| 7 | 7 | | relating to participation by certain educational aides in a school |

| 8 | 8 | | district's mentoring program. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 21.458, Education Code, is amended by |
|---|
| 11 | 11 | | adding Subsection (a-1) and amending Subsection (c) to read as |
|---|
| 12 | 12 | | follows: |
|---|
| 13 | 13 | | (a-1) Each school district may assign a mentor to each |
|---|
| 14 | 14 | | educational aide who has less than one year of classroom |
|---|
| 15 | 15 | | experience. A person assigned as a mentor under this subsection is |
|---|
| 16 | 16 | | not required to be a teacher and is not subject to the requirements |
|---|
| 17 | 17 | | prescribed by Subsections (a) and (b) that apply to a mentor teacher |
|---|
| 18 | 18 | | assigned to mentor a classroom teacher. |
|---|
| 19 | 19 | | (c) From the funds appropriated to the agency for purposes |
|---|
| 20 | 20 | | of this section, the commissioner shall adopt rules and provide |
|---|
| 21 | 21 | | funding to school districts that assign mentors [mentor teachers] |
|---|
| 22 | 22 | | under this section. Funding provided to districts under this |
|---|
| 23 | 23 | | section may be used only for providing: |
|---|
| 24 | 24 | | (1) mentor [teacher] stipends; |
|---|
| 25 | 25 | | (2) scheduled time for mentors [mentor teachers] to |
|---|
| 26 | 26 | | provide mentoring to assigned classroom teachers and educational |
|---|
| 27 | 27 | | aides; and |
|---|
| 28 | 28 | | (3) mentoring support through providers of mentor |
|---|
| 29 | 29 | | training. |
|---|
| 30 | 30 | | SECTION 2. This Act applies beginning with the 2009-2010 |
|---|
| 31 | 31 | | school year. |
|---|
| 32 | 32 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 33 | 33 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 34 | 34 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 35 | 35 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 36 | 36 | | Act takes effect September 1, 2009. |
