55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a requirement that a recipient of money from the Texas
88 Enterprise Fund participate in a federal work eligibility
99 verification program.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 481.078, Government Code, is amended by
1212 adding Subsections (f-1), (g-1), and (k) to read as follows:
1313 (f-1) The governor may not enter into a grant agreement with
1414 an entity unless the entity provides documentation to the office
1515 certifying the entity's participation in the federal E-Verify
1616 program or any successor program to verify the work eligibility
1717 status of all its new employees in this state.
1818 (g-1) The grant agreement must include a provision
1919 requiring that the grant recipient:
2020 (1) use the federal E-Verify program or any successor
2121 program to verify the work eligibility status of all its new
2222 employees in this state; and
2323 (2) submit to the office an annual report containing
2424 the results of employment eligibility verifications under
2525 Subdivision (1) that were conducted during the previous calendar
2626 year.
2727 (k) In this section, "federal E-Verify program" means the
2828 electronic verification of work authorization program of Section
2929 403(a) of the federal Illegal Immigration Reform and Immigrant
3030 Responsibility Act of 1996 (Pub. L. No. 104-208, reprinted in note,
3131 8 U.S.C. Section 1324a), operated by the United States Department
3232 of Homeland Security and known as the Basic Pilot Program or
3333 E-Verify.
3434 SECTION 2. Section 481.078(g-1), Government Code, as added
3535 by this Act, applies only to a grant agreement entered into on or
3636 after the effective date of this Act. A grant agreement entered
3737 into before the effective date of this Act is governed by the law in
3838 effect on the date the agreement was entered into, and the former
3939 law is continued in effect for that purpose.
4040 SECTION 3. This Act takes effect September 1, 2009.
