| 7 | 7 | | relating to a requirement that a recipient of money from the Texas |

| 8 | 8 | | Enterprise Fund participate in a federal work eligibility |
|---|
| 9 | 9 | | verification program. |
|---|
| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 481.078, Government Code, is amended by |
|---|
| 12 | 12 | | adding Subsections (f-1), (g-1), and (k) to read as follows: |
|---|
| 13 | 13 | | (f-1) The governor may not enter into a grant agreement with |
|---|
| 14 | 14 | | an entity unless the entity provides documentation to the office |
|---|
| 15 | 15 | | certifying the entity's participation in the federal E-Verify |
|---|
| 16 | 16 | | program or any successor program to verify the work eligibility |
|---|
| 17 | 17 | | status of all its new employees in this state. |
|---|
| 18 | 18 | | (g-1) The grant agreement must include a provision |
|---|
| 19 | 19 | | requiring that the grant recipient: |
|---|
| 20 | 20 | | (1) use the federal E-Verify program or any successor |
|---|
| 21 | 21 | | program to verify the work eligibility status of all its new |
|---|
| 22 | 22 | | employees in this state; and |
|---|
| 23 | 23 | | (2) submit to the office an annual report containing |
|---|
| 24 | 24 | | the results of employment eligibility verifications under |
|---|
| 25 | 25 | | Subdivision (1) that were conducted during the previous calendar |
|---|
| 26 | 26 | | year. |
|---|
| 27 | 27 | | (k) In this section, "federal E-Verify program" means the |
|---|
| 28 | 28 | | electronic verification of work authorization program of Section |
|---|
| 29 | 29 | | 403(a) of the federal Illegal Immigration Reform and Immigrant |
|---|
| 30 | 30 | | Responsibility Act of 1996 (Pub. L. No. 104-208, reprinted in note, |
|---|
| 31 | 31 | | 8 U.S.C. Section 1324a), operated by the United States Department |
|---|
| 32 | 32 | | of Homeland Security and known as the Basic Pilot Program or |
|---|
| 33 | 33 | | E-Verify. |
|---|
| 34 | 34 | | SECTION 2. Section 481.078(g-1), Government Code, as added |
|---|
| 35 | 35 | | by this Act, applies only to a grant agreement entered into on or |
|---|
| 36 | 36 | | after the effective date of this Act. A grant agreement entered |
|---|
| 37 | 37 | | into before the effective date of this Act is governed by the law in |
|---|
| 38 | 38 | | effect on the date the agreement was entered into, and the former |
|---|
| 39 | 39 | | law is continued in effect for that purpose. |
|---|
| 40 | 40 | | SECTION 3. This Act takes effect September 1, 2009. |
