55 relating to the powers and duties of the Hopkins County Hospital

77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 1043.052, Special District Local Laws
99 Code, as effective April 1, 2009, is amended to read as follows:
1010 Sec. 1043.052. NOTICE OF ELECTION. Notice [At least 10
1111 days before the date] of an election of directors [, notice of the
1212 election] shall be published [one time] in a newspaper of general
1313 circulation in the district in accordance with Section 4.003,
1414 Election Code [Hopkins County].
1515 SECTION 2. Section 1043.059(d), Special District Local Laws
1616 Code, as effective April 1, 2009, is amended to read as follows:
1717 (d) Subject to Subsection (e), the board may provide
1818 financial inducements [, including income subsidies or guarantees
1919 and reimbursement of relocation expenses,] to a full-time medical
2020 intern or [resident] physician [serving in a hospital] who
2121 contractually agrees to:
2222 (1) reside and practice in Hopkins County; and
2323 (2) provide care and treatment to its needy residents.
2424 SECTION 3. Section 1043.108, Special District Local Laws
2525 Code, as effective April 1, 2009, is amended to read as follows:
2626 Sec. 1043.108. PROPERTY, FACILITIES, AND EQUIPMENT FOR
2727 HEALTH CARE PROVIDERS [STAFF PHYSICIANS]. (a) The board shall
2828 determine the type, number, and location of buildings required to
2929 establish and maintain office facilities for health care providers
3030 [staff physicians] as necessary to provide adequate health
3131 [medical] care services.
3232 (b) The board may:
3333 (1) acquire property, including equipment, and
3434 construct facilities for the district for use by health care
3535 providers [staff physicians]; and
3636 (2) mortgage or pledge the property or facilities as
3737 security for the payment of the purchase or construction price.
3838 (c) The board for the district may:
3939 (1) lease the office facilities and equipment to
4040 health care providers [staff physicians]; and
4141 (2) sell or otherwise dispose of the property,
4242 including facilities and equipment.
4343 SECTION 4. Section 1043.152(c), Special District Local Laws
4444 Code, as effective April 1, 2009, is amended to read as follows:
4545 (c) Any district resident [taxpayer] is entitled to:
4646 (1) appear at the time and place designated in the
4747 notice; and
4848 (2) be heard regarding any item included in the
4949 proposed budget.
5050 SECTION 5. Section 1043.154(b), Special District Local Laws
5151 Code, as effective April 1, 2009, is amended to read as follows:
5252 (b) Not later than December 31 each year, the audit shall be
5353 filed[:
5454 [(1) with the comptroller; and
5555 [(2)] at the district office.
5656 SECTION 6. Section 1043.059(e), Special District Local Laws
5757 Code, as effective April 1, 2009, is repealed.
5858 SECTION 7. This Act takes effect immediately if it receives
5959 a vote of two-thirds of all the members elected to each house, as
6060 provided by Section 39, Article III, Texas Constitution. If this
6161 Act does not receive the vote necessary for immediate effect, this
6262 Act takes effect September 1, 2009.
