88 AN ACT
99 relating to the jurisdiction of the court over a nonresident
1010 manufacturer in a products liability action involving a
1111 nonmanufacturing seller.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 82.003, Civil Practice and Remedies
1414 Code, is amended by adding Subsection (c) to read as follows:
1515 (c) If after service on a nonresident manufacturer through
1616 the secretary of state in the manner prescribed by Subchapter C,
1717 Chapter 17, the manufacturer fails to answer or otherwise make an
1818 appearance in the time required by law, it is conclusively presumed
1919 for the purposes of Subsection (a)(7)(B) that the manufacturer is
2020 not subject to the jurisdiction of the court unless the seller is
2121 able to secure personal jurisdiction over the manufacturer in the
2222 action.
2323 SECTION 2. The change in law made by this Act applies to an
2424 action filed on or after the effective date of this Act or pending
2525 on the effective date of this Act.
2626 SECTION 3. This Act takes effect immediately if it receives
2727 a vote of two-thirds of all the members elected to each house, as
2828 provided by Section 39, Article III, Texas Constitution. If this
2929 Act does not receive the vote necessary for immediate effect, this
3030 Act takes effect September 1, 2009.
