County; and
26	26	(2) provide care and treatment to its needy residents.
27	27	(e) The board may employ physicians, dentists, or other
28	28	health care providers as the board considers necessary for the
29	29	efficient operation of the district. This subsection may not be
30	30	construed as authorizing the board to supervise or control the
31	31	practice of medicine, as prohibited by Subtitle B, Title 3,
32	32	Occupations Code [offer financial inducements only to attract
33	33	qualified physicians who possess medical expertise that is not
34	34	available in the county].
35	35	SECTION 3. Section 1043.108, Special District Local Laws
36	36	Code, as effective April 1, 2009, is amended to read as follows:
37	37	Sec. 1043.108. PROPERTY, FACILITIES, AND EQUIPMENT FOR
38	38	HEALTH CARE PROVIDERS [STAFF PHYSICIANS]. (a) The board shall
39	39	determine the type, number, and location of buildings required to
40	40	establish and maintain office facilities for health care providers
41	41	[staff physicians] as necessary to provide adequate health
42	42	[medical] care services.
43	43	(b) The board may:
44	44	(1) acquire property, including equipment, and
45	45	construct facilities for the district for use by health care
46	46	providers [staff physicians]; and
47	47	(2) mortgage or pledge the property or facilities as
48	48	security for the payment of the purchase or construction price.
49	49	(c) The board for the district may:
50	50	(1) lease the office facilities and equipment to
51	51	health care providers [staff physicians]; and
52	52	(2) sell or otherwise dispose of the property,
53	53	including facilities and equipment.
54	54	SECTION 4. Section 1043.152(c), Special District Local Laws
55	55	Code, as effective April 1, 2009, is amended to read as follows:
56	56	(c) Any district resident [taxpayer] is entitled to:
57	57	(1) appear at the time and place designated in the
58	58	notice; and
59	59	(2) be heard regarding any item included in the
60	60	proposed budget.
61	61	SECTION 5. Section 1043.154(b), Special District Local Laws
62	62	Code, as effective April 1, 2009, is amended to read as follows:
63	63	(b) Not later than December 31 each year, the audit shall be
64	64	filed[:
65	65	[(1) with the comptroller; and
66	66	[(2)] at the district office.
67	67	SECTION 6. This Act takes effect immediately if it receives
68	68	a vote of two-thirds of all the members elected to each house, as
69	69	provided by Section 39, Article III, Texas Constitution. If this
70	70	Act does not receive the vote necessary for immediate effect, this
71	71	Act takes effect September 1, 2009.
