55 AN ACT
66 relating to creating an account to promote continuing education for
77 certain child care providers.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 42.0521, Human Resources Code, is
1010 amended to read as follows:
1111 Sec. 42.0521. EARLY CHILD CARE DEVELOPMENT ACCOUNT; DEPOSIT
1212 OF FEES. (a) The early child care development account is an
1313 account in the general revenue fund that may be appropriated only to
1414 the department for the purposes and activities authorized by this
1515 section and for reasonable administrative expenses under this
1616 chapter.
1717 (b) The account consists of:
1818 (1) the [The] fees authorized by this chapter and
1919 received by the department;
2020 (2) all money appropriated for the purposes of this
2121 section;
2222 (3) any gifts, grants, or donations received for the
2323 purposes of this section; and
2424 (4) interest earned on money in the account.
2525 (c) The account is exempt from the application of Section
2626 403.095, Government Code.
2727 (d) The purpose of the account is to support continuing
2828 education initiatives that:
2929 (1) implement infant and toddler child care best
3030 practices for caregivers of children from birth to age three;
3131 (2) promote the development of secure, consistent,
3232 responsive relationships and attachments between child care
3333 workers and the infants and toddlers in their care; and
3434 (3) provide training and knowledge on the importance
3535 of the emotional development of infants and toddlers [shall be
3636 deposited in the general revenue fund].
3737 SECTION 2. This Act takes effect immediately if it receives
3838 a vote of two-thirds of all the members elected to each house, as
3939 provided by Section 39, Article III, Texas Constitution. If this
4040 Act does not receive the vote necessary for immediate effect, this
4141 Act takes effect September 1, 2009.
