4	4	A BILL TO BE ENTITLED
5	5	AN ACT
6	6	relating to the prohibition of signs along certain roads.
7	7	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	8	SECTION 1. Section 391.252, Transportation Code, is amended
9	9	by amending Subsection (a) and adding Subsections (d) and (e) to
10	10	read as follows:
11	11	(a) A person may not erect an off-premise sign that is
12	12	adjacent to and visible from:
13	13	(1) U.S. Highway 290 between the western city limits
14	14	of the city of Austin and the eastern city limits of the city of
15	15	Fredericksburg;
16	16	(2) State Highway 317 between the northern city limits
17	17	of the city of Belton to the southern city limits of the city of
18	18	Valley Mills;
19	19	(3) State Highway 16 between the northern city limits
20	20	of the city of Kerrville and Interstate Highway 20;
21	21	(4) U.S. Highway 77 between State Highway 186 and
22	22	State Highway 44;
23	23	(5) U.S. Highway 281 between:
24	24	(A) State Highway 186 and Interstate Highway 37,
25	25	exclusive of the segment of U.S. Highway 281 located in the city
26	26	limits of Three Rivers; and
27	27	(B) the southern boundary line of Comal County
28	28	and State Highway 306;
29	29	(6) State Highway 17 between State Highway 118 and
30	30	U.S. Highway 90;
31	31	(7) State Highway 67 between U.S. Highway 90 and
32	32	Farm-to-Market Road 170;
33	33	(8) Farm-to-Market Road 170 between State Highway 67
34	34	and State Highway 118;
35	35	(9) State Highway 118 between Farm-to-Market Road 170
36	36	and State Highway 17;
37	37	(10) State Highway 105 between the western city limits
38	38	of the city of Sour Lake to the eastern city limits of the city of
39	39	Cleveland;
40	40	(11) State Highway 73 between the eastern city limits
41	41	of the city of Winnie to the western city limits of the city of Port
42	42	Arthur;
43	43	(12) State Highway 21 between the southern city limits
44	44	of the city of College Station and U.S. Highway 290;
45	45	(13) a highway located in:
46	46	(A) the Sabine National Forest;
47	47	(B) the Davy Crockett National Forest; or
48	48	(C) the Sam Houston National Forest;
49	49	(14) Segments 1 through 4 of State Highway 130;
50	50	(15) a highway in Bandera County that is part of the
51	51	state highway system;
52	52	(16) Farm-to-Market Road 3238 beginning at State
53	53	Highway 71 and any extension of that road through Hays and Blanco
54	54	Counties;
55	55	(17) Farm-to-Market Road 2978 between Farm-to-Market
56	56	Road 1488 and the boundary line between Harris and Montgomery
57	57	Counties;
58	58	(18) U.S. Highway 90 between the western city limits
59	59	of the city of San Antonio and the eastern city limits of the city of
60	60	Hondo; [or]
61	61	(19) the following highways in Austin County:
62	62	(A) State Highway 159;
63	63	(B) Farm-to-Market Road 331;
64	64	(C) Farm-to-Market Road 529;
65	65	(D) Farm-to-Market Road 1094; and
66	66	(E) Farm-to-Market Road 2502; or
67	67	(20) after the date of written notice of the order to
68	68	the department, a public road or portion of a public road located in
69	69	a county under Subsection (e) and outside the corporate limits of a
70	70	municipality, if designated by order of the commissioners court of
71	71	the county in which the road or portion of the road is located.
72	72	(d) A commissioners court may adopt an order under
73	73	Subsection (a)(20) only after conducting a public hearing on the
74	74	proposed order.
75	75	(e) Subsection (a)(20) applies only in a county that:
76	76	(1) has a population of 20,000 or more but less than
77	77	25,000;
78	78	(2) does not contain a municipality that has a
79	79	population of 5,000 or more; and
80	80	(3) is adjacent to a county that has a population of
81	81	50,000 or more.
82	82	SECTION 2. This Act takes effect September 1, 2009.
