55 AN ACT
66 relating to weight limits on a vehicle loaded with certain
77 agricultural products.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 621.508, Transportation Code, is amended
1010 to read as follows:
1111 Sec. 621.508. AFFIRMATIVE DEFENSE FOR OPERATING VEHICLE
1212 OVER MAXIMUM ALLOWABLE AXLE WEIGHT. It is an affirmative defense to
1313 prosecution of, or an action under Subchapter F for, the offense of
1414 operating a vehicle with a single axle weight or tandem axle weight
1515 heavier than the axle weight authorized by law that at the time of
1616 the offense the vehicle:
1717 (1) had either:
1818 (A) a single axle weight or tandem axle weight
1919 that was not heavier than the axle weight authorized by law plus 12
2020 percent; or
2121 (B) a combination of single axle weights and
2222 tandem axle weights heavier than the axle weight authorized by law,
2323 so long as each axle weight or tandem axle weight does not exceed
2424 the axle weight authorized by law plus six percent;
2525 (2) was loaded with timber, pulp wood, wood chips, or
2626 cotton, livestock, or other agricultural products that are:
2727 (A) in their natural state; and
2828 (B) being transported from the place of
2929 production to the place of first marketing or first processing; and
3030 (3) was not being operated on a portion of the national
3131 system of interstate and defense highways.
3232 SECTION 2. This Act takes effect September 1, 2009.
