99 relating to reimbursement rates for nursing home services provided
1010 to Medicaid recipients.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 32.028, Human Resources Code, is amended
1313 by amending Subsection (n) and adding Subsection (q) to read as
1414 follows:
1515 (n) The executive commissioner of the Health and Human
1616 Services Commission [commission] shall ensure that rules governing
1717 the determination of rates paid for nursing home services provide
1818 for the reporting of all revenue received and costs incurred,
1919 without regard to whether a cost is an allowable cost for
2020 reimbursement under the medical assistance program, except:
2121 (1) as provided by Subsection (h); and
2222 (2) a penalty imposed under this chapter or Chapter
2323 242, Health and Safety Code.
2424 (q) The Health and Human Services Commission shall
2525 periodically conduct an analysis of the base rates paid for nursing
2626 home services provided under the medical assistance program to
2727 enable the executive commissioner of the commission to
2828 appropriately set future rates. In conducting the analysis, the
2929 commission may consider any factors the commission considers
3030 relevant, including:
3131 (1) the costs incurred by nursing homes to provide
3232 services to recipients of medical assistance;
3333 (2) general and health-care specific inflation
3434 issues;
3535 (3) rates paid in other states for comparable
3636 services; and
3737 (4) incentives offered under Subsection (g) to improve
3838 quality of care.
3939 SECTION 2. If before implementing any provision of this Act
4040 a state agency determines that a waiver or authorization from a
4141 federal agency is necessary for implementation of that provision,
4242 the agency affected by the provision shall request the waiver or
4343 authorization and may delay implementing that provision until the
4444 waiver or authorization is granted.
4545 SECTION 3. This Act takes effect September 1, 2009.
