7 | 7 | | relating to eligibility for the small and mid-sized adjustment |

8 | 8 | | under the public school finance system. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 42.2516(b), Education Code, is amended |
---|
11 | 11 | | to read as follows: |
---|
12 | 12 | | (b) Subject to Subsections (b-1), (b-2), (f-1), (g), and |
---|
13 | 13 | | (h), but notwithstanding any other provision of this title, a |
---|
14 | 14 | | school district is entitled to state revenue necessary to provide |
---|
15 | 15 | | the district with the sum of: |
---|
16 | 16 | | (1) the amount of state revenue necessary to maintain |
---|
17 | 17 | | state and local revenue per student in weighted average daily |
---|
18 | 18 | | attendance in the amount equal to the greater of: |
---|
19 | 19 | | (A) the amount of state and local revenue per |
---|
20 | 20 | | student in weighted average daily attendance for the maintenance |
---|
21 | 21 | | and operations of the district available to the district for the |
---|
22 | 22 | | 2005-2006 school year; |
---|
23 | 23 | | (B) the amount of state and local revenue per |
---|
24 | 24 | | student in weighted average daily attendance for the maintenance |
---|
25 | 25 | | and operations of the district to which the district would have been |
---|
26 | 26 | | entitled for the 2006-2007 school year under this chapter, as it |
---|
27 | 27 | | existed on January 1, 2006, or, if the district would have been |
---|
28 | 28 | | subject to Chapter 41, as that chapter existed on January 1, 2006, |
---|
29 | 29 | | the amount to which the district would have been entitled under that |
---|
30 | 30 | | chapter, based on the funding elements in effect for the 2005-2006 |
---|
31 | 31 | | school year, if the district imposed a maintenance and operations |
---|
32 | 32 | | tax at the rate adopted by the district for the 2005 tax year; or |
---|
33 | 33 | | (C) the amount of state and local revenue per |
---|
34 | 34 | | student in weighted average daily attendance for the maintenance |
---|
35 | 35 | | and operations of the district to which the district would have been |
---|
36 | 36 | | entitled for the 2006-2007 school year under this chapter, as it |
---|
37 | 37 | | existed on January 1, 2006, or, if the district would have been |
---|
38 | 38 | | subject to Chapter 41, as that chapter existed on January 1, 2006, |
---|
39 | 39 | | the amount to which the district would have been entitled under that |
---|
40 | 40 | | chapter, based on the funding elements in effect for the 2005-2006 |
---|
41 | 41 | | school year, if the district imposed a maintenance and operations |
---|
42 | 42 | | tax at the rate equal to the rate described by Section 26.08(i) or |
---|
43 | 43 | | (k)(1), Tax Code, as applicable, for the 2006 tax year; |
---|
44 | 44 | | (2) an amount equal to the product of $2,500 |
---|
45 | 45 | | multiplied by the number of classroom teachers, full-time |
---|
46 | 46 | | librarians, full-time counselors certified under Subchapter B, |
---|
47 | 47 | | Chapter 21, and full-time school nurses employed by the district |
---|
48 | 48 | | and entitled to a minimum salary under Section 21.402; [and] |
---|
49 | 49 | | (3) an amount equal to the product of $275 multiplied |
---|
50 | 50 | | by the number of students in average daily attendance in grades nine |
---|
51 | 51 | | through 12 in the district; and |
---|
52 | 52 | | (4) the amount necessary to ensure that a district |
---|
53 | 53 | | that is eligible for an adjustment under Section 42.103 during the |
---|
54 | 54 | | 2009-2010 or a subsequent school year as a result of the repeal of |
---|
55 | 55 | | Section 42.103(e) by ___.B. No. ____, Acts of the 81st Legislature, |
---|
56 | 56 | | Regular Session, 2009, receives the total additional amount of |
---|
57 | 57 | | state and local funding per student in weighted average daily |
---|
58 | 58 | | attendance that would have resulted from the repeal of Section |
---|
59 | 59 | | 42.103(e) if the district were not limited to the amount of revenue |
---|
60 | 60 | | prescribed by Subdivision (1). |
---|
61 | 61 | | SECTION 2. Section 42.103(e), Education Code, is repealed. |
---|
62 | 62 | | SECTION 3. This Act takes effect September 1, 2009. |
