8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Section 681.001, Transportation Code, is amended |
---|
10 | 10 | | by adding item (8) to read as follows: |
---|
11 | 11 | | (8) "Optometry" and "Therapeutic Optometry" have the |
---|
12 | 12 | | meanings assigned by Section 351.002, Occupations Code. |
---|
13 | 13 | | SECTION 2. Section 681.003(e), Transportation Code, is |
---|
14 | 14 | | amended to read as follows: |
---|
15 | 15 | | (e) If a first application for a disabled parking placard |
---|
16 | 16 | | under this section is made by or on behalf of a person with: |
---|
17 | 17 | | (1) a mobility problem caused by a disorder of the |
---|
18 | 18 | | foot, the notarized written statement or written prescription |
---|
19 | 19 | | required by Subsection (c) may be issued by a person licensed to |
---|
20 | 20 | | practice podiatry in this state or a state adjacent to this state; |
---|
21 | 21 | | or |
---|
22 | 22 | | (2) a disability caused by visual impairment in |
---|
23 | 23 | | accordance with Sec. 681.001 of this chapter, the notarized written |
---|
24 | 24 | | statement or written prescription required by Subsection (c) may be |
---|
25 | 25 | | issued by a person licensed to practice optometry or therapeutic |
---|
26 | 26 | | optometry in this state or a state adjacent to this state. |
---|
27 | 27 | | SECTION 3. The changes in law made by this Act apply only to |
---|
28 | 28 | | an application for a disabled parking placard submitted on or after |
---|
29 | 29 | | the effective date of this Act. An application submitted before the |
---|
30 | 30 | | effective date of this Act is governed by the law in effect on the |
---|
31 | 31 | | date the application is submitted, and the former law is continued |
---|
32 | 32 | | in effect for that purpose. |
---|
33 | 33 | | SECTION 4. This Act takes effect September 1, 2009. |
