5	5	relating to the powers and duties of the Hopkins County Hospital
6	6	District.
7	7	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	8	SECTION 1. Section 1043.052, Special District Local Laws
9	9	Code, as effective April 1, 2009, is amended to read as follows:
10	10	Sec. 1043.052. NOTICE OF ELECTION. Notice [At least 10
11	11	days before the date] of an election of directors [, notice of the
12	12	election] shall be published [one time] in a newspaper of general
13	13	circulation in the district in accordance with Section 4.003,
14	14	Election Code [Hopkins County].
15	15	SECTION 2. Section 1043.059(d), Special District Local Laws
16	16	Code, as effective April 1, 2009, is amended to read as follows:
17	17	(d) Subject to Subsection (e), the board may provide
18	18	financial inducements [, including income subsidies or guarantees
19	19	and reimbursement of relocation expenses,] to a full-time medical
20	20	intern or [resident] physician [serving in a hospital] who
21	21	contractually agrees to:
22	22	(1) reside and practice in Hopkins County; and
23	23	(2) provide care and treatment to its needy residents.
24	24	SECTION 3. Section 1043.108, Special District Local Laws
25	25	Code, as effective April 1, 2009, is amended to read as follows:
26	26	Sec. 1043.108. PROPERTY, FACILITIES, AND EQUIPMENT FOR
27	27	HEALTH CARE PROVIDERS [STAFF PHYSICIANS]. (a) The board shall
28	28	determine the type, number, and location of buildings required to
29	29	establish and maintain office facilities for health care providers
30	30	[staff physicians] as necessary to provide adequate health
31	31	[medical] care services.
32	32	(b) The board may:
33	33	(1) acquire property, including equipment, and
34	34	construct facilities for the district for use by health care
35	35	providers [staff physicians]; and
36	36	(2) mortgage or pledge the property or facilities as
37	37	security for the payment of the purchase or construction price.
38	38	(c) The board for the district may:
39	39	(1) lease the office facilities and equipment to
40	40	health care providers [staff physicians]; and
41	41	(2) sell or otherwise dispose of the property,
42	42	including facilities and equipment.
43	43	SECTION 4. Section 1043.152(c), Special District Local Laws
44	44	Code, as effective April 1, 2009, is amended to read as follows:
45	45	(c) Any district resident [taxpayer] is entitled to:
46	46	(1) appear at the time and place designated in the
47	47	notice; and
48	48	(2) be heard regarding any item included in the
49	49	proposed budget.
50	50	SECTION 5. Section 1043.154(b), Special District Local Laws
51	51	Code, as effective April 1, 2009, is amended to read as follows:
52	52	(b) Not later than December 31 each year, the audit shall be
53	53	filed[:
54	54	[(1) with the comptroller; and
55	55	[(2)] at the district office.
56	56	SECTION 6. Section 1043.059(e), Special District Local Laws
57	57	Code, as effective April 1, 2009, is repealed.
58	58	SECTION 7. This Act takes effect immediately if it receives
59	59	a vote of two-thirds of all the members elected to each house, as
60	60	provided by Section 39, Article III, Texas Constitution. If this
61	61	Act does not receive the vote necessary for immediate effect, this
62	62	Act takes effect September 1, 2009.
