| 8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 9 | 9 | SECTION 1. Subchapter A, Chapter 456, Transportation Code, | |
| 10 | 10 | is amended by adding Section 456.009 to read as follows: | |
| 11 | 11 | Sec. 456.009. ALLOCATION OF FUNDS. (a) The commission | |
| 12 | 12 | shall adopt rules to allocate funds to designated recipients under | |
| 13 | 13 | this chapter. | |
| 14 | 14 | (b) Of the total amount of money allocated under this | |
| 15 | 15 | chapter, the commission may not distribute: | |
| 16 | 16 | (1) less than 90 percent of the total amount allocated | |
| 17 | 17 | under the formula program provided by Subchapter B; and | |
| 18 | 18 | (2) more than 10 percent of the total amount allocated | |
| 19 | 19 | under the discretionary program provided by Subchapter C. | |
| 20 | 20 | SECTION 2. This Act takes effect September 1, 2009. |
